COUNCIL AGENDA STATEMENT Item 7 Meeting Date 7/7/81 ITEM TITLE: Resolution /DS,3~Extending Maximum Vacation Accrual Limit for Fire Engineer Raymond Leebolt SUBMITTED BY: Director of Person (4/5ths Vote: Yes No ) ' BACKGROUND In 1976, the City Council amended the Civil Service Rules by placing a maximum accrual limit on vacation hours, The limit was twice the amount an employee could earn in one year of service. ' In a recent situation, a Fire Engineer reached his maximum and subsequently became ill. He has requested a waiver of the rule which limits his accrual in order that he may use his accumulated sick leave while sick (broken ankle). Such a waiver would permit ' Mr. Leebolt to use his sick hours during the time he is unable to return to work, while at the same time prevent any loss of vacation hours. Therefore, it is my RECOMMENDATION: That Council adopt the resolution waiving Rule 2.02.B.2.(e) and . ~ Section 2.10.A.1. of the MOU between the City and I.A.F.F. Local 2180 for 1981-82 for Raymond Leebolt until such time as he returns to work, and requiring that he reduce the excess within six months of his return. BOARD/COP~MISSION RECOMMENDATION: That Council waive the provisions in Rule 2.02.B.2.(e) allowing Raymond Leebolt to accrue vacation hours over the maximum limit until he is able to return to work, and requiring that he reduce the balance below the maximum limit within six months of his return. DISCUSSION: At the Civil Service Commission meeting of 6/11/81, the special circumstances surrounding Raymond Leebolt's absence from work due to illness were discussed. Mr. Leebolt had reached his maximum vacation accrual limit April 16, 1981 before he broke his ankle on May 6, 1981. As a result, vacation hours which would have accrued to Mr. Leebolt were being lost. This situation was acceptable to him, although he had the opportunity to schedule and use vacation to bring his balance below the limit. In fact, he had -~ scheduled a vacation for July 7-July 17 (96 hours) and could have taken single days prior to that time. However, once Mr. Leebolt broke his ankle he did not wish to use ^~ vacation hours, but wished to use sick hours which he accumulated for this purpose. Rule 2.02.C.5.(e). specifically allows an employee on vacation to use sick leave instead of vacation if an illness or injury occurs. Now, in order to allow the use of . sick hours when sick, and prevent the loss of vacation hours, a waiver of the maximum vacation accrual is required. Although the Commission made a recommendation regarding the Civil Service Rules only, the MOU between the City and the I.A.F.F. Local 2180 would require a waiver of the maximum vacation limit provision in order to authorize excess accumulation for Mr. Leebolt. -~ Mr. Leebolt made his request fora waiver on the maximum vacation limit on 5-8-81. If the resolution is adopted, it is recommended that the waiver be made retroactive to 5-8-81, and that Fire Engineer Leebolt be required to reduce his balance below the regular limit within six months of returning to work or lose the excess accrued during his illness.
