SUMMARY
On September 29, 2010, the Director of Public Works received sealed bids for the "Robinhood
Ranch Unit II, Sewer Pump Station Improvements - Phase II (SW256A)" Project. The work to be
done consists of the removal and disposal of existing improvements, installation of storm drain
pipes and structures, sidewalk, driveway, concrete slab, and retaining walls. The proposed action
would: (1) waive a minor clerical error that resulted in a lower total bid, (2) award the contract to
TED Enterprises, Inc, and (3) authorize the expenditure of available funds, as needed, to
complete the work in accordapce with City standards.
ENVIRONMENTAL REVIEW
The Enviromnental Review Coordinator has reviewed the proposed project for compliance with
the Califomia Enviromnental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1 categorical exemption pursuant to Section 15301 [Existing Factlities] of the State

CEQA Guidelines because the project consists of removal and replacement of existing facilities
with negligible expansion. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
The general scope of the Robinhood Ranch Unit II, Sewer Pump Station Improvements- Phase II
project is to complete site improvements for the sewer pump station and replace the existmg
crushed storm drain system, construction of a headwall, rip-rap energy dissipater, clean-out,
concrete slab, and driveway all within the same parcel. The work also includes all labor,
materials, equipment, transportation and protection of existing improvements and other work
necessary to complete the project.
On September 29, 2010, the Director of Public Works received twelve (12) bids for the
"Robinhood Ranch Unit II, Sewer Pump Station Improvements- Phase II (SW256A)" Project.
The following bids were received:

Staff reviewed the apparent low bid proposal in the amount of $85,235 submitted by TED
Enterprise, Inc. During review of TED Enterprise's bid proposal, staff found that the contractor
had a minor mathematical error in a specific bid item subtotal; however, the grand total was
correct and the unit bid pri"Ce remained the same. TED Enterprise, Inc. submitted a letter
acknowledging said clerical error and stands by the corrected bid item subtotal (Attachment 1).
The low bid submitted by TED Enterprise Incorporated is below the Engineer's estimate of
$92,900 by $7,665 (9% below the Engineer's estimate). Design staff has verified the references

provided hy the contractor and has determined that the contractor has perfonned satisfactorily for
those references. The Contractor's License No. 949397A is current amI active.
Also for consideration is the authority of the Director of Public Works to approve change orders
over and above existing policy limits. Under City Council Policy No. 574-01, if an individual
change order causes the cumulative increase in change orders to exceed the Director's authority
("Maximum Aggregate Increase in Change Orders"), then City Council approval is required.
The base contract amount for the subject project is 585,235. The corresponding maximum
aggregate contract increase that may be approved by the Director of Public "vVorks under Policy
No. 574-01 is $8,523.50. Approval of tonight's resolution will increase the Director of Public
Works' authority to approve change orders as necessary up to the contingency amount of
$17,000, an increase of $8476.50 and will authorize the expenditure of all available
contingencies and to increase the valLIe of the contract, as necessary, resulting trom
unforeseeable conditions and unit quantity adjustments. Unforeseen conditions include such
items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the
contingency funds are not used, then they will be returned to the project fund balance.
Disclosure Statement
Attached is a copy of the contractor's Disclosure Statement as Attachment 2.
Wage Statement
Contractors bidding on this project were not required to pay prevailing wages to persons
employed by them for work under this project, No special minority or women owned business
requirements were necessary as part of the bid documents. However, the "Notice to Contractors"
was sent to various trade publications in order to encourage disadvantaged businesses to bid on
the proj eet.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision
concerns repairs, replacement, or maintenance of existing streets or similar facilities and,
therefore, there is not a material financial effect of the decision on the property holdings of the
City Council Members pursuant to California Code of Regulations sections 18704.2(b)(2) and
18705 .2(b)( I).
CURRENT YEAR FISCAL IMPACT
There is no impact to the General Fund. At this time, statI is recommending an inter-project
transfer in the amount of $100,000 from existing capital improvement project (DRI80) to CIF
SW256A, and appropriating $15,000 from the Sewer Replacement Facilities Available Fund
balance to SW256A as necessary to complete the project. A breakdown of the project costs is as
follows:

WHEREAS, the apparent low bid by TED Enterprise, Inc. of $85,235.00 is below the

WHEREAS, staff has verified the references provided by the contractor and their work
record has been satisfactory; and
WHEREAS, the engineer's estimate was based on average prices for similar types of
work completed during the last two years; and
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista
does hereby waive mathematical irregularities, accept bids and award the contract for the
"Robinhood Ranch Unit II, Sewer Pump Station Improvements - Phase II (SW256A)" to TED
Enterprises, Inc., in the amount of $85,235; authorize an inter-project transfer in the amount of
$100,000 from existing project DR180 to SW256A; appropriate $15,000 from the Sewer
Replacement Facilities available fund balance to SW256A; and authorize the expenditure of all
available funds.
