This project is part of the Bicycle Transportation Account (BTA) grant, Three Part Bicycle Facilities Improvement, to replace inductive loop systems with new video detection cameras at the intersections of E Street/Bay Boulevard and H StreetlBay Boulevard. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class I categorical exemption pursuant to Section 153301 (c) (Existing Facilities) of the State CEQA Guidelines because the improvements will be installed on streets. Thus, no further environmental review is necessary. RECOMMENDATION Council adopts the resolution.: BOARDS/COMMISSION RECOMMENDATION Not applicable. 9-1 11/09/10, Iteml Page 2 of 3 DISCUSSION On November 25, 2008 by ResolutlOn Number 2008-262, the City Council approved the Local Agency-State Agreement for Bicycle Transportation Account Project (Local Agency-State Agreement) to provide bicycle amenities for commuters. The BT A grant project is a Three Part Bicycle Facilities Improvement, to provide for bicycle amenities such as replacement of bus- mounted bike racks, roadway signage for bicycle facilities and traffic signal video detection units, in order to encourage alternative modes of transportation. The proposed action would allow the City to enter into a contract for the replacement of existing inductive detection loops with video detection cameras at two intersections. All other objectives of the Three Part project have been completed. City staff advertised the prevailing wage project on September 24, 20 I 0 and received five (5) bids on October 13, 2010. The following table summarizes the bids received: CONTRACTOR BID 1 HMS Construction, Inc. - Vista, CA $ 59,900 2 Lekos Electric, Inc. - El Cajon, CA $ 79,810 3 DBX Inc. - Temecula, CA $ 84,710 4 Republic, ITS - El Cajon, CA $149,375 Palm Engineering Construction - Riverside, CA 5 (The bid amount had a math error of $63,000. The correct total should $151,910 have been $88,910) The low bid submitted by HMS Corporation, Inc. is above the Engineer's estimate of$54,000 by $5,900, or approximately 10%. This difference is attributable to the fact that staff underestimated the cost for the Video Imaging Detection System bid item; staffs estimate was based upon an average unit cost for this item from previous bid submittals for similar projects. The Contractor has satisfactorily completed similar traffic signal modification work with the City within the last two years. Staff has reviewed HMS Construction, Inc.'s bid submittal and has determined it to be responsive. Therefore, staff recommends awarding the TF369 project contract to HMS Constmction, Inc. Wage Statement The work to be done under this contract is State funded. Contractors are obligated to pay not less than the state prevailing wages to persons employed by them for work under this contract. General prevailing wage rates (California Labor Code SlnO-1815) are predetermined by the Department ofIndustrial Relations and are effective at the date of the contract award. Disclosure Statement Attachment I is a copy of the Contractor's Disclosure Statement. 9-2 11109110, Itern~ Page 3 of 3 DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property, which is the subject of this action. CURRENT YEAR FISCAL IMPACT On November 25, 200S by Resolution Number 2110S-263, the City Council accepted and appropriated the Bicycle Transportation Account (BT A) funds for fiscal year 200S/2009 in the amount of $135,630, estabhsheu the Three Part Bicycle FacilitIes Project, authorized the transfer of li.mds in the amount of $15,070 ($11,000 from the Traffic Signal Fee Fund, $2,750 from the Transportation Development Act (TDA) Fund, and $1,320 from TransNet funds), and amenued the FY200S/20W CIP program. A breakdown ofthe project costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $59,900 B. Contingencies (15%) $ S,9S5 C. Staff Cost (Construction Inspection, Survey, Design) $ 5,115 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $74,000 PROJECT BUDGET A. Transit Cap Project (remaining fund available) $ 1,000 B. BTA Grant (Local match reimbursement of 10%) $73,000 TOTAL PROJECT BUDGET $74,000 Sufficient funds are available in the TF369 project account to complete the contract work. ON-GOING FISCAL INfPACT Completion of the project will have no fiscal impact to the City. The improvements will be owned and maintained by Ca!trans. ATTACHMENTS 1. TF369)" PROJECT TO HMS CONSTRUCTION, INe. IN THE AMOUNT OF $59,900 WHEREAS, City staff prepared prevailing wage contract specifications and advertised the project on September 24, 2010; and WHEREAS, on November 25, 2008 by Resolution number 2008-262, the City Council approved the Local Agency-State Agreement for Bicycle Transportation Account (BTA) project, a Three Part Bicycle Facilities Improvement; and WHEREAS, as part of the Three Part Bicycle Facilities Improvement, this project will replace existing inductive loops with video detection camera at two intersections while the other parts were complete; and WHEREAS, on October 13, 2010, the Director of Public Works received five (5) sealed bids for the project as follows: CONTRACTOR BID I HMS Construction, Inc. - Vista, CA $ 59,900 2 Lekos Electric, Inc. - EI Cajon, CA $ 79,810 3 DBX Inc. - Temecula, CA $ 84,710 4 Republic, ITS - EI Cajon, CA $149,375 Palm Engineering Construction - Riverside, CA 5 (The bid amount had a math error of $63,000. The correct total should $151,910 have been $88,910) WHEREAS, the low bid by HMS Construction, Inc. is above the Engineer's estimate of $54,000 by $5,900, or approximately 10% due to a lower estimated unit cost by the Engineer for the "Furnish and Install Video Imaging Detection System;" and WHEREAS, HMS Construction Inc. has installed traffic signal projects in the City with satisfactory performance; and WHEREAS, there are'sut1icient funds in TF369 project for Construction expenditure, funded from the Transit Cap Project and BT A grant fund (appropriated by City Council Resolution 2008-263). 9-6 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award the contract for the "Traffic Signal Modification at Two Intersections at E StreetlBay Boulevard and H Street/Bay Boulevard" TF369 Project to HMS Construction, Inc. in the amount of $59,900.
