SUMMARY
On September 29, 2010, the Director of Public Works received sealed bids for the "Castle Park
Storm Water Treatment" in the City of Chula Vista, California (STLJ06A)" project. The work
to be done consists of the installation of Modular Wetland Systems bio-filtration units, at the
intersections of Second Avenue and Palomar Street, Fifth Avenue and Naples Street, and Fifth
Avenue and Emerson Street, all in the City of Chula Vista, Califomia. The proposed action
would award the contract to Ncw Century Constmction and authorize the Director of Public
Works to expend all available funds in the project.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class I categorical exemption pursuant to Section 15301 (Existing Facilities) of the State
CEQA Guidelines because the proposed biofiltration units will be installed to mitigate "offsite"
storm water impacts and involve no expansion of existing street right-of-way. Thus no tllrther
CEQA review or documentation is necessary. Additionally, the Environmental Review
Coordinator has reviewed the proposed project for compliance with the National Environmental
Polley Act (NEPA) due to the use of federal CDBG funds, and has determined that the project
quallfies for a Categorical Exclusion (Subject to 58.5) pursuant to Title 24, CFR Section 58.35(a)
as implemented by the U.S. Department of Housing and Urban Development (HUD) Guidelines.
Thus, no further NEP A review or documentation is necessary.

DISCUSSION
The Southwestern Chula Vista Street Improvements project (STL306) is an eXIstmg CIP
established in FY 04/05 and is programmed to undertake street improvements in the Castle Park
area of western Chula Vista. These improvements are funded through a $9.5 million Housing and
Urban Development (HUD) Section 108 loan. The Castle Park Area Storm Water Treatment
(STL306A) project utilizes this funding to provide offsite mitigation of impacts resulting from
the inability to sufficiently treat storm water as part of the onsite design and construction of the
aforementioned street improvements in the Castle Park area. The First Avenue Improvements
project (STU03), constructed in January of2009, is one such project within the Castle Park area
benefiting from this mitigation. The resolution proposed for City Council approval would install
Modular Wetland Svstems bio-filtration units, at the intersections of Second Avenue and

Palomar Street, Fifth Avenue and Naples Street, and Fifth Avenue and Emerson Street, all in the
City of Chula Vista, California.
The general scope of Castle Park Area Storm Water Treatment project involves excavation and
grading, removal and disposal of existing improvements, installation of Modular Wetland
Systems bio-filtration units, installation of asphalt concrete pavement, crushed aggregate base,
curb, gutter, sidewalk, and drainage improvements.
On September 29,2010, the Director of Public Works received and opened bids from ten (10)
contractors for the construction phase, as follow:

The low bid of $138,700, submitted by New Century Construction is below the Engineer's
estimate of S 140,680 by $1,980, or approximately 1.5%. The Contractor has satisfactorily

pCI-Eormed construction projects of similar scope for the City. The Contractor's License No.
614517 is current and active.
Staff has reviewed the low bid and detemlined the bid package was complete, with no errors or
omissions; therefore, staff recommends a\varding a contract in the amount of $138,700 to New
Century Constmction.
The proposed resolution would also authorize the Director of Public Works to approve change
orders over and above existing policy limits. Under City Council Policy No. 574-01, if an
individual change order causes the cumulative increase in change orders to exceed the Director's
authority CMaximum Aggregate Increase in Change Orders"), then City Council approval is
required. The corresponding maximum aggregate contract increase that may be approved by the
Director of Public Works under Policy No. 574-01 is $12,709. Approval of tonight's resolution
would increase the Director of Public Works' authority to approve change orders, as necessary,
up to the contingency amount of $20,805, an increase of $8,096 over Policy No. 574-0l.
Increasing the contingency funds will allow staff to continue the project without delay should
unforeseen circumstances resulting in increased project costs arise during the course of
construction, as well as make adjustments to bid item quantities. Unforeseen conditions include
such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. [fthe
contmgency funds are not used, then they will be returned to the project fund balance.
Disadvanta~ed Business Enterprise Goal
The bid documents set forth participation requirements per Federal Regulation for meeting the
disadvantaged and women-owned business goals.
Staff also reviewed New Century Construction's eligibility status with regard to federal
procurement programs and the status of. the State contractor's licenses. New Century
Construction is not listed as excluded fi'om Federal Procurement Pro!,,'fams.

Attachment 1 is a copy of the Contractor's Disclosure Statement.
Wage Statement
Contractors bidding on this project are required to pay prevailing wages to persons employed by
them for work under this project. No special minority or women owned business requirements
were necessary as part of the bid documents. However, the "Notice to Contractors" was sent to
various trade publications in order to encourage disadvantaged businesses to bid on the project.
DECISION MAKER CONFLJCT
Stall has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property, which is the subject ofthis action.

There is no direct fiscal impact to the General Fund as the Section 108 Loan provides funding for
this project.
ON-GOING FISCAL IMPACT
Upon completion of the project and one-year contractor maintenance period, the improvements
will require only routine normal maintenance of the street facilities. The Public Works
department will incur maintenance cost in the range of $500 to $1,000 annually for each of the
Modular Wetland Systems installed with this project.

WHEREAS, the project consists of installing Modular Wetland Systems bio-filtration
units and appurtenant improvements, at the intersections of Second Avenue and Palomar Street,
Fitih Avenue and Naples Street, and Fifth Avenue and Emerson Street, all in the City ofChula
Vista, California, as an offsite means to mitigate storm water impacts resulting from
improvements to the Castle Park area of Chula Vista; and
WHEREAS, the work also includes all labor, material, equipment, transportation,
protection and restoration of existing improvements and traffic control necessary for the project
as shown on the drawings; and
WHEREAS, City staff prepared plans and specifications for the "Castle Park Storm
Water Treatment" in the City ofChula Vista, California (STL306A)" project; and
WHEREAS, on September 29, 2010, ten bids were received as follows:

opening, met the regulations and guidelines presented in the bid package and is declared to be
responsive; and

WHEREAS, the low bid by New Century Construction of $138,700 is $1,980 (1.5%)
below the Engineer's estimate of$140,680; and
WHEREAS, staff has reviewed the low bid and recommends awarding a contract in the
amount of $138,700 to New Century Construction; and
WHEREAS, approval of tonight's resolution will increase the Director of Public Works
authority to approve change orders as necessary and authorizing the expenditure of all available
funds in the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids and award the contract for the "Castle Park Storm Water
Treatment (STL306A) in the City of Chula Vista" Project to New Century Construction in the
amount of$138,700, and authorize the Director of Public Works to expend all available funds in
the project.
