Thc adoption of California building codes is a routine action tmdertaken by the City in response to State adopted building codes. This action allows the City to incorporate appropriate local amendmcnts into the cnforcement program. ENVIRONMENTAL REVIEW Thc Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmcntal Quality Act (CEQA) and has dctermined that thcre is no possibility that the activity may have a significant effect on the environment; therefore, pursuant to Section IS061(b)(3) of the State CEQA Guidelines the activity is exempt from the provisions of CEQA. Thus, no environmcntal review is necessary. RECOMMENDA nON That the City Council place the ordinances of the various 2010 Editions of the California building codes on first reading. BOARDS/COMMISSION RECOMMENDATION The Board of Appeals and Advisors at their Monday, October 11,2010 meeting unanimously recommended adoption of the various 20 I 0 Editions of the California building codes. DISCUSSION As mandated by the California Building Standards Commission (CBSC), jurisdictions within the State shall begin enforcing the 2010 Editions of the California building codes on January 1,2011. Every three years, the State adopts and amends the newest model codes published by the various independent code-developing bodies. New State building codes take effect one-hundred and eighty (180) days after they are published to allow local jurisdictions time to adopt local amendments to the State building codes before they take effect. Local amendments cannot be less restrictive than the State building codes and must be based on findings that the amendments are necessary becausc of local climatic, geological or topographical conditions. Local amendments are not effective until the amendments have been filed with the CBSC. The majority of the proposed local amendments currently exist in our Municipal Code as amendments to the current building codes adopted by the City and are carried forward as the City adopts thc 2010 codes. Staff is proposing new local amendments to the 20 I 0 California Green Building Standards Code (2010 CGBSC), proposed Ordinance "E", and the 2010 California Fire 5-2 Item No.: S Meeting Date: 11/09/2010 Page 3 of5 Code (20 I 0 CFC), proposed Ordinance "I". These local amendments will be discussed later in this report. All but two of the 2010 California codes are updated editions to the current codes that are enforced locally and throughout the state and therefore it should not be dinicult for staff and the industry to incorporate into their current practices. The 2010 California Residential Code (2010 CRC) is a completely new code to California and the 20 I 0 COBSe, which the prior edition was entirely voluntary, now contains mandatory and voluntary requirements for both residential and non-residential development. The following are brief discussions on the various ordinances adopting the 20 I 0 building codes: Proposed Ordinance "A" Administrative Provisions for the Technical Codes This ordinance proposes minor amendments to Municipal Code Chapter 15.06, Administrative Provisions for the Technical Codes. The proposed amendments remove the need to have to amend this Chapter every time new codes are adopted and revise the definition of Building Official due to the elimination of the position of Assistant Director of Planning and Building. Proposed Ordinance "B" - 201 0 California Buildinl< Code The proposed ordinance simply adopts the 2010 California Building Code and carries forward existing local amendments to the current Building Code adopted by the City. Proposed Ordinance "c" - 20 I 0 California Residential Code The 2010 CRC is a new code to California and is based on the 2009 International Residential Code, published by the International Code Council, with State amendments. The 2010 CRC applies "to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location. removal and demolition of detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress and their accessory structures." By incorporating prescriptive design methods, design tables and illustration drawings, the CRC simplifies the design and construction of low-rise one- and two-family dwellings and townhouses. New residential buildings and their accessory structures that fall outside the scope of the CRC will have to comply with the 2010 California Building Code. The CRC requires all new one- and two-family dwellings and townhouses to have tire sprinkler systems. This is the first time where a State building code has such requirement on one- and two-family dwellings. The average cost of a residential sprinkler system for a new home is $1.25 per square foot. Additions and remodels to existing one- and two-family dwellings and townJJouses that do not have an existing fire sprinkler system are exempt from this requirement unless other State or local codes trigger it. Staff is not proposing any local amendments to the 2010 CRC. Proposed Ordinance "D" ~ 2010 California Referenced Standards Code The proposed ordinance simply adopts the 20 I 0 California Referenced Standards Code. Statf is not proposing any local amendments to the code. 5-3 Item No.: 5 Meeting Date: Il/U9120 I 0 Page 4 of 5 Proposed Ordinance "E" - 20 I 0 Califomia Green Building Standards Code As part of the implementation of Measure # 4 of the Climate Change Working Group, on October 6, 2009, Council adopted Ordinance 2009-3140 adding Chapter 15.12, Green Building Standards (G13S), to the Municipal Code. The City's GBS is based on the early adoption of the State Housing and Community Development's (HCD) green building standards found in the all- voluntary 2008 California Green Building Standards Code (08 CGBSC), and requiring them on all new residential and non-residential buildings and additions and alterations to existing residential and non-residential buildings. The proposed ordinance amends MC Chapter 15.11 by adopting the 2010 CGBSC and local amendments. The 2010 CGBSC contains mandatory and voluntary requirements that apply to both residential and non-residential buildings. The 20 I 0 CGBSC applies only to new buildings and staff is proposing an amendment to also require it on additions, alterations and tenant improvements to existing buildings. This proposed amendment will bring the scope of the 2010 CG13SC to be in- line with the scope of the City's current G13S. Amending the code to require it on additions, alterations and tenant improvements created the need to amend other sections of the code where the requirements are unreasonable for these types of projects. Another proposed amendment to the 2010 CGBSC, in order to bring it in-line with the City's current G13S, is the addition of a subsection establishing the effective date of the residential indoor water use measures to be January 1,2011, the same date this code takes effect, instead of the date established by HCD which is July, 1,2011. These measures are currently required by the City's G13S. BCD delayed the effective date of these measures due to a concern that the products (low-flow fixtures, showerheads and toilets) may not be available to meet market demand when the code gets adopted statewide. These products have been required in Chula Vista since November of 2009 and there are no indications that local suppliers are having di fficulty meeting demand. In addition, due to the current slowdown in construction activity, staff does not anticipate a large increase in local demand between now and July 1,2011. Even though the Board of Appeals and Advisors (BOA&A) unanimously recommended to Council the adoption of the ordinances, a member of the Board expressed concern with the potential tlnancial impact these two proposed amendments can have on residential additions and alterations, and wanted Council to be aware of the concern when considering the adoption of these amendments. Staff explained to the BOA&A that the City's current GBS apply to additions, alterations and tenant improvements and that the proposed amendments will simply continue what is required today. In addition, staff informed the Board that the products required under the residential mandatory measures are readily available with a small, if any, cost premium above non-complying products. Proposed Ordinance "F" - 2010 California Mechanical Code The proposed ordinance simply adopts the 1010 California Mechanical Code. Staff is not proposing any local amendments to the code. Proposed Ordinance "G" - 2010 California Electrical Code 5-4 Item No.: '5 Meeting Date: 11/09/2010 Page 5 of 5 The proposed ordinance simply adopts the 20 I 0 California Electrical Code and carries forward existing local amendments to the current Electrical Code adopted by the City. Proposed Ordinance "H" - 2010 California Plumbing Code The proposed ordinance simply adopts the 20 I 0 California Plumbing Code and carries forward existing local amendments to the current Plumbing Code adopted by the City. Proposed Ordinance ''1'" - 2010 California Fire Code The proposed ordinance adopts the 2010 California Fire Code and carries forward existing local amendments to the current Fire Code adopted by the City. Additionally, two new amendments have been set forth therein. The first new amendment adopts the California State Fire Marshal's GuiJelines for the installation of Solar Photovoltaic Systems (Attaclmlent 2). These provisions will ensure safety for firefighters when working around this technology; and afford operational access to key building features, such as the roof. The second new amendment aligns the California Fire Code's requirements for 'Artwork' to match the requirements of the Life Safety Code. This alignment is also in concert with a majority of the fire depmiments throughout San Diego County. DECISION MAKER CONFLICT Staff has determined that the recommendations requiring Council action are not site specific and consequently the 500 foot rule found in California Code of Regulations Section I 8704.2(a)(l ) is not applicable to iliis decision. CURRENT YEAR FISCAL IMPACT There are no increases in fees proposed in this adoption. The cost of new code books and related training is inclnded in tlle current year's budget. Building permit fees will need to be adjusted to recover the cost of the additional staff time associated with plan review and inspection. The additional staff time will be accounted for in updates to building permit fees. ONGOING FISCAL IMPACT No ongoing fiscal impact. The additional bnilding permit review and inspection time associated with implementing these ordinances will be funded through updated building permit fees. A TT ACHMENTS I. In addition, Member Bejarano and Vice Chair, Rita Buencamino-Andrews chose not to extend their second terms so now there would be three vacancies to fill. Mr. EI-Khazen said the committee would need to elect a Chair and Vice Chair for the new fiscal year 2010-2011, and asked the commission to go through the election first before they go on to other items on the agenda. 1. ROLL CALL: Members present constituted a quorum. 2. APPROVAL OF MINUTES: September 14,2009 MSC (LM/AS) (4-0-0-1) Approve the minutes of September 14, 2009. Motion carried with Member Lopez absent. 3. NEW BUSINESS: A Election of Chair and Vice-Chair for fiscal year 2010-11. B Ordinances adopting the various 2010 building codes and local amendments. Building Official, Lou EI-Khazen, presented the proposed ordinances and amendments outlined in the staff report. He stated that the majority of the proposed amendments are currently in the Municipal Code (MC) and are carried over as the City adopts the updated codes. Mr EI-Khazen noted that all but two of the 2010 California codes are updated editions to the current codes. The 2010 California Residential Code (2010 CRC) is a completely new code to California and the 2010 California Green Building Standards .Code (2010 CGBSC), which was entirely voluntary. now contains mandatory and voluntary requirements for both residential and non-residential projects. Mr EI-Khazen stated that the 2010 CRC requires all new one and two family dwellings and townhouses (including attached garages) to have fire sprinkler systems. He mentioned this was the first time a State building code has such requirements on one and two family dwellings. 5-6 Board of Appeals & Advisors Meeting Minutes October 11, 2010 Mr. EI-Khazen said the Deputy Fire Chief/Fire Marshall, Justin Gipson has been working with the water districts to see how the cost for additional meters or enlarging the size of the meters could be minimized so that the financial impact to the residents and builders is minimized. Justin Gipson stated that he has been working with three water districts (CA American, Sweetwater Authority and Otay Water). In the past what had driven the cost of putting in home sprinklers was a capacity fee. These utility companies have agreed to not charge the additional capacity fee when a sprinkler system is required which will help minimize the cost. The building official discussed the 2010 CGBSC. He noted it wasn't a new code but now it has mandatory requirements. He'stated that the City's current green building standards (GBS), MC Chapter 15 12 adopted October 2009, are based on the early adoption of the State Housing and Community Development's (HCD) green building standards found in the all-voluntary 2008 California Green Building Standards Code (08 CGBSC), and that they are required on all new residential and non-residential buildings and additions and alterations to existing residential and non-residential buildings. He also stated that the proposed ordinance amends MC Chapter 1512 by adopting the 2010 CGBSC and local amendments. Member Jones commented that the proposed standards are more stringent than the state's 2010 CGBSC in that the City is amending the scope to include additions and alterations and amending the effective date of the indoor water conservation measures to be 1/1/2011 instead of 7/1/2011. Mr EI Khazen explained that these measures are currently required in our MC and that the purpose of the proposed amendments is to maintain what is required today. Member Jones stated that essentially he wasn't against the 2010 CGBSC per se, as he believed in conservation measures; he practiced them himself. He stated that he is concerned about the additional construction cost to additions and remodels especially in today's economy and these amendments would only burden the consumer further, ultimately affecting the construction industry Member Johns stated that in his opinion, our civic leaders were imposing these standards onto Chula Vista residents unfairly. He suggested to staff that the amendments be reconsidered, or delayed for one to two years in order to allow the economy time to recover Mr. EI-Khazen stated that because City Council adopted the current GBS just last year and required them on additions and alterations, that it would be Council's expectation that they are carried forward when adopting new measures. Mr. EI-Khazen offered to include Member Johns' concerns in the staff report to Council. There was discussion amongst the Board on what the outcome to the residential consumer would be if these amendments were passed. Member Meservy acknowledged Member Jones's concerns and commended him for practicing conservation measures. However, he didn't feel the majority of the public would be as conscientious and felt the proposed amendments are valid and supported them. Mr. EI-Khazen pointed out that the products required under the mandatory residential requirements are readily available at local home improvement stores and soon may be the only products that can be found in the market. Mr. EI-Khazen also stated that the cost difference between complying and non-complying products is small if any. Member Meservy wanted clarification of consultant services noted in section 102.4, if this was a City of Chula Vista requirement? Mr. EI-Khazen stated this amendment is a carryover of what the City currently has in the MC and It is intended to allow the building official to require the opinion of a third- party consultant when complex energy efficiency or green building measures are proposed and the City does not have the required expertise to verify compliance at time of plan review He also stated that the code itself has language that addresses special inspection and third party certifications. Member Meservy said he had to leave, (6:40 p.m.) however, he had read the material and was willing to leave a standing vote to accept all of the proposed amendments. The Chair and Mr. EI-Khazen discussed the pre-plumbing for photovoltaic systems and solar water heaters. Mr. EI-Khazen explained the requirement is to have stubbing from the roof, so at a later time when the owner wants to install this system they are not penetrating the roof, which may void the 5-7 Board of Appeals & Advisors Meeting Minutes October 11, 2010 roofing warranty. The cost to do this is very minor it would run about $200- $300 for material and labor A similar procedure would apply to solar water heater. The building official and Deputy Fire Chief/Fire Marshal Gipson presented the proposed ordinance adopting the 2010 California Fire Code and amendments. Member Jones noted the State Fire Marshal's Guidelines was not included in the packets, he actually found it on line. He saw nothing wrong with the guidelines. His only recommendation to staff would be that this kind of information be provided in the future for any department that wants to come before this committee. This would help the committee make informative decisions about the items being presented before them. Mr EI- Khazen said that Member Jones made a good 'point and this kind of information would be provided in the future. Chair Sanfilippo and Fire Chief Gipson discussed the operational permit for Christmas tree lots. The Chair wanted to ensure that the permit addresses the residual of unsold trees and their expedient removal from the lots because of fire hazards. Fire Chief Gipson stated these conditions could be established in the permit before it is issued. After further deliberation, the Board of Appeal and Advisors unanimously recommended that City Council adopt the various 2010 Editions of the California building codes. MSC (AS/CS) (4-0-0-1) Recommend to City Council adoption of the various 2010 Editions of the California building codes and that staff include Member Jones' concerns with the amendments to the 2010 CGBSC in the staff report to Council. Motion carried with Member Lopez absent. 4 MEMBERS COMMENTS/CHAIRMAN'S COMMENTS/REPORTS: Chair Sanfilippo thanked all the committee members for attending tonight's meeting and taking the time to review the information. 5. BUILDING OFFICIAL'S COMMENTS/REPORTS: Mr. EI-Khazen stated that possibly in November or December he may be bringing an updated fee study for the Board's consideration. Member Jones asked if the building permit fees were going to be raised again. Mr EI-Khazen stated that the study addresses current cost recovery rates and the fees in some cases may go up or may go down and that he had not reviewed the final draft. Chair Sanfilippo asked if the City still intended to keep the permit streamline efforts in play. Mr EI- Khazen confirmed and offered to include Chair Sanfilippo to the Oversight Committee. 6. Office of the State Fire Marshal (CAL FIRE-OSFM), local Fire Departments (FD), and the solar photovoltaic industry have developed this guideline for installations to increase public safety for all structures equipped with solar photovoltaic systems. This guideline was developed with safety as the principal objective. The solar photovoltaic industry has been presented with certain limitations in roof installations due to firefighting suppression techniques. The intent of this guideline is to provide the solar photovoltaic industry with information that will aid in the designing, building, and installation of solar photovoltaic systems in a manner that should meet the.objectives of both the solar photovoltaic industry and the Fire Service. The provisions of this guideline, if adopted by the local enforcing ci'g'ency by local ordinance, is meant to apply to the design, construction and installation of solar photovoltaic systems on buildings regulated by Title 24 of the California Building Standards Codes. A solar contractor should always contact their 10caLfire de.partment to determine if the means or methods to be used will allow for a sate installation that is acceptable to the fire department and meets local code reqtJirements,. General Information about Solar Photovoltaic Systems Solar photovoltaic systems generate electricity from the sun. As of September 2007, there are roughly 30,000 solar photovoltaic systems installed on homes, commercial buildings and free- standing structures)n California. Most systems are connected to the electric grid and provide power to the site. The majority of these systems do not have any battery backup equipment - instead, excess power is sent to the electric utility system. '" Solar photov'bltaic (PV) systems are installed with an alternating current (AC) disconnect at the.service'panel. Conduit carrying direct current (DC) power connects the modules to th'e inverter. The inverter connects the PV system to the utility service panel. AC disconnects are not required in all jurisdictions because the main breaker provides this level of disconnect. A DC disconnect is installed on the site side of the inverter. Typical systems seen today have an inverter located near the utility service panel. Some inverters (micro inverters, AC modules) are located at the PV module (the solar industry refers to PV panels as "modules"). If the inverter is located at the PV module, the conduit from the modules to the utility power supply is AC. The DC disconnect at the service panel cuts power to the inverter, which is then unable to export power to the utility service panel and prevents any solar electricity from harming service or maintenance workers on the utility side of 3 5-11 Draft PV Guideline, April 22, 2008 the panel. During the day, there is power in the conduit between the PV modules and the DC disconnect The systems can produce up to 8 amps and up to 600 volts of electricity which varies by installation. Modules connected together are called strings. Multiple strings are connected together at a combiner box. The power output is highest on a bright day with low ambient temperatures and drops as the modules heat up (such as on a very hot day). There is no power output in the dark and there is no stored energy in the modules themselves. Service lights used by fire crews do not provide enough light to develop any harmful power levels. Modules are mounted on buildings or on ground supported frames. Roof mounted modules, also sometimes known as panels, can be one of thes~ types: . Directly on a building's roof . Integral to the roof system of a building . On a rack with a space above the roof surface . On a freestanding structure but not on the habitable structure (such as a trellis or other free-standing support structure) Specifically: . Modules attached to a mounting system maybe attached to the roof or rest on the roof surface. . Modules integrated to the.roof system are commonly referred to as Building Integrated Photovoltaics (BI PV) and are of two types: o Physically integrated roofing products resemble roof shingles or tiles and are installed along with.standardroof shingles or tiles so that they blend into the overall appearance of the roof. Physically integrated BIPV modules alternate current as part of a.defined roofing system. o Aesthetically integrated modules also resemble roof shingles or tiles and are installed alorig with standard roof shingles or tiles to blend into the overall appearance of the roof. Aesthetically integrated modules do not alternate current as part of a defined roofing system. Modules are located in a manner to provide the best access to sunlight. This means they are typically mounted on the south or west side facing roof fac;;ade. In residential applications, the typical roof area used is about 400 square feet. Larger size systems correspond to a higher site electricity demand. Although it is not advisable to step or walk on any solar system due to slip and/or trip hazards, the systems should be able to support a firefighter's weight. Other PV products, such <js those integrated with a curtain wall or as windows are not currently addressed in this guideline. Other types of solar energy systems that might be seen at a site do not generate electricity. These can be broken down into three major types - solar water heating, solar pool heating, and solar space conditioning. Glycol is used in areas where extended periods of freezing temperature levels could cause ice to damage the solar panels and/or distribution pipes. This may be necessa'ry where, for example, new products, designs, technologies or methods become available that provide sufficient alternative protection and access, pathways,pnd ventilation opportunities for fire crews. Local Ord.inance Required by City, County, City and County, Fire Protection Districts This guideline does not have the force of law and the provisions of this guideline do not limit the existing authority of city or county governments or Fire Protection districts to establish more restrictive and reasonably necessary changes to the provisions contained in the California Code of Regulations, Title 24, the California Building Standard Codes pursuant to complying with the findings and filings requirements. To convert these guidelines into a legally enforceable format, a city, county, or city and county must follow the appropriate procedure as explained above. 1.0 MARKING PV systems must be marked. Marking is needed to provide emergency responders with appropriate warning and guidance with respect to working around and isolating the solar electric system. This can facilitate identifying energized electrical lines that connect the solar modules to the inverter, as these should not be cut when venting for smoke removal. Materials used for marking must be weather resistant. It is recommended that Underwriters Laboratories Marking and Labeling System 969 (UL 969) be used as standard to determine weather rating. (UL listing of markings is not required). 1.1 Main Service Disconnect For residential applications, the marking may be placed within the main service disconnect. Hips and Valleys: Modules should be located no closer than one and one half (1.5) feet to a hip or a valley if modules are to be placed on both .sides of a hip or valley. If the modules are to be located on only one side of a hip or valley that is of equal length then the modules may be placed directly adjacent to the hip or valley. . 2.1.2 Smoke Ventilation The modules should be located no higher than three feet (3') below the ridge. 2.2 Commercial Buildings and Residential Housing Comprised of Three (3) or More Units Exception: If a local fire department determines that the roof configuration is similar to residential (such as in the case of townhouses, poridominiums, or single family attached buildings), the local fire department may make a determination to apply the residential access and ventilation requiremenls. Examples of these requirements appear at the end of this guideline. 2.2.1 Access There should be a minimum six foot (6') wide clear perimeter around the edges of the roof Exception If either axis of the building is 250 feet or less, there should be a minimum four feet (4') wide clear perimeter around the edges of the roof. 2.2.2 Pathways Pathways should be estatJlished in the design of the solar installation. Should provide not less than 4 feet (4') clear around roof access hatch with at least one not less than 4 feet (4') clear pathway to parapet or roof edge 2.2.3 Smoke Ventilation a Arrays should be no greater than 150 by 150 feet in distance in either axis b. Ventilation options between array sections should be either: 1. A. As used herein, the term "electric fence" includcs all fences which in any way use electrical energy as an additional deterrent or have wires charged with electricity which are not covered with adequate insulation to protect persons and animals coming in contact therewith. B. No electric fence may be constructed, maintained or operated within the City. 15.24.060 Phase arrangement - Amended. Section 408.3(E) of the California Electrical Code is hereby amended to read: Phase Arrangement. The phase arrangement on three-phase buses shall be A, B, C from front to back, top to bottom, or left to right, as viewed from the front of the switchboard or panelboard. The C phase shall be that phase having the higher voltage ground on three- phase, four-wire delta-connected systems. FINDINGS AND DECLARATION The City COlmcil of the City of Chula Vista specifically and expressly tinds and declares that each of the additions and amendments noted above to the 2010 Edition of the 5-58 Calilornia Fire Code IS necessary due to local climatic, geological and topographical conditions.
