PLEDGE OF ALLEGIANCE - SILENT PRAYER
Chair Grasser Horton had been chosen to serve as a member of the City Council and Vice-Chair
Fuller was on vacation; therefore Commissioner Tugenberg as Immediate Past Chair conducted
the meeting.
The pledge of allegiance to the flag was led by Chair Tugenberg and was followed by a morhent
of silent prayer.
.INTRODUCTORY REMARKS
Chair Tugenberg reviewed the composition of the Planning Commission, its responsibilities and
the format of the meeting.

of May 22, 1991, as submitted.

ITEM 1: PUBLIC HEARING: GPA-91-03, PCZ-91-E: CITY-INITIATED PROPOSAL
TO AMEND THE CITY GENERAL PLAN, FROM RESEARCH AND
LIMITED MANUFACTURING TO RETAIL COMMERCIAL, FOR CERTAIN
TERRITORY, GENERALLY BOUNDED BY MAIN STREET TO THE
NORTH, BROADWAY (BEYER BOULEVARD) TO THE EAST, FAIVRE
STREET TO THE SOUTH, AND 27TH STREET TO THE WEST. ALSO
REQUESTED IS AN AMENDMENT TO THE MONTGOMERY SPECIFIC
PLAN FROM RESEARCH AND LIMITED INDUSTRIAL TO MERCANTILE
AND OFFICE COMMERCIAL, AND A REZONE FROM CITY-ADOPTED
COUNTy ZONE CLASSIFICATION C-37 TO CITY CLASSIFICATION C-T-P
Chair Tugenberg noted that only four Commissioners were present and that the item may be
continued.
Associate Planner Batchelder requested that Items 2 and 3 be taken out of order, since there was
a request for continuance, with Item 1 to follow.
ITEM 2: PUBLIC HEARING: GPA-90-01: PROPOSAL TO AMEND THE LAND USE
ELEMENT OF THE CITY GENERAL PLAN BY THE REDESIGNATION OF
APPROXIMATELY 3.65 ACRES OF LAND, LOCATED AT THE
SOUTHEAST CORNER OF EAST "H' STREET AND OTAY LAKES ROAD,
FROM "LOW-MEDIUM DENSITY RESIDENTIAL (3-6 DU/AC)" AND
"SPECIAL STUDY" TO "RETAIL COMMERCIAL" - Kelton Title Corporation
ITEM 3: PCZ-90-B: CONSIDERATION TO REZONE APPROXIMATELY 3.65 ACRES
LOCATED AT THE SOUTHEAST CORNER OF EAST "H" STREET AND
OTAY LAKES ROAD FROM "R-l" TO "C-C-P" - Kelton Title Corporation
Chair Tugenberg again noted there were only four Commissioners present and strongly
recommended a continuance.
A letter had been submitted by the applicant for continuance of the item.
MS (Casillas/Tugenberg) to continue the item to July 24, 1991.
Chair Tugenberg called for questions. At this time, the applicant approached the podium and
personally requested the continuance in addition to the previously submitted letter.

LIMITED MANUFACTURING TO RETAIL COMMERCIAL, FOR CERTAIN

AND OFFICE COMMERCIAL, AND A REZONE FROM CITY-ADOPTED
COUNTY ZONE CLASSIFICATION C-37 TO CITY CLASSIFICATION C-T-P
Associate Planner Batchelder noted that this item was a Council referral. At the November 13,
1990, public hearing on the Harborside B, Part 2 Rezoning for Montgomery, the property owner
of the subject property had requested that Council defer from zoning the subject properties, since
the proposed zoning to I-L-P would have precluded his intent to remodel and expand the Otay
Farms Market. Council referred the item to staff for preparation of a work program to expedite
resolution of that portion of the special study area of the Montgomery Specific Plan. The work
program had been approved at the Council meeting of December 4, 1990. Mr. Batchelder stated
that the Montgomery Planning Committee unanimously recommended adoption of the Negative
Declaration; amendment of the City General Plan from Research and Limited Industrial to Retail
Commercial, and amendment of the Montgomery Specific Plan from Research and Limited
Manufacturing to Mercantile and Office Commercial; and to recommend that the City Council
adopt an ordinance rezoning the site to the City's C~T-P zone.
He then introduced Contract Planner May who summarized the report which had been prepared
by the firm of Lettieri-Mclntyre. This included the location of the property, current uses,
zoning, and staff's recommendations and reasonings for those recommendations.
Commissioner Casillas asked if it was the applicant's intention to build a new market in the
southern parcel. Ms. May answered affirmatively, and explained some of the plans of the
applicant.
Upon Commissioner Casillas' query, Associate Planner Batchelder said the applicant had given
no time commitment and was not ready to come forth with a site plan. He had expressed his
intent to propose a plan there.
Commissioner Martin asked about the designation of the area underneath the vacant lot. Mr.
Batchelder answered that at the time the Harborside B, Part 2 Rezonings were done in
November, the area was designated at I-L-P, although there was a special study overlay
extending south of Faivre Street.
Chair Tugenberg asked if the applicant's plans, when submitted, would include the entire area.
Mr. Batchelder answered affirmatively.

This being the time and the place as advertised, the public hearing was opened. No one wishing
to speak, the public hearing was closed.
MSUC (Casillas/Carson) 4-0 (Commissioners Decker and Fuller absent) that based on the Initial
Study and comments on the Initial Study and Negative Declaration, find that this reclassification
will have no significant environmental impacts and adopt the Negative Declaration issued on IS-
91-33 for the Otay Market rezone.
MSIJC (Casillas/Carson) 4-0 (Commissioners Decker and Fuller absent) to recommend that the
City Council adopt a resolution to change the General Plan designation to Retail Commercial,
the Montgomery Specific Plan designation to Mercantile and Office Commercial, and adopt an
ordinance changing the zone classification to C-T-P for the property as described on the attached
Exhibit "A".
MSUC (Carson/Martin) 4-0 (Commissioners Decker and Fuller absent) to recommend that the
City Council adopt an ordinance changing the zone classification of the City-adopted County
zoning C37 to the City's C-T-P, including the adoption of the supplemental findings supporting
the P modifier as shown in Attachment 1.
ELECTION OF OFFICERS
Assistant Planning Director Lee noted that Susan Fuller had indicated to him that, if the
Commission wished to nominate her, she was willing to accept a position of either Chair or
Vice-Chair.
MSUC (Carson/Martin) 4-0 (Commissioners Decker and Fuller absent) to elect Susan Fuller as
Chair and Joe Casillas as Vice-Chair.

DIRECTOR'S REPORT
Assistant Planning Director Lee said staff was still trying to determine if the architects on the
Chula Vista Shopping Center would be able to come down to provide a presentation at the July
17 workshop. He would not have an answer until the latter part of the week. Therefore, the
Commission would reconvene to the 5:00 workshop, but there was a possibility of cancellation
if they were unable to attend.
COMMISSION COMMENTS
Commissioner Carson suggested retaining the Negative Declaration from Items 2 and 3 for the
next meeting.

Chair Tugenberg commented that the last Commission workshop was probably the best the
Commission ever had.
Assistant Planning Director lee noted that Commissioner Grasser Horton had been the Planning
Commission representative on the Bayfront Subcommittee. She had been appointed to the City
Council, and he believed Commissioner Decker had offered to serve as an alternate on the
Bayfront Subcommittee. In that case, with his consent, staff would move to contact him to make
sure he was aware. Commissioner Tugenberg noted Mr. Decker had a change in his business
and it would be good to contact him in case he was unable to accept the position.
