OF THE CITY PLANNING COMMISSION OF
CHULA VISTA, CALIFORNIA
July 28, 19~2
A regular business meeting of the City Planning Commission of Chula Vista,
California was held on the above date beginning at 7:00 p.m. in the City Council
Chambers, Public Services Building, 276 Fourth Avenue.
Commissioners Present: Pressutti, Williams, R. Johnson, Green, G. Johnson,
O'Neill and Stevenson
Commissioners Absent: None
Staff Present: Director of Planning Gray, Associate Planner Liuag,
Senior Civil Engineer Daoust, Assistant City Attorney
Harron, and Secretary Mapes
The pledge of allegiance to the flag was led by Chairman Pressutti, and was
followed by a moment of silent prayer.
APPROVAL OF MINUTES
MSUC (O'Neill-Stevenson) The minutes of the meeting of July 14, 1982 be approved
as written.
ORAL COMMUNICATIONS
Chairman Pressutti called for oral communications and none were presented.
1, PUBLIC HEARING: Conditional use permi.t PCC-83-1 to establish a day care
facility for 20 children located at 142 Third Avenue -

Chairman Pressutti acknowledged a request from the applicant to continue this
hearing to the meeting of August 25th. He then opened the public hearing and
asked if anyone in the audience wished to speak in regard to this application who
could not be present on August 25th. As no one responded, Chairman Pressutti,
with the consent of the Commission, declared the public hearing continued to
the meeting of August 25, 1982.
3. PUBLIC HEARING: Variance ZAV-83-1 - Reduction in minimum street fronta§e
requirement in order to maintain a rooftop si~n on the
commercial buildin§ at 639 Broadway - The Bedroom
Chairman Pressutti advised that the applicant wished to continue this public
hearing to the meeting of August 11th. He opened the public hearing and with
the consent of th~ Commission continued the hearing to the meeting of August 11,
1982.

2. PUBLIC HEARING: Conditional use permit PCC-83-2 to establish a preschool
for a maximum of 25 children at 471 "E" Street - Ignacio
Martinez
Associate Planner Liuag reported that the property located at the northeast
corner of "E" Street and Brightwood contains 10,300 sq. ft. and is developed
with an attractive single family home and well maintained landscaping. The
garage has been converted to office and living space. The applicant is requesting
permission to operate a preschool facility in the dwelling for 20 to 25 children.
Three employees will work in two shifts during the hours 7:30 a.m. to 6:00 p.m.
The entire house will be used for the preschool activity and the garage will
be used for office and storage space. Rather than providing onsite parking on
this property for the employees, the applicant has obtained permission to use
the church parking lot across the street. An agreement assuring that use is
one of the recommended conditions for approval of this request.
Mr. Liuag acknowledged receipt of a letter from Madge Farris, owner of the
adjacent single family residence to the north, expressing support for the
proposed use. It is recommended that the request be approved subject to a list
of six conditions. The only signing proposed will be a small freestanding sign
facing "E" Street.
This being the time and place as advertised, the public hearing was opened.
Joe Bishop, 445 "E" Street, speaking for the owners of the apartment house
approximately 150 feet east of this proposed use expressed concern over the
noise which may result from children's activities at the school, asserting that
they presently get a lot of noise from the Lutheran school located across the
street. He also pointed out the traffic on "E" Street is extremely heavy during
the morning hours when parents would be bringing children to this location and
also in the evening when they would be picking them up.
Bill Blank, representing the applicant, advised that this will be a preschool
for 3, 4, and 5 year olds who will spend most of the time indoors, with one
hour in the morning and one hour in the afternoon devoted to outside activity.
In response to his request for a show of hands of people in the audience who
support this request, approximately 20 people raised their hands.
Edward Carroza, general partner on the vacant property adjacent to the east,
on which approval has been granted for the construction of 11 condominium units
expressed the opinion that the noise from this project would reduce the value
of their property and would be a deterrent to the sale of the units when they
are constructed. In response to a question from Commissioner O'Neill he affirmed
that at the present they have no plans to begin construction of those units.
Elizabeth Galligan, 466 "E" Street, resident directly across the street from
this site, expressed concern over the introduction of this type of use in the
residential neighborhood. She feared that under this use the property may not
be as well maintained as it has been in the past, and also that granting this
request might open the door to additional requests for commercial use in the
vicinity.
Connie Martinez advised that she and her husband have purchased the subject
property and she will be the director of the facility. She asserted it will

be their intention to keep the yard in good condition to help the children
enjoy the environment and to enhance the neighborhood.
Mrs. Martinez stressed the need in this community for a good quality preschool
day care facility. She affirmed that she was previously the director of such
a facility operated within a church property but that operation has been closed.
She spoke of the educational activity and the pleasant atmosphere provided for
the children enrolled in the school.
Cynthia Smothers reported on her own experience in having a child under the
guidance of Mrs. Martinez which she felt had been extremely beneficial to the
child. She urged that the request be approved on the basis that the quality of
care provided by Mrs. Martinez and her staff is super.
In response to a question from Commissioner Stevenson, Mr. Liuag advised that
commercial uses could not be approved for this area of "E" Street without a
General Plan amendment and rezoning.
Mr. Carroza expressed concern regarding his liability in the event children
wandered from this location on to his property and were injured.
As no one else wished to speak, the public hearing was closed.
MSUC (Green-O'Neill) The Commission finds that this project will have no
significant environmental impacts and adopts the Negative Declaration issued
on IS-83-2.
MSUC (Green-O'Neill) Based on the findings stated in the report, the Commission
approves a conditional use permit for the establishment of a preschool day care
facility at 471 "E" Street, subject to the following conditions:
1. The facility is permitted to operate between the hours of 7:30 a.m. and
6:00 p.m., Monday through Friday.
2. No outside play activities shall occur prior to 9:00 a.m.
3. The applicant shall be allowed one 6 ft. high, 9 sq. ft. freestanding
sign subject to Zoning Administrator approval.
4. The applicant shall install the sidewalk on Brightwood Avenue with the
interior remodeling of the building and prior to the issuance of a business
license.
5. Parking for three vehicles shall be provided by means of an acceptable
agreement filed with the City.
6. Failure to comply with the conditions listed shall constitute grounds for
revocation of the conditional use permit by the Planning Commission.
4. PUBLIC HEARING: Tentative subdivision map for Chula Vista Tract 82-12,
Snu~ Haven, 300 block "K" Street - Kaye & Horninq
Associate Planner Liua9 reported that in 1980 the Planning Commission approved
a conditional use permit for the construction of a 20 unit apartment project on
1.68 acres on "K" Street located in the C-O and C-C zones. Following that
approval architectural and site plans were reviewed and approved by the Design
Review Committee. Building permit applications are now being processed. The
proposed subdivision map is for the purpose of creating three lots and selling
the units as condominiums. Mr. Liuag displayed plats depicting the proposed

development and reported there will be 16 townhouse units on one lot, 4 flat
units on another lot, and the third lot contains commercial development. The
project meets the condominium requirements for storage, open space and parking.
It is recommended that the map be approved subject to two conditions relating
to maintenance of private driveways, sewers and drainage systems, and to the
prohibition of garage or carport conversions or the installation of individual
outside antenna.
This being the time and place as advertised, the public hearing was opened.
Thomas Horning, 440 Del Mar Court, the applicant, expressed concurrence with
the conditions as recommended.
As no one else wished to speak, the public hearing was closed.
MSUC (Stevenson-Williams) The Commission finds that the project will have no
significant environmental impacts and adopts the Negative Declaration on IS-80-54.
MSUC (Stevenson-Williams) Based on the findings stated in the report, the
Commission recommends that the City Council approve the tentative subdivision map
for Snug Haven, Chula Vista Tract 82-12, subject to the conditions listed in
the report.
DIRECTOR'S REPORT
Director of Planning Gray advised that the City Council has given tentative
approval to a revised plan for the EastLake project, and due to the revisions
State Law requires that the proposal be referred back to the Planning Commission
for review and recommendation. It has been requested that the Commission conduct
this review at the meeting scheduled for August 18 at 5:00 p.m. instead of a
study session on that date. The meeting would adjourn for dinner and further
discussion of planning items. He advised this will not be a public hearing and
should not require a great deal of time, but because there is a change in the
configuration of the project a report from the Planning Commission is required
prior to final Council action.
Commission G. Johnson requested that at that meeting an updated report on
approved projects in the city on which development is pending be supplied to the
Planning Commission.
COMMISSION COMMENTS
Commissioner Stevenson commented that he and Commissioner Williams are up for
reappointment for a second term on the Planning Commission but he noted from
the City Council minutes that they are considering a new procedure for making
these appointments.
Mr. Gray affirmed that the Council had expressed a desire to hold the interviews
prior to appointment of Planning Commissioners.
ADJOURNMENT
Chairman Pressutti adjourned the meeting at 8:52 p.m. to the meeting of
August 11, 1982 at 7:00 p.m.
