HomeMy WebLinkAboutPlanning Comm min 1982/04/14 MINUTES OF A REGULAR BUSINESS MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA April 14, 1982 A regular business meeting of the City Planning Commission of Chula Vista, California was held on the above date beginning at 7:00 p.m. in the Council Chambers, Public Services Building, 276 Fourth Avenue. Commissioners Present: Pressutti, Green, R. Johnson, O'Neill, Stevenson and Williams Commissioners Absent: G. Johnson (with previous notification) Staff Present: Director of Planning Peterson, Principal Planner Lee, Senior Civil Engineer Daoust, Assistant City Attorney Harron and Secretary Mapes The pledge of allegiance to the flag was led by Chairman Pressutti, and was followed by a moment of silent prayer. APPROVAL OF MINUTES MSUC (R. Johnson-O'Neill) The minutes of the meeting of March 17 and March 24, 1982 be approved as mailed. ORAL COMMUNICATIONS Chairman Pressutti asked for oral communications and none were presented. 1. Review of conditional use permit PCC-73-26 for amusement arcade at 1465 Melrose Avenue Mr. Lee reported that a conditional use permit for an amusement arcade at 1465 Melrose Avenue was approved in I973, subject to review by the Planning Commission after nine months of operation. After a brief period the operation was closed until a new operator reopened the arcade last July. The new operator was advised of the condition requiring review after nine months, which is the purpose of this agenda item. Although the original operation consisted only of mechanical "foosball" games, there are now 22 games in the center, mostly electronic. A check on the operation of this center has revealed that it has not been a source of trouble for the Police Department and the adjoining businesses have expressed no problems based on the operation of this center. It is recommended that continued operation of the amusement center be approved subject to seven conditions enumerated in the staff report. Commissioner Stevenson pointed out that approval of similar requests has included a condition requiring a security guard or an operator who has had security type training. -2- April 14, 1982 Hooshan§ Broumand, 343 South Mollison, E1 Cajon, reported that he will be the manager of the Family Amusement Center under the new ownership and that his 30 years in the army has given him experience in dealing with youth and with handling security problems. Commissioner Williams expressed the opinion that a notice should have been sent to other business operators in this shopping center to solicit their participation in this hearing. Commissioners R. Johnson advised that he did not think it is necessary to have a security officer in this type of establishment, since there are other businesses in the city where the need for a guard is greater but that requirement is not made. Commissioner Green suggested adding a condition that the attendant be at least 21 years of age. MS (Green-O'Neill) The operation of an amusement arcade under conditional use permit PCC-73-26 shall be allowed to continue subject to the 7 conditions listed in the report and an additional condition that the person supervising the center shall be 21 years of age or older. The motion carried by a vote of 5-1 with Commissioner Williams voting "no." 2. PUBLIC HEARING: Consideration of rezoninq application PCZ-82-E to chan~e approxi]mately ~ acres at 45 North Fourth Avenue from C-C to I-L - Title Insurance and Trust Company Director of Planning Peterson noted that a General Plan Amendment recommended for approval by the Planning Commission last week would change the designation of this area from Retail Commercial to Limited Industrial. That recommendation has not yet been considered by the City Council. He pointed out that the property in question does not have good exposure or frontage on Fourth Avenue and over the past seven or eight years there have been inquiries concerning the use of the property for industrial purposes but none for commercial development. It is recommended that the change of zoning from C-C to I-L be approved. This being the time and place as advertised, the public hearing was opened. As no one wished to speak, the public hearing was closed. MSUC (R. Johnson-O'Neill) The Commission recommends that the City Council approve the change of zone for six acres at 45 North Fourth Avenue from C-C to I-L. 3. PUBLIC HEARIGN: Consideration of rezoninq application PCZ-82-F to chan§e approximately 12.3 acres at the southeast corner of Industrial Boulevard and Oxford Street from C-C-P to I-L - J & J Investments Principal Planner Lee advised that a General Plan Amendment recommended by the Planning Commission last month would change the designation of property at the southeast corner of Industrial Boulevard and Oxford Street from Retail Commercial to Research and Limited Industrial. An application has been filed requesting a change in the zoning from C-C-P to I-L. -3- April 14, 1982 The site plan of the proposed development was displayed. Mr. Lee advised that building permits are being requested in the County to build this commercial and industrial complex. Annexation of this area to Chula Vista is pending as part of the Montgomery Annexation. The site plan and architecture have been reviewed and approved by the Design Review Committee as the applicants wants to be assured that if annexation is approved the project can go ahead. This being the time and place as advertised, the public hearing was opened. As no one wishes to speak the public hearing was closed. MSUC (Green-Stevenson) The Commission readopts the Negative Declaration issued on IS-81-21. MSUC (Green-Stevenson) The Commission recommends that the City Council approve the change of prezoning for 12.3 acres at the southeast corner of Industrial Boulevard and Oxford Street from C-C-P to I-L-P. 4. PUBLIC HEARING: Consideration of rezonin§ application PCZ-82-G to attach the "P" Precise Plan Modi~¥in§ District to 29 acres of I-L zoned property and establish precise plan §uidelines for 180 acres of industrial property located on both sides of Otay Valley Road east of 1-805 - City initiated Director of Planning Peterson advised that this proposal would not change the underlying industrial zoning of the property but would attach the "P" Modifying District to 29 acres of I-L zoned property that is adjacent to Otay Valley Road just east of the 1-805 freeway. Since 1-805 is the entry into this industrial area, it is desired to have the development that occurs as attractive as possible. Also, Brandywine Avenue leads into a residential area to the north so that it is important to have the industrial development which occurs around the intersection of Otay Valley Road and Brandywine Avenue be as attractive as possible. The staff report also contains suggested guidelines for the development of the property in the I-L-P and I-P districts. The guidelines pertain to setbacks, signs, grading and landscaping. This being the time and place as advertised, the public hearing was opened. Dick Kau, 3404 Bonita Road, spoke in opposition to the proposed attachment of the "P" Modifying District to any additional property in the area. He advised that he does not own land on Otay Valley Road but represents two of the owners of property being considered. He contended that the application of any additional restrictions is contrary to the recommendation of the Nuffer Smith report which relates to the image of Chula Vista with particular attention to increasing industrial development within the City. He asserted that adding the "P" District requires an additional step in the review of development plans and makes it more difficult to interest industrial users in locating in this area. Principal Planner Lee advised that for four years he has worked with the Design Review Committee which acts on precise plans for industrial and commercial properties. Membership of that committee includes professional architects engaged in private practice in the building field. It requires only two weeks from the date plans are filed until they get to the committee. It is also possible for a developer to meet with a subcommittee of the Design Review Committee and receive suggestions at the early stages of the plan preparation. -4- April 14, 1982 As no one else wished to speak, the public hearing was closed. Commissioner Stevenson remarked that it makes more sense to have the "P" Modifying District near this entry area where staff is now recommending it than in the area further to the east where we already have it. This action just brings the entry area into conformance with the balance of the area. Commissioner Green expressed the opinion the "P" Modifying District does not need to be applied to additional property in this particular area, and adding more restrictions could damage the perception developers have of the city. MS (Stevenson-O'Neill) Based on the findings stated in the report, the Commission recommends that the City Council attach the "P" Precise Plan Modifying District to properties on the north and south sides of Otay Valley east of 1-805, and adopt the guidelines set forth in the report. The motion carried by a vote of 5-1 with Commissioner Green voting "no." DIRECTOR'S REPORT Director of Planning Peterson reminded the Commission of their joint meeting with the City Council at 4:00 p.m. on Thursday, April 22, for a review and discussion of the work of the Contract Planner on a revision of the City's General Plan. COMMISSION COMMENTS Chairman Pressutti advised that he has been selected to attend a seminar in Washington, D.C. to learn what is being done to help senior citizens. He will be out of town during the week of the next scheduled hearing on EastLake. After discussion by the Commission, it was concluded that the continued EastLake hearing should be conducted on May 19 as scheduled and if it is the Commission's desire to continue it to a future meeting when all members would be present, that can be accomplished on May 19th. Commissioner O'Neill reported there is a drainage problem along Garrett Avenue on the east side of the new County Regional Center; also, that when Mankato was a through street stop signs were located on Garrett Avenue at the intersection of Mankato. He felt that now the stop sign should be removed from Garrett and, if necessary, placed on Mankato. Senior Civil Engineer Daoust advised that the County is correcting the drainage problem by providing an inlet for the drainage. This should be accomplished and paving repairs completed within a couple of days. ADJOURNMENT Chairman Pressutti adjourned the meeting at 8:15 p.m. Respectfully submitted, Helen Mapes, Secret~fy
