OF THE CITY PLANNING COMMISSION OF
CHULA VISTA, CALIFORNIA
September 10, 1980
A regular business meeting of the City Planning Commission of Chula Vista,
California was held on the above date beginning at 7:00 p.m. in the City
Council Chambers, Public Services Building, 276 Fourth Avenue.
Commissioners present: Pressutti, R. Johnson, G. Johnson, O'Neill, Smith,
Stevenson and Williams
Commissioners absent: None
Staff present: Principal Planner Lee, Senior Civil Engineer Daoust,
Assistant City Attorney Harron and Secretary Mapes
The pledge of allegiance to the flag was led by Chairman Pressutti, followed
by a moment of silent prayer.
APPROVAL OF MINUTES
MSUC (Stevenson-O'Neill) The minutes of the meeting of August 27, 1980 be
approved as written. Commissioner R. Johnson abstained from voting due to his
absence from that meeting.
ORAL COMMUNICATIONS
James Johnson, 424 Stoneridge Court, extended a verbal and written invitation to
each Commissioner to attend the 19th annual open house and buffet of the South
Bay Pioneers to be held on Sunday, October 5th at 1:30 p.m. Mr. Johnson briefly
commented on recent improvements at the facility, including the installation of
solar heating, and on the contribution to society this organization renders in
this community.
1. PUBLIC HEARING: a. Specific Plan for area added to South College
Sectional Plannin~ Area
b. Revision to Chula Vista Tract 80-20, Charter Point,
addin~ 1.5 acres
Principal Planner Lee advised that a development plan and tentative map for a
260 unit subdivision in the South College Area was approved about four months
ago. During review of that project it was noted that there was 1.5 acres of
surplus property owned by Southwestern College adjacent to this project. The
developer has since purchased that property. It has been rezoned from R-1 to
P-C with a maximum density of 10 units to the acre, which would allow 15 units
on the site. The applicant is proposing to incorporate the 1.5 acres into the

Charter Point subdivision and develop 14 additional lots thereon. The
original subdivision was planned to permit access to the surplus property
site, if desired. In incorporating this site into the subdivision the
applicant proposes to use the same architecture and floor plans for the
units, which features split level construction and includes a garage for
each unit.
Mr. Lee noted that the original resolution approving the tentative map included
a condition requiring the applicant to devote 10% of the units to low and
moderate income housing. Since that time the staff position has changed,
as evidenced by a lengthy memo sent to the City Manager and considered by
the City Council, outlining various options for providing low and moderate
income housing. One of the options would reduce the requirement from 10% to
3%. The City Council has not adopted a policy at this time and have asked for
additional study and a tour of Orange County where inclusionary housing is
used. It is felt at this time that 3% is a more realistic figure to require
of each development.
Commissioner Smith pointed out the staff report indicated 3%, or a total of
6 units. With the total units involved, 3% would equal 8 units. Mr. Lee
concurred the figure should be changed to 8 units.
Commissioner Smith expressed the opinion the Commission does not have an
obligation to vote on levying a tax on the developer nor to decide who gets to
live in the units, and that would be the result of the Commission specifying
that a certain number of units shall be reserved for low and moderate income
families.
This being the time and place as advertised, the public hearing was opened. As
no one wished to speak, the public hearing was closed.
MSUC (O'Neill-G. Johnson) The Commission recertifies EIR-80-4 and adopts
Candidate CEQA findings in accordance with Resolution EIR-80-4-A.
MS (O'Neill-G. Johnson) The Commission recommends that the City Council approve
a revision to the South College Sectional Planning Area plan, as approved by
Planning Commission Resolution PCM-80-17 and City Council Resolution No. 10094,
to include the additional 1.5 acre site, and approve the revised tentative map
for Charter Point, Chula Vista Tract 80-20, increasing the subdivision from 260
units to 276 units, based on the findings and subject to the conditions set
forth in Resolution PCS-80-20, with modifications as recommended in the staff
report corrected to indicate "8 units for rent or sale at rates affordable .... "
MS (Smith-R. Johnson) The motion be amended to delete all reference to affordable
housing wherever it may appear.
Chairman Pressutti pointed out that the Commission, in making the finding of
conformity to the Housing Element of the General Plan, does have the responsibility
of addressing the issue of providing affordable housing.

The amendment to the motion failed by the following vote:
AYES: Commissioners Smith and R. Johnson
NOES: Commissioners Williams, Pressutti, G. Johnson, O'Neill and Stevenson
ABSENT: None
The original motion carried unanimously.
2. PUBLIC HEARING: Conditional use permit PCC-81-3, request to locate psychiatric
hospital at 730 Dora Lane - Vista Hill Hospital
Principal Planner Lee reported that the applicant has asked for a continuance of
this public hearing to October 22 to allow them additional time to complete the
necessary environmental review.
Chairman Pressutti declared the public hearing open.
MSUC (R. Johnson-Stevenson) The public hearing to consider conditional use permit
PCC-81-3 be continued to October 22, 1980.
3. PUBLIC HEARING (cont.): Conditional use permit PCC-80-21, request for
§xpansion of existing mini-shop at 196 Broadwas - Atlantic
Richfield Company
Principal Planner Lee noted that this hearing was continued from a previous
meeting to this date. The applicant has just recently met with the staff and
submitted a revised site plan, which should be reviewed before a report and
recommendation is prepared by the staff. It is recommended that the hearing
be continued to the next meeting, September 24.
Chairman Pressutti reopened the public hearing.
MSUC (G. Johnson-Stevenson) The public hearing to consider conditional use permit
PCC-80-21 be continued to September 24, 1980.
4. PUBLIC HEARING: Consideration of revocation of conditional use permit C-67-22
for operation of car wash facility at 215 Woodlawn
Principal Planner Lee reviewed the history of this conditional use permit which
was issued in 1967. In 1976 the Planning Commission approved a permit to upgrade
and expand the facility; the expansion was not accomplished and the permit has
expired. Notification was given to the owner that certain repairs were necessary
to restore the structure to its original condition, since the roof had been
removed after being damaged. Dennis Gray, the owner, contacted the staff from
time to time, asking for delays with the hope that he could redevelop the entire
site; this continued for about two years. In January of this year Mr. Gray sold
the property to Mr. & Mrs. Ledsam. They are trying to secure a loan to repair
and expand the operation. It is recommended that the new owners be given 2½
months to restore the building to its original condition or to apply for and
receive authorization to expand the facility with construction based on an
approved time schedule. The recommendation indicates that failure to comply with
the repairs or expansion would constitute revocation of the project and require
that the site be cleared within 60 days.

Don Ledsam, 1640 Maple Drive, #63, Chula Vista, reported that he purchased the
property on January 15th, and up to this time his attempts to secure a loan to
complete the desired expansion of the facility to five bays has not met with
success. He recently contacted the new People's Bank and they looked with favor
on his request and sent an appraiser, who appraised the property today. It was
then indicated the bank would grant a loan if the Planning Commission approves
the extension of time to November 26, 1980.
As no one else wished to speak, the public hearing was closed.
MSUC (Stevenson-R. Johnson) The Planning Commission specifies that by November 26,
1980, the building at the car wash facility at 215 Woodlawn shall be restored to
its original condition or modified as approved by the Director of Planning, or
the applicant shall have applied for and received authorization to expand the
facility with construction to occur based on an approved schedule, and that
failure to comply with one or the other of these conditions will automatically
constitute the revocation of conditional use permit C-67-22 and require that the
site be cleared of all structures within 60 days after said revocation.
DIRECTOR'S REPORT
Principal Planner Lee reported that the staff has no urgent items to discuss at
the study session scheduled for next Wednesday, September 17th, and if it is the
Commission's desire that meeting could be cancelled.
With the concurrence of the Commission members, Chairman Pressutti announced that
the study session scheduled for September 17th is cancelled.
COMMISSION COMMENTS
Commissioner O'Neill commented on an article in a recent issue of the "Evening
Tribune" concerning demonstration projects recently begun by H.U.D. to try to
cut the cost of housing. The project nearest to this area will be conducted at
Hayward, California. Mr. O'Neill asked if it would be possible for the Commission
to obtain information on such a project during its progress, rather than waiting
for its completion and issuance of a final report.
Mr. Lee advised the staff will find out what information is available.
ADJOURNMENT
Chairman Pressutti adjourned the meeting at 7:40 p.m. to the meeting of
September 24, 1980 at 7:00 p.m.
