Before selling these parcels it is nPCessary to obtain an appraisal of value for each parcel. It is my RECOMMENDATION: That Council: 1. Appropriate $4,000 from the unappropriated balance of 2106 Gas Tax funds and transfer to project 250-2501-GT129 (Sale of excess rights-of-way) 2. Authorize the City Engineer to execute the agreement between the City and Thomas L. Roberts, MAI for appraisal of the three parcels. 3. Authorize the ex penditure of $4,000 from Gas Tax Project 129. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: The Engineering Department has identified three parcels of excess rig ht-of-way owned by the City. The three parcels were purchased with Gas Tax funds. Parcels 1 and 2 were purchased by the State of California for freeway construction and later relinquished. Parcel 3 was purchased by the City as part of the right-of-way required for constructing North Second Avenue. Following is a brief history of each parcel: Parcel 1 is located in the northwest quadrant of the Palomar Street and I~5 freeway interchange. It consists of 0.3334 acres and lies adjacent to property owned by Inland Industries. This property was relinquished by the State of California on November 24, 1952 and is presently unimproved. Inland Industries has made application for the vacation of this right-of-way. The City became owner of the right-of-way in fee simple when it was annexed to the City on August 17, 1959 (see plat attached). Inland Industries is interested in purchasing this parcel so it can be incorporated into the planned development of their property. Parcel 2 is located west of the northerly terminus of Vista Drive at the I-805 freeway (see plat attached). It consists of 0.4861 acres and is currently improved as a street. Both adjacent property owners are interested in purchasing this rig ht-of-way so that it can be incorporated into a proposed development of their property. The State of California relinquished this right-of-way to the City on August ?_0, 1975. The City owns the right-of-way in fee simple. Parcel 3 is located along the east side of North Second Avenue near the northerly City limits. It consists of 0.1713 acres and lies between the entrance road to KOA campground and Vista Hill Psychiatric Foundation (see attached plat). A portion of parcel 3 contains right-of-way purchasd by the State of California for the Route 54 freeway. The State is in the process of relinquishing their right-of-way to the City. The remainder of Parcel 3 consists of rig ht-of-way purchased by the City for the construction of North Second Avenue . Once the City vacates the old right-of-way for North Second Avenue and the State relinquishes their interests to the City, Engineering intend s to proceed with the public sale of this parcel. The first step to proceeding with the sale of these parcels is to determine their current fair market value by having them appraised. Engineering requested written proposals from four appraisers who have done work for the City in the past: 1. E. Alan Comstock, M.A.I. 2. H.L. (Bill) Lipmann, M.A.I. 3. Gerald S. Kibbey, M.A.I. 4. Thomas L. Roberts, M.A.I. Three of the appraisers submitted proposals for appraising the three parcels: 1. Thomas L. Roberts - $3,000 2. H.L. (Bill) Lipman - $3,600 3. E. Alan Comstock - willing to negotiate a fee Mr. Roberts and Lipman both said they could complete the appraisal in 45 days after authorization to proceed. It is my recommendation that Thomas L. Roberts, M.A.I. be retained to do the appraisals on the three parcels. /63G 7 e FINANCIAL STATEMENT: Page 3, Item g Meeting Date 1-6-8.0 There are sufficient funds available in the unappropriated balance of 2106 Gas Tax Funds to pay for the cost of the appraisals. Requested appropriation from unappropriated balance 2106 Gas Tax funds $4,000 Thomas L. Roberts appraisal fee $3,000 Title reports $300 Engineering & contingencies $700 TOTAL $4,000 FISCAL IMPACT: The cost to appraise the three parcels will range from $3,000 to $4,000. These costs will be reimbursed to the Gas Tax fund when the parcels are sold. Since all three parcels were purchased with gas tax funds, all proceeds from the sale of the parcels will be deposited in the City's Gas Tax fund. KJG : f pw /6 36'
