SUMMARY
On September 15, 20iO, the Director of Public Works received three (3) sealed bids for the
"Sewer RehabilitatIOn Program, FY 2008-2009 various locations in the City of Chula Vista
(SW255B/SW235)" project. The project will replace existing broken sewer mains and laterals,
repair cracked sewer lines, and replace asphalt concrete pavement in various locations
throughout the City ofChula Vista.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act and has deternlined that the project qualifies for a
Class 1 categorical exemption pursuant to Section 15301 of the State CEQA Guidelines. Thus,
no further environmental review is necessary.

DISCUSSION
Based on the results of compiled data inspections, including those performed with a closed
circuit television camera. a number of access areas and sewer pathways have been identified by
the Public Works Department as requiring replacement and/or rehabilitation. Certain sections of
pipe are cracked and need to be replaced, repaired or relined to prevent groundwater infiltration
or leachll1g of raw sewage into the ground. The general scope of the project involves the
replacement of existing broken sewer mains and laterals, the installation of pipe lining to repair
cracked sewer lines, the replacement of sewer access holes, trenching, and asphalt concrete
pavement.
The locations and types of work to be done are detailed in Plats I through 23 (Attachment I).
The method used for the rehabilitation of the City's sewer mains and laterals employs an industry
standard practice known as cure in place pipe (CIPP). This mode of rehabilitation utilizes a
specialty liner designed to seal connectIOns by lining pipes that are less than 24 inches in
diameter. The specially designed liner is a fiberglass laminate completely impregnated with a
curing resin. This liner is installed by inHating and pushing the liner into the sewer main. Once
inside, a 2 to 3 inch brim is formed and adhered to the inside of the host sewer pipe providing a
watertight seal. This procedure restores the integrity of the sewer mains and prevents the
infiltration of ground water and/or ex-filtration ofraw sewage water from leaking outside of the
pipe. Onee the liner is cured, the sewer lateral openings leave an identifiable indention which are
cut open by remote robots. The rehabilitation of sewer mains will also prevent roots from
penetrating the sewer main. Root infiltration of sewer mains has a potential of causing more
damages to the pipe and causing stoppage of flow.
While the CIPP is known for being a trenchless method of rehabilitation, the City cannot avoid
digging into the pavement within certain areas of the City. It still becomes necessary for the
Contractor to open the streets and trench down to perfonn repairs to certain sewer main. Under
this contract, the Contractor will be allowed to perform work at night to reduce traffic
congestions within business areas of City during the day. Night work within residential
neighborhoods will not be allowed.
On September 15, 2010, Public Works staff advertised the annual "Sewer Rehabilitation
Program, FY 2008-2009 various locations in the City of Chula Vista (SW255B)" project. The
apparent low bidders were contingent upon a grand total base bid of all locations shown on plats
I to 23 (Attachment 1). The bids from the three contractors are as follows:

However, after examining the three bidder's submittal package, it was found that all submitted
bids containeu mathematical irregularities. Despite the $10 mathematical irregularity by Charles
King Company, Inc., their mathematical irregularity does not change their low bid ranking. In
addition, by waiving all mathematical irregularities, none of the low bid rankings change as
shown in the above table. Thus, in the best interest of the City and during this time of buuget
crisis, statl recommends that a public hearing he held in accordance with the City Charter to
waive all mathematical irregularity in all bids and accept all bids.
The low bid by Charles King Company, Inc. of $995,546.25 is $340,456.75 (25%) below the
Engineer's estimate of $1,335,990. The Engineer's estimate was based on average prices for
similar types of work completeu during the last two years. This difference in competitive
bidding can be attributed to the current state of the economy. The high degree of competition
within the constmction market and the lack of work in other jurisdictions make it difficult to
predict Clr project market value cost without some adjustment to the contract cost.
While Charles King Company heauquarters are locateu in Orauge County, they have uone
previous work for the City of San Diego. Staff verifieu the references provided by the
contractor; their work record has been satisfactory. After reviewing the low bidder, staff
recommends awarding a $995,546.25 contract to Charles King Company, Inc. of Signal Hills,
CA.
The locations of the proposeu work are located in the cast side and west side of I-80S. Eighty
percent (80%) of the repairs are locateu within the west side of Chula Vista and approximately
ten percent (10%) are located In the east side of I-80S Freeway and the remaining location,
approximate ten (10%) percent can be found in the Montgomery area (Attachment 1).
Approval of this resolution will authorize an inter-project transfer and authorize City staff to
expend all available funds and increase the value of the contract as necessary due to unforeseen
cirCUl11st311Ces. Unforeseen circumst311ces may cause an increase in quantities beyond what was
anticipated dunng the preparation of the project speci fications. Due to the age of the City streets
in the western part of the City, "unforeseen circumstances" may occur during the removal of the
existing sewer mains anu excavation occurring within the street. Fielu conditions could also
differ from the proposed improvement plans and specifications. As a result, auditional material
may be required to rehabilitate the project site, which could lead to possible "Change Orders" to
the contract. This is a typical situation with all sewer rehabilitation projects built in this area.
According to City Council Policy No. 574-01, if a change order exceeds the cumulative contract
change oruer aggregate amount allowable to be approved by the Director of Public Works
Operations, City Council approval is required. Under said City Council Policy the amount
wuuld be $72,688.22. However, approval of tonight's resolution will increase the Director of
Public Works Operations' authority to approve change oruers as necessary up to the contingency

amount of$190,000.00 or an additional 19% of the contract amount. Any funds that are not used
during constmctIon will be redistributed back to the appropriate original funding source.
'vVage Statement
The contractors who bid on this project were not required to pay prevailing wages to persons
employed by them for the work perfonned under this project. No special minority or W01l1en-
owned business requirements were necessary as part of the bid. However, a "Notice to
Contractors" was sent to various trade publications in order to encourage disadvantaged
businesses to bid on the project.

Attached is ~ copy of the Contractor's Disclosure Statement (Attachment 2).
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found a conflict exists, in
that Councilmember, Pamela Bensoussan has property holdings within 500 feet of the
boundaries of the property which is the subject of this action.
CURRENT YEAR FISCAL IMPACT
Sufficient Sewer Facility Replacement funds were previously appropriated as part of the FY
2008-2009 Capital Improvement Program (Crp) budgets for sewer rehabilitation projects.
Furthermore, sufficlent Trunk Sewer funds are available and were previously appropriated for
SW235 during the FY 2006 2007 Capital Improvement Program. It is proposed that these funds
be utilized along with the "Sewer Rehabilitation Program FY 2008-09 Various Locations in the
City of Chula Vista (SW255B/SW235)" project funds to perform the required work. All work
for Main Street sewer diversion west of Third Avenue shall be charged to SW235. This project
was added to the Sewer Rehabilitation project due to the similar type of work involved and to
obtain better competitive value for all work. City staff have been instmcted to keep all
accounting work for SW235 project separated from the SW255B Sewer Rehabilitation work
since the funding is not alike.

IRREGULARlTlES IN THE BIDS, ACCEPTING BIDS AND
AWARDING A CONTRACT FOR THE "SEWER
REHABlLIT A TION PROGRAM, FY 2008-2009 VARIOUS
LOCATIONS IN THE CITY OF CHULA VISTA, CA
(SW255B/SW235)" PROJECT TO CHARLES KING
COMPANY, INC OF SIGNAL HILL, CA IN THE AMOUNT OF
$995,546.25, AND AUTHORIZING THE DIRECTOR OF
PUBLIC WORKS TO EXPEND AVAILABLE FUNDS
WHEREAS, on September 15, 2010, the Director of Public Works received three (3)
sealed bids for the "Sewer Rehabilitation Program, FY 2008-2009, various locations in the City
ofChula Vista, CA (CIP No. SW255B/SW235)" project as follows:

Charles King Company, Inc. - Signal Hills, CA $ 995,546.25
Palm Engineering and Construction, Inc. - San Diego, CA $1,222,172.00
Zondiros, Inc. - San Marcos, CA $1,237,297.00
WHEREAS, the apparent low bid by Charles King Company, Inc. of $995,546.25 is
$340,451i.75 (25%) below the Engineer's estimate of$1,335,990; and
WHEREAS, Charles King Company, Inc.'s $10 mathematical irregularity does not
change the rankings of the bidders; and
WHEREAS, the headquarters of Charles King Company, Inc. IS located in Orange
County; and
WHEREAS, staff has veritied other the references provided by the contractor and their
work record has been satisfactory; and
WHEREAS, the engineer's estimate was based on average prices for similar types of
work completed during the last two years; and
WHEREAS, in the best interests of the City, all bids shall be accepted at this time.

does hereby waive mathematical irregularities in the bids, accept bids and award a contract for

CA (SW255B/SW235)" Project to Charles King Company, Inc of Signal Hi!!, CA in the amount
of$995,546.25, and authorize the Director of Public Works to expend available funds.
