This district is being formed at the request of the County of San Diego, who will be financing all the costs using their undergrounding funds. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed project qualilies for a Class 2 (d) categorical exemption pursuant to SectIon 15302 (Replacement or Reconstruction) of the State CEQA Guidelines because this CEQA section allows the conversion of overhead electric utility distribution system facilities to underground including connection to existing overhead electric utility distribution lines where the surface is restored to the condition existing prior to the undergrounding. Thus, no further environmental review is required. RECOMMENDA nON Council adopt the resolution. 6-1 10/12/10, Item~ Page 2 of 3 BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION The County of San Diego desires to underground the overhead electric utilities, consisting of uistribution lines anu 69 kV transmission lines and poles, along Plaza Bonita Road approxunately from 600 feet north of the intersection with Bonita Mesa Road to the southwest comer of Plaza Bonita Road anu Bonita Road. On December 1, 2004, the County of San Diego adopteu Ordinance No. 9685 (Attachment 1 l, which approved the fOffiJation of Underground Utility District No. 98 on Plaza Bonita Road. The ordinance took effect 30 days after the date of its passage. According to Public Utility Commission (PUC) Rule 20A, the governing body of the city or county where the overheau electrical facilities are located must adopt an ordinance creating an unuerground district III which both the existing and new facilities are and will be locateu and in which all overhead electrical and communication facilities shall be removed. County staff therefore requested that the cities of National City anu Chula Vista establish utility undcrgrounding districts along Plaza Bonita Road. The County would pay for the undergrounding with their Rule 20A funds. The City of National City formed a utility underground district for the portion of the district with their City boundaries on November 18, 2008, authorizing the County of San Diego to remove the utility poles and overhead wires and install underground electrical facilities within the district at its sole expense. On June 30 2010, staff received notice that the County had decided to proceed with construction of the Plaza Bonita district. COLmty staff requested that the City proceed with formation of the district within Chula Vista boundaries. This district would only include undergrounding of clectricallines, since there are no overhead communication facilities in this area. PUC Rule 20A and Section 15.32.130 of the Chula Vista Municipal Code requires Council to set a public hearing for the establishment of a utility underground district in order to detennine if the public health, safety or general welfare will be served. On September 14,2010 City Council adopted Resolution No. 2010-231 (Attachment 2), declaring the City's intention to underground existing overhead electncal and communication lines along Plaza Bonita Road and setting a public hearing for the October 12, 2010 Council meeting. The location of the proposed district is shown on Attachment 3. Although this portion of Plaza Bonita Roau is in the unincorporated County area, the SDG&E utility easement, which includes the utility poles, is within the City. The utility wires across Bonita Roau will be removed, but the pole on the southwest comer of Bonita Road and Plaza Bonita Roau/Lynwood Drive will remain, because it is needed to serve properties on the south side of Bonita Road. Section 15.32.140 ofthe Chula Vista Municipal Coue requires the City to notify all affected persons and concerned utility companies ofthe time and place of the public hearing at least 15 days prior to the public hearing. Since there currently are no individual electric services cOImccted to the 6-2 10/12/10, Item~ Page 3 of 3 dIstribution lines within the district, no private service conversions will need to be done as part of the district. Since only electrical distribution and transmission lines are involved, SDG&E is the only affected utility, bllt we included other interested utilities serving the area. Public notices have been mailed out as specified. The City is also required to publish the resolution calling for a public heating in a newspaper of general circulation one time no less than five days prior to the date of the public hearing. Notice has been published in the Chula Vista Star News as required. DECISION MAKER CONFLICT Staff has reviewed the property holclings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties which are the subject of this action. CURRENT FISCAL IMPACT There are no impacts to the General Fund or other Chula Vista funds for this action. All work associated with the utility undergrounding will be paicl by San Diego County's Rule 20A funds. ONGOING FISCAL IMPACT There will be no ongoing fiscal impacts. ATTACHMENTS I. Section 89.299 is hereby added to the San Diego County Code of Regulatory Ordinances to read as follows: Sec. 89.299UNDERGROUND UTILITY DISTRICT NO. 98. The following described portion of San Diego COlUlty, State of California, is hereby declared to be Underground Utility District No. 98 of the County of San Diego: Those portions of Plaza Bonita Road and Lynwood Drive in the County of San Diego, State of California, as shown on Road Surveys 2245 and 885, respectively, copies of which are on file in the Office of the County Engineer of said County, described as follows: I. It is the finding of the Board of Supervisors of San Diego County that the public health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within Undcrgrotmd Utility District No.98. The Board of Supervisors further finds that Underground Utility District No.98, herein created, is in the general public interest because that portion of Plaza Bonita Road, from Bonita Road to Bonita Mesa Road, within Underground Utility District No. 98 is used by the general public and carries a heavy volume of vehicular traffic and has a heavy concentration of overhead lines. Section 3. ([I," OF "A" (HUlA VISTA PREPARED BY: ROBERTO SOLORZANOSEPTEMBER 2010 PROPOSED PLAZA BONITA UTILITY UNDERGROUND DISTRICT I RESOLUTION 2010- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ESTABLISHING THE PLAZA BONITA UTILITY UNDERGROUND DISTRICT ALONG PLAZA BONITA ROAD FROM THE NORTH CITY LIMITS TO THE SOUTHWEST CORNER OF BONITA ROAD I I I I I I I , I I I I I I I I i I I I WHEREAS, the County of San Diego wishes to underground the electrical transmission and distribution lines located within San Diego Gas and Electric (SDG&E) right-of-way along the west side of Plaza Bonita Road from approximately 600 feet north of Bonita Mesa Road to the intersection with Bonita Road, which is partly within the City of Chula Vista as shown on the County of San Diego Underground Utility District No. 98 Legal Description (County Ordinance No. 9685) and on the County of San Diego Underground Utility District No. 98 Map incorporated herein by this reference and on file with the Chula Vista City Clerk pursuant to Chula Vista Municipal Code section 15.32.150; and WHEREAS, there are no properties that tie into the subject distribution lines and no streetlights owned and/or maintained by the City would be affected by formation of the proposed underground utility district, therefore Municipal Code Section 15.32.150 A and B are not applicable and a subsequent resolution will not be required; and WHEREAS, Public Utility Commission (PUC) Rule 20A requires that the governing body of the city or county where the overhead electrical facilities are located create an underground district in which both the existing and new facilities are and will be located and in which all overhead electrical and communication facilities shall be removed; and WHEREAS, the County proposes to pay for all the costs of the undergrounding by using its funding allocation as specified in PUC Rule 20A and requests that the City of Chula Vista form an underground district; and WHEREAS, the formation of an underground district by the City along Plaza Bonita Road will be contingent on the payment of all undergrounding costs by the County; and WHEREAS, on September 14,2010, Council adopted a resolution declaring the City's intention to underground overhead electrical transmission and distribution lines along Plaza Bonita Road from the north City limits to the southwest comer of Bonita Road and setting a public hearing for the October 12,2010 Council meeting, in accordance with Section 15.32.130 of the Chula Vista Municipal Code; and WHEREAS, notices of the public hearing have been sent to all affected property owners and concerned utilities and published in the Chula Vista Star News in accordance with Section 15.32.140 of the Chu1a Vista Municipal Code; and 6-12 Resolution No. Page 2 WHEREAS, a public hearing has been held on October 12, 2010 to consider the establishment of the Plaza Bonita Utility Underground District and all persons interested were given the opportunity to be heard. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula Vista does hereby establish the Plaza Bonita Utility Underground District along Plaza Bonita Road from the north City limits to the southwest corner of Bonita Road. BElT FURTHER RESOLVED that the City Council hereby makes those certain findings that the public health, safety and general welfare requires the removal of the subject poles, overhead wires and associated structures within said district.
