This item involves a request to rezone a .49 acre parcel located at 290 IIHII Street from R-3 to C-O. The Planning Commission also included for consideration the rezoning from R-3 to C-O of two parcels located immediately to the west and contiguous to the subject property. 2. On P.pril 22, 1981 the Planning Commission adopted the Negative Declaration on 15-81-34, which is forwarded for Council adoption. . . B. RECOMMENDATION: Concur with Planning Commission recommendation. C. PLANNING COMMISSION RECOMMENDATION: On April 22, 1981 the Planning Commission unanimously recommended that Council approve the rezoning of the property at 290 IIH" Street from R-3 to C-O-P and the two adjacent parcels to the west from R-3 to C-O, in accordance with Resolution PCZ-81-F. D. . DISCUSSION 1. Existing site characteristics. The subject property is a 751x290' level parcel developed with a single family dwelling and detached garage. The two parcels included by the Planning Commission are adjacent to the subject property on the west and lie within the boundaries of the Town Centre Recevelopment area and are being used for parking in conjunction with the bank located at the southeast corner of Third Avenue and IIH" Street. 2. Adjacent zoning and land use. North South East West R-3 C-O & R-l R-3 c-o Church Vacant (Town Centre) and single family dwellings Apartments (16 units) Bank, vacant, and office (Town Centre) -. 3. General Plan The frontage along the east side of Third Avenue, south of IIHII Street is designated on the Land Use Element of the General Plan for development as IIProfessional and Adminis- trative Commercial II and the frontage along the south side of IIH" Street, east of Third Avenue, is designated for IIHigh Density Residential (13-26 DU/acre)" development. The subject property, as well as the additional two parcels, is located at a point where the two land use designations meet and, therefore, can be considered consistent with the General Plan if zoned either comercially or residentially. .. 4. Transitional area. The two lots recommended by the Planning Department and Planning Commission for inclusion in the rezoning are, in effect, used comercially inasmuch as they form the Form A-113 (Rev. 11/79) continued . The lot adjacent on the east to the subject property was developed with an apartment complex in 1977. Thus, the subject property is a transitional property which is suitable either for commercial office use or multiple family development. Inasmuch as the owner also owns the two lots on Third Avenue immediately south of the bank, which are also contiguous with the subject property (in an "L" shaped configuration) and plans to develop the three lots into a mid-rise office complex, it seems appropriate to zone the subject property to C-OP. PCZ-8l-F RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE REZONING OF .49 ACRE AT 290 "H" STREET FROM R-3 TO C-O-P AND .32 ACRE ADJACENT TO THE WEST FROM R-3 TO C-O WHEREAS, a duly verified application for the rezoning of property was filed with the Planning Department by Jeanne B. Campbell and Myron J. & Betty M. Dalseth on March 18. 1981, application No. PCZ-81-F. and WHEREAS. said application requested a change of zone for .49 acres located at 290 "H" Street from R-3 to C-O. and WHEREAS. the City added for consideration a change of zone for .32 acres adjacent to the west of 290 "H" Street from R-3 to C-O. and WHEREAS, an Initial Study, IS-81-34. was conducted by the Environmental Review Committee on April 12.1981. which concluded that there would be no significant adverse environmental impact from the proposed rezoning of the property and issued a draft Negative Declaration. and WHEREAS, the City Planning Commission set the time and place for a hearing on said zone change. and notice of said hearing. together with its purpose was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing. and WHEREAS. a hearing was held at the time and place as advertised. namely 7:00 p.m.. April 22.1981. before the Planning Commission and said hearing was thereafter closed. . . .,. . '. c. Development of the property shall take into consideration the existing trees on the site in order that as many specimen trees as practical may be retained. 3. The Planning Commission recommends to the City Council that said changes of zone be approved. 4. That this resolution be transmitted to the City Council and a copy be transmitted to the applicant. PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA this 22nd day of April, 1981 by the following vote, to-wit: AYES: Commissioners OINeill, G.
