Shinohara in order to clear the title for Brandywine Avenue SUBMITTED BY: City Attorney (4/5ths Vote: Yes No~) The Shinoharas have requested that the City accept a Quitclaim Deed in any interest they may have in Brandywine Avenue. RECOMMENDATION: That the City accept the Quitclaim Deed BOARD/COMMISSION RECOMMENDATION: N/A DISCUSSION: The property on the east and west side of Brandywine Avenue, known as Assessor's Parcel Nos. 644-040-20, 21, owned by the Shinoharas was previously required to dedicate street right of way in Brandywine Avenue to the City of Chula Vista. This was doneby a grant deed. Recently, the Shinoharas retained a civil engineer to do a record of survey of their property which includes the setting of corners in preparation for the filing of a parcel map. When they went to a title company, it recognized the City's interest in Brandywine Avenue as a fee interest. The County of San Diego refused to approve the record of survey because it disagreed with the title company and classified the City's interest in Brandywine Avenue as an easement. The grant deed is somewhat ambiguous in describing the City's interest, but the Shinoharas have no desire to retain any interest in the street and would prefer to clear up this ambiguity by quitclaiming any remaining interest they have in the street to the City. This would give the City a clear fee interest in the street and would satisfy the County of San Diego.
