After many years, the City has received grants of easement from three
of the property owners adjacent to the north side of the Chula Vista
Municipal Golf Course. Although the easements have been utilized both
by the City of Chula Vista and its predecessor in interest for a long
period of time, there has never been any recorded document as to the
existence of the easements or their purpose.
RECOMMENDATION: Accept the easements and direct their recordation

BACKGROUND:
For almost twelve years, the property owners contiguous with the Chula
Vista Municipal Golf Course have registered their protests as to the
use by the City of approximately 20 feet of their property on the
periphery of the Golf Course for golf course purposes. At some point
in time, the prior owner of the course, the Bonita Country Club, had
obtained easements from the property owners and conveyed the Golf Course
as well as those easements, although the title policy does not clearly
reflect the status of the easements.
After threats of lawsuits and a good deal of really unnecessary hard
feelings on the part of those property owners, Councilman Cox requested
that the City Council authorize him to obtain easements from the pro-
perty owners which would contain a reversionary clause stating that at
such time as the Golf Course would cease to be used for that purpose,
the easemen~would be extinguished. The City Attorney concurred that
such an arrangement would be fair and reasonable to all Darties and
in no way detrimental to the interests of the City either now or at
such future time as the Golf Course may cease to be operating. Three
of the property owners who have been the most vociferous in their
complaints have now executed grants of easement and I believe the problem
has now been amicably resolved in the interests of both the property
owners and the City. Councilman Cox has done an excellent job of
facilitating that resolution.
