In conjunction with the conditional approval by the Design Review
Committee for development at 319 Roosevelt Street, the owners are
required to enter into an agreement with the City to not oppose
the formation of a 1911 Act District or similar proceeding in the
event that such an action for the 300 block of Roosevelt Street
is initiated in the future_ It is my
RECOMMENDATION: That the Council approve subject agreement and
authorize the Mayor to execute the agreement on behalf of the
City.
BOARD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
In July of last year, Mr. and Mrs. William E. Franklin submitted
a request to construct a 6 unit apartment house at 319 Roosevelt
Street. The Design Review Committee considered and conditionally
approved the proposal on August 7, 1980. One of those conditions
states that the Franklins shall enter into an agreement with the
City to not Oppose any 1911 Act or similar proceeding which may
occur in the future to widen the 300 block of Roosevelt Street.
Roosevelt Street is a fully improved street. However, the curb to
curb width is only 30 feet while our standard width is 36 feet
wide. This width has worked satisfactorily for many years,
but the area is in transition from R-l to R-3 development.
We believe that as more traffic is generated some solution to the
problem will to be needed. Alternatives could be to:
1. Widen the street to 36 feet curb to curb.
2. Eliminate parking on one side.
3. Make the street one-way.
Widening the street would be the most expensive by far and also
requires removal of all the parkway trees. Until a final
decision is made we recommend that new developments agree to NOT
protest any future assessment districts. Engineering staff is
planning to include this issue in our work program for next
fiscal year.
The City Council approved a similar agreement on May 5, 1981, with
regard to an 11 unit apartment unit at 325 Roosevelt Street owned
by Robert Pruitt.

Mr. and Mrs. Franklin have properly executed their portion of the
agreement and have submitted it for approval by the City Council.
I recommend approval by the Council and authorization for the
Mayor to sign the agreement on behalf of the City.
