Jerry A. Milburn is building a single family dwelling on his property at
3966 Palm Drive. He has requested permission to connect to the City
sewer system prior to completion of annexation proceedings. It is my
ITEM TITLE:
RECOMMENDATION: That City Council approve subject agreement and
authorize the Mayor to execute on behalf of the City.

DISCUSSION:
On August 20, 1980, the owner of County Tax Assessor's Parcel No. 593-
111-08 (3966 Palm Dr i ve, Bon i ta) subm i tted an appl ica tion to the
Planning Department for annexation to the City. The necessary documents
are complete and ready to submit to the Local Agency Formation
Commission. They are being held pending the resolution of the tax
distribution negotiations between the City and the County.
Since the application was made, the owner began construction on his
house upon the subject property. The building is nearing completion and
the owner desires to connect to the City sewer. It has been the City's
practice to allow such connections prior to final annexation of the
properties involved after the owners demonstrate the intent to annex to
the City and enter into an agreement stating that they will complete the
annexation proceedings.
The Milburn agreement includes the following conditions:
1. Owner is soley responsible for the cost of:
a. plans for sewer main extension (approximately 150 L.F. to
serve his property) prepared by a registered civil engineer
and approved by the City Engineer,
b. installing said sewer extension by an engineering contractor,
and
c. installation of his private sewer lateral (approximately 400
L.F.)
2. Ovmershall secure all permits associated with the sewer connection
and pay all appropriate fees.

3. If the owner causes obstruction to the annexation proceedings, the
City may require disconnection from the sewer system at the sole
cost of the owner.
Mr. Milburn has executed his portion of the agreement. I recommend that
the Council approve it and authorize the Mayor to sign on behalf of the
City.
