RESOLUTION NO. 9944 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 80-8, PARKWAY PLACE follows: The City Council of the City of Chula Vista finds as That in accordance with the attached Negative Declara- tion, IS-75-78, and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Chula Vista Tract 80-8, Parkway Place and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-80-8, adopted on the 9th day of January, 1980, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative subdivision map in accordance with Planning Commission Resolution No. PCS-80-8. BE IT FURTHER RESOLVED that final plans for handling the drainage for this project are to be brought back before the City Council for approval at the time of submission of the final map. On Dec. 11, 1975 a draft Negative Declaration of Environmental Impact was recommended by the Environmental Rpview'Committee of the City of Chula Vista. The project is descri bed as follo\'/s: a 20 unit apartment buildinq with 30 on site parking spaces and over 9000 sq. ft. of landscapinq 1>roject LocatlOn: Near the northwest corner of Park Way & 5th Ave. Chula Vista It is the finding of the Environmental Review Committee that the project will not have a significant effect on the environment for the following reasons: 1. The Project will not adversely affect any natural or man made environment~l features present in the project setting, nor will the project generate any pollutants that will have a potential to signficiantly degrade the quality of the environment or curtail the range of the environment which supports the biosystem. 2. The project is in conformance with the long range goals of the City of Chula Vista and will not therefore attain short term to the d.is3dvantage of long range goals. 3. The projcci: Hill not provide any system that could suppurt secondary development that would cumulate to a level of being substantial and adverse nor do any of the insignificant impact inte~act to a significant level. 4. The project will not result in the generation of any noise, air pollution, light, aesthetic blight nor any other hazard to the welfare nor health of any human being. NOTE: This evaluation is limited to site plan and architectural review, consideration of a parcel map and the consideration of a density variance. PCS-80-8 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 80-8, PARKWAY PLACE WHEREAS, a tentative subdivisin~ ~ap for Chula Vista Tract 80-8, Parkway ) Place, was filed by Dean Bowden on November 1,1979 to subdivide 3.08 acres located at the northwest corner of Park Way and Fifth Avenue into five lots, and WHEREAS, Section 66473.5 of: :ie State Map Act py'ovi des that" approva"! (i";' a subdivision map shall be based UpOil finuings of consistency between the SULJl vision map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place for a public: hearing to consider said tentative map, and notice of s~id hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to tb,c date of saicl hearing, and WHEREAS, a hearing was held ?t said time arJ place, namely 7:00 p.m.~ January 9,1980 in the City Council Chambers before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission recertified the Negative Declaration on IS-75-78, prepared in 1976 to cover an identical subdivision map on the same property. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission concerning the d~vplop- ment, the Commission finds as follows: a. The site is physically suited for single family residential develop- ment and the proposed project conforms to all standards estab ,.; shed by the City for such use. b. The design of the subdivision"will not affect the existing or proposed improvements: streets, sewers, drainage, etc., which have been designed to avoid any serious health problems. c. The subdivision is consistent with the General Plan Elements as follows: Land Use Element - The General Plan designates this area as High ~t\ tt&1 Density Residential, 13-26 dwelling units per gross acre. Although lot 5 will have a density of 53 units to the acre, the development is already established at that density. Construction of single family homes on the four lots will have the effect of bringing the property more closely into conformance with the General Plan. Lots 1-4 will be developed at a density of approximately 6 units per acre, well within the density designated by the General Plan. Circulation Element - The proposed project is served by existing streets. Housing Element - The proposed project will provide additional decent housing in the Central Area of Chula Vista, thereby providing 'residents a choice of living accommodations. LOil:;ervat"ion> Open Sp3,ce, and Parks and Recreation Elements Yhp developer will pay the required fees for the development of PQrks in the service area. Se'ismic Safety and Safety Elements - The proposed project is not c'los€: to any known geological hazard. Noise Element - The proposed project will not result in the genera- tion of substantial noise pollution nor will it be subject to l!:1i"cc?ptable levels ot noise. Bicycle Routes Element - The proposed project is not required to provide a bicycle route nor will it result in the interference of continuity of any proposed or existing routes. Public Building Element - The proposed project will not result in tile relocation of any existing or proposed public facilities. 2. The Planning Commission recommends to the City Council that the tentative map for Chula Vist(\, Tract 80-8, Parkway Place, be approved, subject to the follow- ing conditions: a. lhe developer shall be responsible for the construction of improved drainage facilities from the northerly property line of lot 1 to the southerly property line of lot 4. The improved drainage facilities shall be capable of carrying a.design flow of 586 cubic feet per second. T~e developer shall also be responsible for the cost of drainage improvements from the southerly property line of lot 5 to the northerly right of way line of Park Way. Said improvements w,ill be constructed in conjunction with a City project and the developer shall post a cash bond deposit with the City for the estimated cost of these improvements prior to approval of the final map. After the installation of these improvements is complete and actual costs are known, the developer will either pay an additional amount or receive a refund so as to adjust the cash deposit to cover exact costs.
