I OF THE CITY OF CHULA FEE POLICY FOR SUB- CENTRE PROJECT AREA The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain In Lieu Parking Fee Policy for Subarea 1 of the Chula Vista Town Centre Project Area No.1, attached hereto as Exhibit "A" and incorporated herein by reference as if set forth in full, be, and the same is hereby adopted. Any developer of a new commercial building within the Downtown Parking District, in Subarea 1 of the Chula Vista Town Centre No.1 Project Area, except for the lands ~ituated within the Townsite Focus Area, or any developer of an addition to an existing commercial building therein, shall pay an In-lieu Parking Fee to the City of Chula Vista prior to the issuance of a Building Permit for ~uch new building or addition. 2. H~~ RESOLUTION NO. PCA-80-5 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO CHAPTER 19.62 OF THE MUNICIPAL CODE RELATING TO OFFSTREET PARKING AND lOADING WHEREAS, the lack of offstreet parking in the urban core of Chula Vista has become a concern, and WHEREAS, the City Council directed the staff to evo.o'uate methods available foy' financing public parking and to !~ecommend a parking pian for' ,:fficial ajop- tion, and WHEREAS, an Initial Study, IS<-80-32, of possible adverse't:il.:ironmental impacts of a proposed amendment to the t-'iunicipal Code telating tt' offstreet parking. was conducted by the Environmental Review Coordinator who concluded that the proposed amendment woul d not produce si gnifi cant envi rorunenta 1 effects and on December 24, 1979 recommended that the Planning Commissio;j adopt a Negative Declaration on the Initial Study, and WHEREAS, the City Planning Commission set the time and place for a hearing to consider the proposed amendment, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., January 9, 1980 in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and the hearing was thereafter closed, and WHEREAS, the Planning Commission found that in accordance with the findings in the Negative Declaration on IS-80-32, the proposed amendment to the Municipal Code will have no significant environmental impact upon the environment, and adopted the Negative Declaration. NOW, THEREFORE, BE IT RESOLVED AS FOllOWS: 1. From facts presented to the Planning Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require the amendment to Section 19.62.040 of the Municipal Code to read as follows: 19.62.040 Alternatives to on-site parking. For any new non-residential use, structure or building, required off-street parking which, due to the size or location of the parcel, cannot be provided on the premises, may be provided on other property not more than two hundred feet distant by publicly available pedestrian access from said use, structure or building, subject to a binding agreement with the city as to permanent reservation of said space and access thereto; or if the proposed nonresidential use lies within the boundary of a parking district, off-street parking requirements shall be considered to be met provided that ;f- f' /FJ any developer of a new commercial building within a parking district, or a developer of a commercial addition to an existing building therein, shall pay the requisite fee established under the City Council's in lieu parking fee policy. 2. The Planning Commission recommends to the City Council that said amendment be adopted. 3. The Planning Comnrission further recommends the adoption of the "In lieu parking fee policy for Subarea 1 of the Chu~a Vista Town Centre Project Area No. 1" as set forth on the attached Exhibit A. ~. That this resolution be transmH'~ed to the City Council.
