HomeMy WebLinkAboutReso 1980-9928 RESOLUTION NO. 9928 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DIRECTING THE CITY MANAGER TO ACT FOR AND ON THEIR BEHALF IN NEGOTIATING AN EQUITABLE AND MUTUALLY AGREEABLE FORMULA WITH THE STAFF OF SAN DIEGO COUNTY FOR PROPERTY TAX EXCHANGES RELATING TO JURISDICTIONAL CHANGES AND REQUESTING THE BOARD OF SUPERVISORS TO GIVE SIMILAR DIRECTION TO THEIR STAFF The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Section 99(b) of Chapter 282 of the California Statutes of 1979 requires the negotiation of any exchange of pro- perty tax revenues occasioned by jurisdictional changes between the areas affected, and WHEREAS, under such circumstances the Board of Supervisors is authorized to negotiate such property tax revenue exhanges on behalf of the County and special districts, and WHEREAS, the City Council of the City of Chula Vista is also authorized and required to enter such negotiation and there- after both bodies are required to approve such negotiated property tax revenue exchanges by resolution, and WHEREAS, in the case of the ADMA Company, Inc. reorgani- zation, such negotiated property tax exchange was agreed upon and approved by Resolution No. 9927, and WHEREAS, the City Council of the City of Chula Vista although expressing its agreement and approval in the case of the ADMA Company, Inc. reorganization, did so with the firm con- viction that the property tax exchange negotiated in that instance did not constitute a fair and equitable distribution of property tax either for the ADMA reorganization and, more particularly, in respect to future annexation, and WHEREAS, the City Council strongly desires to signifi- cantly modify the negotiated tax exchange formula arrived at in regard to the ADMA reorganization either as expressed in Resolu- tion No. 9927 or through amendments to the state law regarding the distribution formula for property taxes or through a continued negotiation process by the staffs of the City of Chula Vista and the County of San Diego. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby direct that the City Manager and the Mayor and a designated Councilmember meet with and negotiate with representatives of the San Diego County Board of Supervisors. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby specifically request that the San Diego County Board of Supervisors give similar instruction to its staff and to a designated member or members of the Board. BE IT FURTHER RESOLVED that in the event a new formula for distribution of property tax exchanges is arrived at between the County and the City, such new formula shall apply to attachment 4 of the resolution of the County of San Diego for that annexation known as ADMA Company, Inc. Reorganization, and the property tax exchange shall be appropriately adjusted. BE IT FURTHER RESOLVED that that City Clerk be, and she is hereby directed to forward a certified copy of this resolution to the County Board of Supervisors, the San Diego County Auditor and all the cities in San Diego County. No. 142 TUESDAY, DECEMBER 18, 1979 RESOLUTION RE NEGOTIATED PROPERTY TAX EXCHANGE RELATING TO JURISDICTIONAL CHANGES On motion of Supervisor Hamilton , seconded by Supervisor Eckert , the following resolution is adopted: WHEREAS, Section 6.6 of Chapter 1161 of the Statutes of 1979 requires the negotiation of any exchange of property tax revenues occasioned by jurisdictional changes between the areas affected; and WHEREAS, under such circumstances the Board of Supervisors is authorized to negotiate such property tax revenue exchanges on behalf of the County and special districts; and WHEREAS, the attached list of jurisdictional changes between the County, special districts and cities are proposed; and WHEREAS, the Board of Supervisors has negotiated with each of the affected cities to determine an_equitable exchange of property tax revenue applicable to such jurisdictional changes; NOW THEREFORE IT IS RESOLVED AND ORDERED that each of the listed jurisdic- tional changes shall result in the property tax exchanges shown on the attachment.
