RESOLUTION NO. 9916
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA DECLARING ITS INTENTION TO CONDUCT A PUBLIC
HEARING TO CONSIDER THE DEFERRAL OF UNDERGROUNDING
REQUIREMENTS AT 740 HILLTOP DRIVE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Section 15.32.050 of the Chula Vista Municipal
Code provides that the City Council may vary from or defer the
requirements of undergrounding utilities in a new construction
project if the City Council finds from the evidence presented at
the public hearing that all of the following facts exist:
1. That extraordinary conditions exist to the extent
that enforcement of this section would result in
unnecessary hardship to the owner or the utility
company.
2. That such deferral will not, under the circumstances
of the particular case, be detrimental to the health,
safety or general welfare of the neighborhood.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby declare its intention to con-
duct a public hearing for the purpose of whether to defer the
undergrounding of utilities at 740 Hilltop Drive on Tuesday,
February 5, 1980 at 7:00 p.m. in the Council Chambers, City Hall,
276 Fourth Avenue, Chula Vista, California.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and she is hereby directed to cause a copy of
this resolution to be published once in a newspaper of general
circulation published within the City of Chula Vista, and to
cause notices of the passage of this resolution to be posted in
the manner and form required by law.
