ENVIRONMENTAL REVIEW The Environmental Review CQQrdinatQr has reviewed the proPQsed project fQr compliance with the CiilifQmia Environmental Quality Act (CEQA) and has determined that the project qualifies fQr a Class 3 categorical exemptiQn pursuant tQ SectiQn 15303 [New CQnstructiQn] .of the State CEQA Guidelines because the project includes the placement .of acceSSQry freestanding sculptures, fencing and landscape features within the dQwntQwn business district. Thus, nQ further environmental review is necessary. RECOMMENDATION That CQuncil ad .opts the resQlutiQn. BOARDS/COMMISSION RECOMMENDATION The Cultural Arts CQmmissiQn .of the City .of Chula Vista recQmmends that CQuncil adQpt the resQlutiQn. 6-1 SEPTEMBER 28, 2010, Item~ Page 2 of2 DISCUSSION Existing Council policy requires that developers of every major project within the TO\'iIl Centre 1 and Bay Front project areas contribute either one half of one percent (Bayfront) or one percent (Town Centre I) of the cost ofa major project as a fee to go into the Fine Arts Fund. The Fine Arts Fund was set up to promote visual and cultural enhancements within the Town Centre I and Bayfront areas. The fine arts policy restricts the use of these funds for use on exterior works, to include sculpture, statuary, fountains, murals, bas-relief, monuments, stained glass and wood carvings. The proposed use of these fuuds to purchase sculpture or create exhibit space for rotating art pieces to be displayed in the Town Centre 1 area is allowable and recommended use of the Fine Arts Fund. In late 2009, the Cultural Arts Commission commenced discussion on how to improve the visual appearance of the comer lot on Third Avenue and E Street. The lot, having been vacant for a number of years, was considered by the Commission as a possible site for a community garden with an accompanying mural. Additional information obtained from the Development Services Department, Redevelopment Division concerning the site's suitability as a community garden caused the Commission to change their vision for the space. As a result, a garden of sculptures that could be relocated if the lot was to be developed at a later time was thought by the Commission to be a better use of the space. The Commission will seek additional donations from local businesses and sponsors to complete the project. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has fonnd a connict exists, in that COUllcilmember Steve Castaneda has property holdings within 500 feet of the boundaries ofthe property which is the subject of this action. . CURRENT YEAR FISCAL IMPACT Approval of the resolution will result in the a one-time appropriation of $20,000 to the Fine Arts Fnnd's Services and Supplies expenditure category from the available fund balance. The appropriation of $20,000 will be used to acquire sculptures. ONGOING FISCAL IMPACT None. One time request ATTACHMENTS Not applicable Prepared by: Stephanie Loney, Principal Librarianl Staff Liaison tv the Cultural Arts Commission 6-2 RESOLUTION NO. 2010- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE CULTURAL ARTS COMMISSION REQUEST TO APPROPRIATE $20,000 TO THE FINE ARTS FUND FROM THE AVAILABLE FUND BALANCE FOR THE PURPOSE OF FUNDING THE SCULPTURE GARDEN PROJECT WHEREAS, the Fine Arts Fund was established to promote visual and cultural enhancements within the Town Centre I and Bayfront areas; and WHEREAS, the Fine Arts Fund balance is currently $32,315.00; and I I I I I I , I j I WHEREAS, the line arts policy restricts the use of these funds for use on exterior works, to include sculpture, statuary, fountains, murals, bas-relief~ monuments, stained glass and wood carvings; and WHEREAS, the Cultural Arts Commission has determined that the site located on the corner of Third A venue and E Street would be enhanced by a garden of sculptures; and WHEREAS, the Cultural Arts Commission would like to purchase sculptures for the site located on the corner of Third Avenue and E Street or create exhibit space for rotating art pieces; and WHEREAS, the Cultural Arts Commission, in order to purchase a collection of sculptures, would like to utilize a portion of the Fine Arts Fund while seeking donations from other sponsors and local businesses; and WHEREAS, the Cultural Arts Commission is requesting an appropriation of $20,000 from the Fine Arts Fund to be used to purchase sculptures for the Bayfront/Town Centre I redevelopment project area. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the appropriation of $20,000 from the Fine Arts Fund for the use by the Cultural Arts Commission to commence creation of a Sculpture Garden.
