The Chula Vista Chamber of Commerce has also requested that this alteration be made. Motel proprietors have represented that the current restriction on forms of identification unfairly inhibits their business. Specifically, the request is to permit non-U.S. residents to use their valid, non-U.S. drivers' licenses as a form of identification to rent motel or hotel rooms in Chula Vista. Currently the only permitted fonns of identification for non-U.S. residents are official passports, U.S. Visas, INS alicn registration cards, or INS border crossing cards. Chula Vista Municipal Code S 3.41.030(B). The Chula Vista Police Department, as monitoring agency of motels and hotcls, has no objection to the requested alteration. Accordingly, staff recommends the Council approve this simple alteration to the Chula Vista Municipal Code. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the state CEQA Guidelines because it will not result in a physical change in thc environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to the CEQA. I I i I , j I I I I , , , I I I I I I I I I I I , ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 3.4[, SECTION 3.41.030, SUBSECTION B OF THE CHULA VISTA MUNIC[P AL CODE WHEREAS, the Chula Vista Municipal Code imposes requirements on the types of identification a person needs to display in order to rent hotel or motel rooms in Chula Vista; and WHEREAS, Chula Vista hotel proprietors have requested that non-U.S. residents be permitted to rent rooms with validly issued driver's licenses trom their nation of origin; and WHEREAS, the Chula Vista Municipal Code needs to be amended to reflect this request; and WHEREAS, other than the amendment to Subsection B of Section 3.41.030, the remainder of Section 3.4 1.030 will remain the same. That Chula Vista Municipal Code Chapter 3.41, Section 3.41.030, Subsection B, be amended to read as follows: 3.41.030 - Regulations B. Satisfactory identitication for legal residents of the United States shall consist of one of the following: a valid driver's license issued by the transient's state; a federal or state government or military identification card; a passport; or any other form of valid governmental identification on which the transient's photograph appears. For persons legally residing outside of the United States, valid governmental identification shall include an official passport, U.S. visa, INS alien registration card El-f-INS border crossing card. or a valid driver's license issued from the oon-U.S. resident's nation or QD.gill. SECTION II. EFFECTIVE DATE. This ordinance will take effect and be in force thirty days after final passage. Presented by Approved as to form by 18-3
