AGENDA STATEMENT \ ':;::. . .~.. .,.i~' ITEM TITLE: SUBMITTED BY: REVIEWED BY: September 14,2010 Item '8 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DELEGATING AUTHORITY TO THE CITY MANAGER TO ACT ON THE CITY'S BEHALF IN MATTERS RELATING TO THE CITY AND THE CSAC EXCESS INSURANCE AUTHORITY IV DIRECTOR OF HUMAN RESOURCES .t-\U ASSISTANT CITY MANAGER ~.., CITY MANAGE~ 4/STHS VOTE: YES D NO ~ SUMMARY The City's excess workers' compensation insurance pool, CSAC Excess Insurance Authority (Authority), has determined that it is necessary for each member of the Authority to delegate to a person(s) or position(s) authority to act on the member's behalf in matters relating to the member and the Authority, except for those actions that must be approved by the member's governing body. This resolution delegates that authority to the City Manager. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defmed under Section 15378(b)(5) of the State CEQA Guidelines because it involves only the delegation of authority to the City Manager in matters concerning the City's excess workers' compensation insurance pool; therefore, pursuant to Section 15060( c )(3) of the State CEQA Guidelines the activity is not subject to CEQA. RECOMMENDATION Council adopt this resolution. BOARDS/COMMISSION RECOMMENDATION 8-1 Not Applicable DISCUSSION In October 2003, the City joined the Authority, a statewide member driven insurance pool comprised of public entities, in order to secure more cost-effective excess workers' compensation coverage than we could on our own. The City's Risk Manager, Teri Enos, is currently an elected member of the Authority's Board of Directors. The EIA is currently updating its records and has requested that each member entity's governing body delegate authority to an individual or position to officially act on the member's behalf in matters relating to the member and the Authority, except as to those actions that must be approved by the governing body itself. This resolution will delegate that authority for the City's matters to the City Manager. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in the California Code of Regulations section 18704.2 (a)(l) is not applicable to this decision. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DELEGATING AUTHORITY TO THE CITY MANAGER TO ACT ON THE CITY'S BEHALF IN MATTERS RELATING TO THE CITY AND THE CSAC EXCESS INSURANCE AUTHORITY WHEREAS, the CSAC Excess Insurance Authority (Authority) has determined that it is necessary for eaeh member of the Authority to delegate to a person(s) or position(s) authority to act on the member's behalf in matters relating to the member and the Authority; and WHEREAS, except as to those actions that must be approved by the City Council, sueh delegation of authority is necessary in order to earry out the purposes and functions of the Authority with its members; and WHEREAS, in order to ensure a person(s) or position(s) is delegated with authority to act on the member's behalf in matters relating to the member and the Authority, action by the member's governing body is necessary. NOW THEREFORE, BE IT RESOLVED by the City Council of the City ofChula Vista that it hereby delegate authority to the City Manager to act on the City's behalf in matters relating to the City and the CSAC Excess Insuranee Authority.
