This program involves a regional collaboration of local agencies conducting DUI / driver license checkpoints and saturation patrols, with the goal of reducing the number of alcohol-involved collisions in the South Bay region. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDA nON Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. 12-1 9/14/2010, Item /2- Page 2 of3 DISCUSSION The California Office of Traffic Safety's (OTS) mission is to obtain and effectively administer traffic safety grant funds to reduce deaths, injuries and economic losses resulting from traffic related collisions. The Police Department has been awarded various OTS grants, including the Serious Traffic Offenders Program (STOP), Comprehensive Traffic Safety Program, DUI Enforcement Program, and Selective Traffic Enforcement Program (STEP), which all enhanced the Traffic Unit by funding new positions. Additionally, OTS administers mini-grants such as the Sobriety Checkpoint Program and Click It or Ticket, which funds traffic enforcement operations on an overtime basis. In addition to the prosecution services provided by the District Attorney's Office, the Police Department will coordinate regional efforts to conduct DUl/driver license checkpoints, saturation patrols, warrant service operations, court stings and minor in possession operations. Participating law enforcement agencies include San Diego, Coronado, National City, San Diego Sheriff, San Diego Probation and Southwestern College. These enforcement operations will be conducted on an overtime basis by all agencIes. I i I I I I I I I I I I I I I In October 2008, the California Office of Traffic Safety awarded $525,000 to the Police Department to implement a program focused on vertical prosecution of traffic-related cases in the South Bay region. This program has greatly enhanced the efficiency and effectiveness of traffic enforcement. Consequently, the Police Department has been awarded another $486,539 to continue the DUI Prosecution and Awareness Program, which covers a one-year period of 10/1/20 I 0 to 9/30/2011. A District Attorney Investigator III from the San Diego County District Attorney's Office will be retained on a contractual basis for the period of the grant and utilized as a drug recognition expert witness for prosecution of non-alcohol DUI cases, as well as attending and providing testimony regarding the set up and operation of checkpoints. This position will assist the vertical prosecution District Attorney with case preparation and provide training to allied agencies to improve prosecution of traffic cases. Along with the contractual costs with the District Attorney's Office and overtime costs to conduct the enforcement operations, there will be one-time expenses of training costs and checkpoint supplies. When the grant ends in September 2011, the contractual services with the District Attorney's Office will also end. The Police Department will work with the District Attorney's Office on the continuation of these important services after September 2011. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. 12-2 9/14/2010, Item 12- Page 3 of3 CURRENT YEAR FISCAL IMP ACT Approval of this resolution will result in the acceptance of $486,539 of grant funding from the California Office of Traffic Safety, Because the grant period crosses between two fiscal years, $366,505 will be appropriated to the fiscal year 2010/2011 budget of the Police Grant Fund and $123,034 will be included in the fiscal year 2011/2012 budget. The funding from the California Office of Traffic Safety will completely offset the costs of the DUl Prosecution and Awareness Program, resulting in no net fiscal impact. ONGOING FISCAL IMPACT There is no ongoing fiscal impact for accepting these grant funds. A TT ACHMENTS None. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby accept $486,539 from the California Office of Traffic Safety and appropriate $89,936 to the personnel services category and $276,569 to the supplies and services category of the Police Grant Fund for the DUI Prosecution and Awareness Program.
