These improvements were required to be installed in .unction with the construction of 18 residential units within their erty under Conditional Use Permit PCC-87-8. RESOLUTION l'3f~ Y The Council received a request from the Pioneers at its meeting of August 16, 1988 that this agreement be amended and referred the request to staff for analysis and possible preparation of an appropriate amendment to the agreement. RECOMMENDATION: That Council accept this report and approve the resolution as discussed herein BOARDS/COMMISSIONS RECOMMENDATIONS: Not Applicable. The City's financial participation in this project was established at a maximum of $160,000 under the original agreement. That amount was stated to include costs of improvements, engineering, surveying, soils investigation and testing, inspection, project management, utilities relocation and right of way acquisition. The City was to prepare the required environmental review, plans, specifications and cost estimate and to administer a contract providing for the construction work to be done. All of our costs in these regards were to become part of the project cost. All of the project costs in excess of $160,000 were to be paid by the South Bay Pioneers. The sum of $50,000 was to be deposited with the City by the pioneers prior to occupancy of the units to cover those excess ~s as established by a preliminary estimate for budget purposes. . Page 2, Item 20 Meeting Date 10/25/88 The request received by Council on August 16 basically proposes that the City prepare the plans and specifications for the project as initially anticipated and complete the project to subgrade, including removal and replacement of unsatisfactory material, utility relocation, and all other subsurface work and grading. It is also proposed that the City absorb the incidental project costs such as testing, design, and inspection. Upon completion of the above "City" work the pioneers would submit to the City Engineer signed contracts for the surface improvements including curb, gutter and sidewalk; street lights; and pavement. All of this work would be performed along the south side of "c" street, and as noted above would be handled as a separate contract. No money would be deposited with the City, since our relative responsibilities would be established by those contracts. It was also requested that the bonding requirements for the Pioneers' work be waived. The estimated proj ect costs at the time the original agreement was .oved amounted to $193,640, excluding any allowance for ingencies, testing, design, inspection, or other incidental costs. P 3 Item 20 age , Meeting Date 10/25/88 The surface improvements,with contingencies, shown as a "Pioneers" amount account for $37,554, leaving $175,450 for construction costs associated with the work now proposed to be paid for out of City (Block Grant) funds. Additionally, testing of the subsurface material is expected to cost approximately $6,000 in addition to the costs previously paid during the time this project was being considered as a normal City Capital Improvement Project. Estimated incidental costs (including preparation of plans by a consultant at an assumed cost of $6,000) are $18,900. The total of City costs under this proposal would be $200,350, representing an overall increase of $40,350. However, the extent of unsuitable subsurface materials under the street is presently still not defined, so that major cost may be substantially more or less than was considered in our estimate. On the bases that this proposal represents an increase in the ei ty' s share of the project costs of approximately 25% ($40,350/$160,000) and that the concept is greatly changed by dividing the work into two .rate contracts with each party wholly responsible for the costs of r respective contract we would recommend that the Council not concur in this amendment. As an alternative, however, it is noted that the Tentative Map for ehula vista Tract 88-9 has been filed for the property immediately across "C" street from the Pioneers property. Improvements wi thin "e" street will also be required of that developer. As a result of certain Conditions of Approval affecting "C" street which have been proposed for this project that developer, representatives of the South Bay Pioneers and the Engineering Division have discussed the combination of these proj ects to achieve the completion of the "e" Street improvements from the westerly line of Del Mar Avenue to Third Avenue Extension. On the basis of that discussion it is proposed that a soils investigation for the full width of "c" Street be conducted. The work would be accomplished by Benton Engineering, who performed the earlier investigation for the City. In this situation the work would be done under an agreement with the developer, Mr. Ron Helderlein, and be paid for by him and the City in equal amounts. . . Page 4, Item 20 Meeting Date 10/25/88 After completion of that investigation and the resulting report it is proposed that the developer's engineer prepare grading and improvement plans for the improvement of "c" street across the full frontage of both properties. The cost of that work would be paid by the developer and the City, with the proportionate shares determined by the estimated cost of work (grading and improvements) on the respective sides of the street centerline. All of the City's costs for the soils investigation and plan preparation would be taken from the overall contribution of $160,000 previously set aside for this project. Upon completion of the plans an agreement for a cooperative project among the developer, South Bay Pioneers and the City would be prepared and executed. It is recommended that this alternative proposal be accepted by Council and that staff be directed to return with an agreement providing for the City's participation in the modified project as discussed above. It is also recommended that Council adopt a resolution authorizing staff to .iciPate in the cost of a soils investigation and to pay a portion of cost for preparation of plans for the improvement of "c" Street as dlscussed above. FISCAL IMPACT: A total of $160,000 in Block Grant Funds was set aside for this project in 1987. No additional City cost is anticipated as a result of this proposed amendment.
