On May 10,1988, the City Council by Resolution No. 13554, awarded a contract
in the amount of $124,443 for the installation of traffic signals at the East
H Street/Rutgers Avenue - Corral Canyon Road and Otay Lakes Road/Ridgeback
Road - Canyon Drive intersections. The contract was awarded to MCR Electrical
Contractors, Inc. The work is now completed.
RECOMMENDATION: That Council approve a resolution accepting the contract
work.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
~CR Electrical Contractors, Inc. completed the installation of traffic signals
at the East H Street/Rutgers Avenue - Corral Canyon road intersection and at
the Otay Lakes Road/Ri dgeback Road - Canyon Drive i ntersecti ons on August 4,
1988 and on September 29, 1988, respectively. Final inspections of the
traffic signals were made on August 5, 1988 (East H Street/Rutgers Avenue) and
on September 30, 1988 (Otay Lakes Road/Ridgeback Road). All work was found to
be completed in accordance with the contract plans and specifications and to
the satisfaction of the Acting City Engineer.
It should be noted that this contract expired on July 27, 1988. The
contractor, however, requested a contract time extension prior to the
expiration of the contract. The request for a time extension was due to the
fact that one of the contractor I s materi a1 s supp1 i ers coul d not furni sh the
traffic signal pole in a timely fashion which in accordance with the contract
documents is a valid reason for a contract extension. Due to a mix-up in
communication and personnel staff changes in Engineering, this item was not
brought before Council before the contract date expired. Had the request been
processed at the appropriate time, staff would have recommended that the time
extension be approved by the City Council because the request was
appropri ate. We, therefore, recommend that Counc i1 accept the contract work
and that no liquidated damages be imposed on the contractor.
