On January 28, 1986, the City Council adopted Policy No. 840-02, a smoking policy for employee areas of City buildings. That policy contained a clause which required that it be re-evaluated for its effectiveness. The policy has been re-evaluated and a management team has met in committee (in meet and confer sessions) with representatives from all employee associations. The amendments presented with this agenda statement have been agreed to by the employee associations. ~ECOMMENDATION: That Council adopt the proposed amendments dealing with smoking by employees in non-public areas of City buildings and that such amendments become effective on October 17, 1988. BOARD/COMMISSION RECOMMENDATION: N.A. DISCUSSION: The original policy which Council adopted in January 1986 included a clause that the policy then adopted would be evaluated for its effectiveness. Since the adoption of that policy, one of the sections of the policy which has created the most complaints by employees was the section that permitted certain employees to continue to smoke at their work stations in the Public Services Building. The three changes in the amendment to Policy No. 840-02 are listed below: 1. Revocation of clause permitting certain employees to continue to smoke at their work stations in the PSB. 2. Prohibition of smoking in employee lounges located in City Hall, PSB, and the Library between 11:30 a.m. and 1:00 p.m. 3. . Almost since the adoption of the policy dealing with smoking in complaints have been received from employees not located in the Change of a smoking area in the Police Department from the Adult Interrogation Room to the Chief's Conference Room due to remodeling. employee areas, Public Services / " .. .uilding for the right to be grandfathered, as were certain employees in the ublic Services Building. At the same time, complaints have been received from non-smoking employees in the Public Services Building indicating that the table top air cleaners were not working, and that the employees did not wish smoking to be permitted in any work areas. In addition, a petition was ; forwarded to Council from employees in the Public Services Building requesting that smoking be prohibited in that building. Since the original policy was adopted as a result of meet and confer sessions and since this would be a change in working conditions, it was proper that suggested amendments for the policy be subject to meet and confer. Rather than having separate meetings with each employee association, the management team proposed, and the associations agreed, ~ that each employee association would appoint representatives and that the negotiations would be done in committee. The attached amendments to Policy 840-02 are a result of those meet and confer sessions, and it is recommended that Council adopt the proposed amendments. The attachment to this agenda statement is a marked up copy of the policy with new language underlined and deleted language struck over. : To give affected employees (PSB employees who were permitted to smoke at their work stations) an acclimation period and to notify other employees, it is recommended these amendments not take effect until October 17, 1988.
