Selection of Consultants n\/ SUBMITTED BY Development Services Administrator ~. ~J ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES_ NO x ) Some time ago the Council requested staff to formulate a policy for selection of consultants. Government Code Section 4525, et seq., requires the City to adopt procedures which ensure that professional. services of private architect or enyi.neeriny firms are engaged on the basis of demonstrated competence and qualifications for the types of services to be performed and at fair and reasonable prices. Technical consultiny services are exempted from these procedures. Although the law only applies to A « E ser•.~ices, we have for the sake of uniformity and fairness included all consulting services except Environmental (covered by Environmental Review Policy). The proposed policy is summarized as follows: 1. Consulting service requirements are. publicly announced. 2. For projects with fees of $10,000 or more tha City Manager will appoint a three or five member selection committee. The selection co~nmitt~~e will select the consultant based on established criteria and the Flead of the lead department will then negotiate the contract which wi1.1 go to Council for approval. For projects with fees less than x10,000 the Head of the lead department and one or more staff members will act as the selection committee. 4. Environmental reaiew contracts are negotiated as directed in the Environmental Review Policy and technical contracts use the normal bid process. So far this fiscal year 1~ consultants have been selected. Had this policy been in effect, 7 consultants would have been selected by a Department Head committee and 5 would have required a selection committee appointed by the City Manager. There would have been no change in the selection process for the remaining three which were selected under the Environmental Review Policy. .his policy has been reviewed by other departments and by the City Attorney. All suggested additions and changes have been incorporated. This po7.icy together with the Environmental Review Policy will formalize the selection process for all consulting services required by the City and will fulfill the general and detailed requirements of the Government Code Section n5"?5, et seq. ~~~
