City Manager~h(l>' (4/5ths Vote: Yes_No~J SUBMITTED BY: REVIEWED BY: On July 15, 1988 the Vista Hill Foundation paid $113,454.00 for Development Impact Fees in conjunction with the issuance of a building permit for their hospital expansion. The Foundation has requested a reduction in fees based on their engineer's study. Chula Vista Ordinance 2251 (Section 5) requires that the waiver or reduction of such fees be approved by the City Council. RECOMMENDATION: That Council approve the resolution authorizing the reduction of Development Impact Fees to $62,399.70 as requested and directing . sta ff to refund fees in excess of that amount whi ch have been collected from the applicant. BOARDS/ COMMISSIONS RECOMMENDATION: Not Applicable. DISCUSSION: ~ The application for waiver or reduction is required to contain a statement of the factual basis for such a request. In this instance the factual basis is a study prepared by Linscott, Law & Greenspan, Engineers, for the applicant. This study shows that the volume of traffic generated by facilities which are similar to those covered by the Vista Hill building permit is substantially lower than the volume considered in Ordinance 2251. The measured traffic is 11.0 trips per day per occupied bed in the Psychiatric Hospital and 6 trips per day per occupied bed in the Residential Treatment Center. Ordinance 2251 specified 20 trips per day per occupied bed for hospitals with no distinction as to type of hospital. For the Psychiatric Hospital expansion of 27 beds this ratio would result in fees of $62,399.70. The fees which were collected on the basis of the SANDAG generation factors amounted to $ 113,454. A refund of $51,054.30 is therefore i ndi cated and proposed. The vol ume of tri ps generated by thi s use accordi ng to the SANDAG factors seemed obviously high. Because we were not in possession of information indicating a more appropriate factor, staff agreed with Vista Hill that a specific study should be used to determine the .Development Impact Fees for this use. Page 2, Item 12 ~ Meeting Date 9/20/88 The Engineering Division has reviewed the submitted study and concurs in its conclusions. On the basis of the information contained therein we anticipate that we will collect additional Development Impact Fees of $37,818 in conjunction with the 30 bed Residential Center expansion and $44,121 in conjunction with their 35 bed Chemical Dependency Center. FISCAL IMPACT: The Development Impact Fees received from the initial Vista Hills expansion project is $113,454. These fees were placed into the overall Development Impact Fee Fund for the provision of transportation facilities in the eastern portion of the City. Vista Hills Hospital would receive an immediate refund of $51,059.30 from this fund.
