COUNCIL AGENDA STATEMENT I tern 13 Meeting Date 9/6/88 ITEM TITLE: Resolution !3?7?--APproving Change Order No.1 for the construction 0 central basin drainage channel east and west of Fi fth Avenue between F and G Streets in the City of Chul a Vista and authorizing the Director of Public Works to execute SUBMITTED BY: Director of Publ ic Work~ ~ REVIEWED BY: City t~anager if (4/5ths Vote: Yes_No~J On June 14, 1988, the City Council, by Resolution 13609, awarded a contract in the amount of $218,184.73 to Commercial Contractors, Inc. for the construction of an open rei nforced concrete 1 i ned rectangul ar channel east and west of Fifth Avenue between F and G Streets in the City. Subsequent to the award, the owners of two parcels whose property the channel crosses have requested that the open channel be covered at their expense. A contract change order has been negotiated with the contractor that will accomplish this work at an equitable cost. ~COMMENDATION: That Council adopt the resolution approving the change order and authorizing the Director of Public Works to execute it on behalf of the City. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Commerci al Contractors, Inc. was awarded the contract to construct an open rectangular concrete lined channel east and west of Fifth Avenue and between F and G Streets. The owners of property located at 338 Fifth Avenue (west of Fifth Avenue) and 482 Center Street (east of Fifth Avenue) requested that the channel be covered to allow the development of their respective properties. They agreed to cover the cost for this extra work. Engineering staff contacted the contractor to ascertain the feasibility of covering the channel as requested by these owners. It should be noted that the original bid contained an alternative for the construction of a covered channel throughout the project reach. This alternative exceeded the cost of an open channel by $32,987.87 and the funds budgeted for the project. The benefit/cost did not justify the City spending an additional $33,000 to cover the channel. . the City Council of Chula Vista, C,.;iifornia Dated ;; t, I j I .:-.~~.. . The contractor after negotiations with City staff, agreed to cover the channel across 338 Fifth Avenue (owned by Mr. J. E. Whittingham) for a total cost of $10,239.49 and to cover the channel across 482 Center Street (owned by Davi d B. Stanley) for a total cost of $11,276.80. Each property owner was given the opportunity to review the proposal and both have deposited monies with the City for their respective share of the costs. We, therefore, recommended that the City Council adopt the resolution approving the change order to accomplish the covering of the open channel across these two parcels. FISCAL IMPACT: This change order will increase the contract amount by $21,516.29. Funds to cover this amount have been deposited by the property owners requesting the change order as follows: J. E.
