San Diego Gas & Electric Company (SDG&E) has submitted a Coastal Development
Permit application for grading, pavement, and containment wall construction on
a 46,550 square foot area on the South Bay Power Plant site. This proposed
work woul d consti tute the site preparati on for the future constructi on of
wastewater tanks to repl ace the exi sti ng wastewater ponds. Improvements to
the existing wastewater ponds or installation of wastewater tanks are being
~uired by the Regional Water Quality Control Board to remediate potential
erse environmental impacts. The project site is indicated on Exhibit A.

the CEQA guidelines.
RECOMMENDATION: That the City Counci 1 conduct a publ i c heari ng and adopt
the attached resolution:
1. Finding that the proposed site preparation for the future
constructi on of wastewater tanks is consi stent wi th the pol i ci es of
the certified Chu1a Vista Local Coastal Program; and
2. Issuing Coastal Development Permit #041 subject to the conditions in
Attachment A to the resolution.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Based on the following findings, the proposed site preparation for the future
construction of wastewater tanks is consistent with the policies of the
certified Chula Vista Local Coastal Program.
1.
The land use and zoning designations for the SDG&E property are
Industrial General. The use of a portion of a property as a site for
wastewater tanks is consistent with the provision in Section 19.82.35
for all owi ng "other accessory uses and bui 1 di ngs customari ly
appurtenant to a permitted (industrial) use".

Condition of Approval #1 prohibits grading for site preparation
between November 1 and April 1 consistent with Section 19.87.08,
Grading and Drainage, of the Bayfront Specific Plan.
The project site is owned by a public utility company which has a
need for restricted access, therefore, the opportunity for publ ic
access to the bay from this site for recreational use is restricted
and not inconsistent with the public access policies of the certified
LCP.

4. Statewide and regional interpretive guidelines have been reviewed and
the proposed project has been found to be in conformance wi th the
public access and public recreational policies of Chapter 3 of the
Public Resources Code.
