1. PUBLIC HEARING PCS-83-3 - CONSIDERATION OF TENTATIVE SUBDIVISION MAP
FOR HUDSON VALLEY ESTATES NO. 2, CHULA VISTA TRACT
83-3 - SUE HUDSON
Principal Planner Lee informed the Commission that this is a resuhmittal of a
tentative subdivision map which expired in 1981 and comprises the division of
a 2-1/2 acre parcel into 9 lots. The site is located on the west side of the
extension of Las Flores Drive approximately 1,250 feet north of "D" Street.
As a portion of the property lies within the lO0-year flood level of the
Sweetwater River flood plain, it is planned to raise those lots a minimum of
1 foot above the flood level by use of fill material. It is also planned to
elevate Las Flores Drive to adhere to the stipulations in Negative Declaration
IS-79-8. To eliminate resultant drainage problems to the adjoining
properties, the developer intends to fill not only the project site hut the
abutting areas which are presently subject to inundation.
In response to a Question by Commissioner O'Neill, Senior Civil Engineer
Daoust replied that conditions added since the 1979 submittal of this
tentative map dealt basically with offsite rights-of-way or easements covered
by the Subdivision Map Act which requires the City to ensure that any needed
offsite rights-of-way for which acquisition through negotiation fails become
subject to condemnation procedures.
In reply to her ouestion, Commissioner Johnson was informed that the
Residential Construction Tax fee did not include the school fee to each
district which, based on a sliding scale, amounted to approximately $300 per
single family dwelling.

The effect of the Sweetwater Flood Control project on the lO0-year flood
elevation in this area and the possibility of flooding of garage conversions
in the lower lots was raised by Commissioner G. Johnson. Mr. Lee pointed out
that a condition prohibiting any conversion of garages as a habitable area
(since they would be subject to inundation) could be added.
In reply to Commissioner Cannon's Query about the parcel being subject to the
Hillside Ordinance and the City's liability for flooding of the property as a
result of the Planning Commission's approval of a project involving sites
lying within the lO0-year flood plain, Assistant City Attorney Harron
indicated that the City would not be liable and Principal Planner Lee noted
that the area was not subject to the hillside district regulations.
Commissioner Cannon was also informed that under the present R-1 zoning, the
Municipal Code has no provisions for saving the trees on the property.
This being the time and the place as advertised, Chairman Johnson opened the
public hearing.
Linda Navarro, 9 Second Avenue, expressed concern about the possible lot size
in contrast to property sites already located in the area. She was assured
that the minimum lot size was 7,000 square feet. The increase in the number
of lots resulted from the creation of the pan handle lot provision which
allows utilization of the rear areas.
Timothy Connor, 4706 East Mountain View Drive, San Diego, identified himself
as the attorney for the applicant and declared his willingness to answer any
Questions. He stated he had no objections to any of the conditions.
There being no other speakers, the public hearing was closed.
MSUC (O'Neill/Cannon) to find that this project will have no significant
environmental impacts and readopt the Negative Declaration issued on IS-79-58.
MSUC (O'Neill/Shipe) that based on the findings contained in Section "E" of
the staff report to recommend that the City Council approve the tentative
subdivision map for Hudson Valley Estates No. 2, Chula Vista Tract 83-3,
subject to the conditions contained in the staff report with the additional
condition that garage conversions for use as a habitable area for those lots
which are within the lO0-year flood plain (Lots 4, 5, 6 and 7) be prohibited.

MUNICIPAL CODE RELATING TO THE DEFINITION OF "FAMILY"

This item was continued from the Planning Commission meeting of March 9, 1983
to allow the City Attorney to prepare a revision to the proposed amendment of
the definition of "family" which would prevent or control uses such as
fraternities and transient types of activities from locating in single-family
residential zones.

The Commission studied the three alternatives presented by the City Attorney's
office and discussed 1) the need for a definition of family, boardinghouse and
lodging house and 2) the advisability of retaining the Court's language.
This being the time and the place as advertised, the public hearing was
opened. No one wishing to speak, the public hearing was closed.
MSUC (G. Johnson/O'Neill) to recommend that the City Council enact an
ordinance amending the Municipal Code by amending Section 19.04.032 as shown
in the staff report.
MS (G. Johnson/Pressutti) to recommend that the City Council enact an
ordinance amending the Municipal Code by amending Section 19.04.092 as shown
in the staff report.
The motion failed hy the following vote:
AYES: Commissioners G. Johnson, Pressutti, Shipe
NOES: Commissioners R. Johnson, O'Neill, Cannon
ABSENT: Commissioner Green
MSC (O'Neill/C~'mnon) to recommend that the City Council enact an ordinance
amending the Municipal Code by repealing Section 19.04.092.
The motion carried by the following vote:
AYES: Commissioners Shipe, R. Johnson, O'Neill, Cannon
NOES: Commissioners G. Johnson, Pressutti
ABSENT: Commissioner Green
MSUC (G. Johnson/O'Neill) to recommend that the City Council enact an
ordinance amending the Municipal Code by repealing Section 19.04.105, amending
Section 19.04.112, revising Section 19.28.040, and repealing Section 19.58.172
as shown in the staff report.
DIRECTOR'S REPORT:
Principal Planner Lee
- asked if the Commission wished to cancel the meeting of
May ll, 1983 as there were no items to be considered. The
Commission agreed.
- stated that at this time there was only one item scheduled
for the meeting of May 25, 1983 and suggested that the
meeting be held at 5:00 instead of 7:00. The Commission
agreed and stated they were in favor of having meetings
containing a short agenda held at the earlier hour of 5:00.
- stated there would be a dinner workshop on May 18, 1983 but
the agenda was not yet decided.

Planning Director Gray
informed the Commission of the approval by the Coastal
Commission of the Sweetwater Flood Control project.
reported that both EastLake and the Gersten project were
moving ahead.
COMMISSION COMMENTS
Commissioner O'Neill asked about the status of the planning Director's
appointment. Director Gray said he had discussed this with the Manager but
the decision was not imminent at this point and he (Bud Gray) will be here
longer than anticipated.
ADJOURNMENT AT 5:50 p.m. to the Workshop Meeting of May 18, 1983 in Conference
Room 3 at 5:00 p.m., and to the Regular Business Meeting of May 25, 1983, at
5:00 p.m., in the Council Chambers.
