On August 10, 1982, by Resolution 10973, the City Council approved the
Tentative Subdi vi si on Map for Chul a Vi sta Tract 82-8, Mi ssi on Verde
Subdivision. The Final Map for said subdivision and associated items are now
before Council for approval. This subdivision is located at the intersection
of East "J" Street and Paseo Ranchero.
RECOMMENDATION: That Council adopt resolutions a through d listed in the
item title of this report.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Chula Vista Tract 82-8, Mission Verde consists of six lots for 76 condominiums
and one lettered lot (not a building site). The final map for said
subdivision has been reviewed by the Public Works Department and found to be
in conformance with the approved Tentative Map. Approval of the map
constitutes acceptance of all sewer, general utility, and tree planting
easements within the subdivision and acceptance of the Paseo Ranchero right-
of-way on behalf of the public.

The developer has executed a subdivision improvement agreement in conjunction
with the Final Map and has provided bonds to guarantee construction of the
required improvements.
The developer has complied with all applicable conditions of approval. Among
the conditions of approval was the requirement that the developer enter into
an agreement by whi ch the developer agrees to indemnify the City agai nst
cl aims resulting from erosi on, sil tati on and/or increased flow of drai nage
ari si ng out of the development of subject property. The developer was al so
required to enter into an agreement by which the developer agrees to
participate in a district providing for the construction of Paseo Ranchero.
The developer has executed two agreements that comply wi th both of these
requirements. The agreements are now before Council for approval.

The agreement to participate in the construction of Paseo Ranchero (Resolution
c) contains a provision that acknowledges that the developer is constructing a
portion of Paseo Ranchero and will be eligible for credit for these
improvements if a reimbursement district is formed. Until such a district is
formed, it is not possible to determine what the developer's complete
obligation is regarding the construction of Paseo Ranchero, but the other
property owners (developers) that would be involved in the district have
indicated that they feel that the improvements being installed exceed this
development's obligation. The developer is eligible to seek reimbursement for
the amount of improvements that are determi ned to exceed thi s development I s
obligation.
The developer has acquired an easement for drainage purposes as required for
deve 1 opment of subj ect property. Sa i d document is now before Counc i 1 for
acceptance.
The City has recently received letters from the Chula Vista City School
District and the Sweetwater Union High School District (attached). Both
districts recommend formation of Mello-Roos districts, stating that developer
fees mandated by State law will be inadequate. The developer has been
informed that he must resolve this issue prior to issuance of any building
permits for this project.
A plat is available for Council viewing.
