Flaugher, the Redevelopment Agency requested staff review current City policies to determine whether the use by Rev. Flaugher was prohibited and if not, return to Council with the proposed policy which would prevent future abuses. This ordinance redefines the City seal consistent with its 1985 design, adds a prohibition relating to the City logo and for malicious use to the existing prohibition against use of the City seal for commercial purposes, and makes it consistent with State law relating to misuse of the seal of the State of California. DISCUSSION: Although the Mobilehomes Issues Committee is not an official board or commission of the City created by the City Council, staff of the Community Development Department provide some support to the Committee because of the public purpose performed by the Committee's review of mobilehome issues relating to the community. As part of that support, Communi ty Development staff promulgates notices of meetings for the Mobilehome Issues Committee on City letterhead, which contains the official logo of the City. Although the meetings of the Committee are not officially sanctioned by the City, the expenditure of funds and distribution of such notices is a lawful expenditure of pUblic funds for public purpose. Cliff Roland, Chairperson of the Mobilehomes Issues Committee, complained to the members of the Agency at its meeting of May 19, 1988, that the handwritten notations, which added to the meeting notice, and were then xeroxed and widely distributed by Rev. Flaugher, constituted an improper use of the City logo. The Agency requested staff review the current City policies to determine whether the alleged use was prohibi ted, and if not, to return to the City Council with a proposed policy which would prevent future abuses. Section 475 of the State Penal Code defines forgery to include the forging or _counterfeiting of any public seal authorized or recognized by the laws of this ate with the intent to defraud another.
