In accordance with the terms of the agreement, the City and County are to share in the total cost of the project on a 50/50 basis. The current agreement limits the City's cost to a maximum of $300,000. A payment of $300,000 has been made to the County. At the time that the agreement was approved the total project cost was estimated at $500,000. The latest figures provided to staff by the County estimate the total project cost at $950,000. The estimated cost of $950,000 for the project was determined as follows: Preliminary and Design Engineering $ 54,200 Right of Way 237,000 Utilities Relocation 50,300 Construction Costs 498,300 Contingency (l0$) 49,700 Construction Engineering 50,000 Total 5950,000 City's Share of Project Cost $475,000 KJG:nr AX-049 EXHIBITS (continued on su lemen al a e Agreement x Resolution x Ordinance_ Plat_ Notification List_ Other ENVIRONMENTAL DOCUMENT: Attached Submitted on FINANCIAL IMPACT The City will accept and assume the maintenance of those improvements constructed within Orange Avenue and Second Avenue lying within the Chula Vista City limits. STAFF RECOMMENDATION Please see Supplemental Page Pour BOARD/COMMISSION RECOMMENDATION COUNCIL ACTION "1~~~ Agenda Item No. For Meeting of 11/20/79 Supplemental Page Two The County has prepared a first amendment to the agreement between the City and the County whereby the maximum expenditure of $300,000 is increased to $475,000. This increase of $175,000 in the City's share of the cost affects Section ii and Section 10 of the original agreement. For FY79-PO the City Council appropriated an additional sum of $94,400 for the Orange Avenue Project in anticipation of the cost increase. Funds were appropriated in the following projects: GT --? ~ Block Grant 48 Revenue Sharing 03 Residential Construction OS $103,000 $147_,000 5103,100 $ 94,400 A payment of 5300,000 has been made to the County in accordance with the agreement. There is an unencumbered balance from the aforementioned projects of $142,4fl4.1C (RS- 03, $48,084.10; and RC-O5, 594,400). Additional funds in the amount of $32,515.90 need to be transferred into the Orange Avenue Project for the City to meet its additional obligation of $175,000 as contained in the first amendment to the agreement between the City and the County. Engineering staff proposes that this sum of $32,515.90 be transferred into the Orange Avenue Project from the following two Gas Tax Projects: Second Avenue Construction - Orange Avenue to San Diego Gas & Electric Company Easement - GT-i03C80 S ?.2,000.00 Third Avenue Widening - "G" to "I" Street - GT-84 $ 10,515.90 The construction of Second Avenue has been incorporated into the Orange Avenue Project. The County found out in the design of Orange Avenue that they had to do considerable work to Second Avenue to get it to connect to Orange Avenue. A substantial portion of the work which was to be constructed in the Second Avenue Project in fact is going to be done with the Orange Avenue Project. Engineering staff is recommending that the County initiate a Change Order adding to the Orange Avenue contract the construction of curb, gutter, and sidewalk in Second Avenue which is within the scope of the project approved by the City Council. This work in Second Avenue will increase the Orange Avenue contract approximately S4,500. A total of $l.2 million dollars has been appropriated for ~~ 5~ Agenda Item No. For Meeting of 11/20/79 Supplemental Page Three the Third Avenue Widening Project. This is a Federal Aid Urban financed project. Staff expects to advertise the Third Avenue Widening Project for bid in March of 1980. There are indications that the City may obtain 100 financing for the construction of Third Avenue from FAU and state funds. It is for this reason that the staff is recommending that funds be transferred from the Third Avenue Project to the Orange Avenue Project. City Council approve the first amendment to County Contract No. 13725-5750 R Agreement between the City of Chula Vista and the County of San Diego for the Improvement of Orange Avenue. 2. The City Council authorize the transfer of funds in the amount of 52,000 from Project GT-103030 Second Avenue to Project GT-7~ Orange Avenue and the transfer of funds in the amount of $10,515.90 from Project GT-34 Third Avenue tnlidening to Project GT-77 Orange Avenue and authorize the expenditure of the funds transferred for the construction of Orange Avenue and Second Avenue. 3. Certificate No. 46 ~ty~~~ FIRST Ab1ENDMENT TO COUNTY CONTRACT 113725-5750 R AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE COUNTY OF SAN DIEGO FOR THE IMPROVEMENT OF ORANGE AVENUE THIS FIRST AIdENDh1ENT entered into in accordance with Section 15 of the original agreement this 20th day of November 1979 by and between the City of Chula Vista, California, a municipal corporation, hereinafter called "City", and the County of San Diego, apolitical subdivision of the State of California, hereinafter called "County". WITNESSETH: IYHEREAS, on January 2, 1979, City and County entered into an agreement to improve Orange Avenue from Third Avenue to Albany Avenue a distance of approximately 0.5 mile hereinafter referred to as "Project"; and WHEREAS, the Terms of this original agreement bound City and County to a maximum expenditure of $300,000 each on "Project"; and PIHERE.4S, it is the desire of City and County to modify the maximum expenditure provisions incorporated in this agreement in order to award the Project contract; and NO{Y THEREFORE, IT IS MUTUALLY AGREED by and between City and County as follows: 1. Section 8 of said agreement is amended to read as follows: "Maximum Expenditures. This agreement shall bind County to a maximum expenditure of $475,000 in CDBG funds and City to a maximum expenditure of $475,000. 2. Section 10 of said agreement is amended to read as follows: "Payment of Costs by City. City shall deposit with County, within 30 days of receipt of invoice, City's share of Project costs. Such invoice shall not exceed 500 of total estimated Project costs, or $475,000, as of the date of invoice. After completion of Project, total Project costs shall be calculated. a. In the event City's actual share of total Project costs is less than said deposit, County will refund the difference between City's actual share and the amount of the f ^ deposit by City. f /I b. In the event City's actual share of total (~ Project costs exceeds said deposit, City will pay the difference, between the amount of said deposit and City's actual share R-9857 of the costs, not to exceed a total payment by City of $475,000. ~.
