The site is located on the north side of Anita Street between Fourth Avenue and Fresno Street. The property contains approximately 8.6 acres. The subject rights of way were dedicated on Map No. 1335, recorded with the County of San Diego on May 17, 1911. The subject portion of Fresno Avenue was named "Merry Lane" on the map and subsequently changed. (Date is unknown, as it was done by the County.) The original subdivision contained 30 lots abutting two 15-foot-wide alleys. In 1960, the lots were consolidated by the owner to facilitate the placement of mobile homes on the property. The County did not vacate the public alleys at that time. In addition, the Fresno Street right of way has never been used as a traveled way. It is bordered on the east by a strip of land approximately 25 feet wide, formerly owned by S.D.& A.E. Railroad. This land, however, is now under the same ownership as the mobile home park. . b the City Council of Chula Vista, CDlifornia Dated ") /? /if'" Page 2 Item 15 Meeting date 7/26/88 4Itccording to the California Streets and Highways Code (Chapter 4, Article 1, Subsection 8331), the Council may vacate a street if: a. The street has been impassable for a period of five consecutive years and; b. that no public money has been spent to maintain the right of way during that time. Both of these facts exist regarding the alleys and the street. It is the opinion of staff that the rights of way are not needed nor will they be needed in the future. The alleys and the street were dedicated on the map for public use and not granted in fee. If Council approves the resolution of vacation, the land will revert to the owner of the mobile home park. All the utility companies have been contacted for their comments, as has the Planning Department. There are no objections from any of them regarding the proposed vacation.
