RESOLUTION NO. 9895
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ACCEPTING NEGOTIATED PROPERTY TAX EXCHANGE
RELATING TO JURISDICTIONAL CHANGES
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Section 99 (b) of Chapter 282 of the California
Statutes of 1979 requires the negotiation of any exchange of pro-
perty tax revenues occasioned by jurisdictional changes between
the areas affected, and
WHEREAS, under such circumstances the Board of Supervisors
is authorized to negotiate such property tax revenue exchanges on
behalf of the County and special districts, and
WHEREAS, the City Council of the City of Chula Vista is
authorized and required to approve such negotiated property tax
revenue exchanges, and
WHEREAS, the attached negotiated property tax exchange
between the County of San Diego and the City of Chula Vista as
that property tax exchange pertains to the ADMA reorganization
has been negotiated,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that the property tax exchange that has
been negotiated in regard to that certain reorganization known as
the ADP-~IA Company, Inc. Reorganization as attachment 4 of the reso-
lution of San Diego County also approving said property tax exchange
be, and the same is hereby approved.
BE IT FURTHER RESOLVED that in the event a new formula
for distribution of property tax exchanges is arrived at between
the County and the City, such new formula shall apply retroactively
to attachment 4 of the resolution of the County of San Diego for
that annexation known as ADMA Company, Inc. Reorganization, and
the property tax exchange shall be appropriately adjusted,
BE IT FURTHER RESOLVED that in the event state law is
amended to provide for a distribution formula for property tax
exchanges resulting from jurisdictional changes under Revenue and
Taxation Code Section 99(b), this resolution shall thereafter be
subject to such distribution formula with respect to attachment 4
of the resolution of San Diego County for that annexation known as
the ADMA Company, Inc. Reorganization.
BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby, authorized and directed to forward a certified copy of this
resolution to the County Board of Supervisors and to the Auditor
of San Diego County.
