HomeMy WebLinkAboutReso 1979-98875~7z Approved as to form by Form No. 342 Rev. 2/76 RESOLUTION NO. 9887 RESOLUTION OF THE CITY COUNCIL OF'3'HE"CTTY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND L & L DEVELOPMENT COt4PANY TO PARTICIPATE IN ANY REIMBURSEMENT, IMPROVEMENT OR FEE DISTRICT AS A CONDITION OF APPROVAL OF FINAL MAP OF CHULA VISTA TRACT N0. 78-2 AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and L & L DEVELOPMENT COMPANY, to participate in any reimbursement, improvement or fee district in the E1 Rancho del Rey area as a condition of approval to the final map of Chula Vista Tract No. 78-2 - Bonita Haciendas dated the 11th day of December 1979 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to record this resolution in the office of the County Recorder of San Diego County. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. DEVELOPM~1dT COMPANY REQUIRIPdG L & L DEVELOPi~1ENT TO PARTICIPATE IP] ANY REIMBURSEMENT, IMPROVEP9ENT OR FEE DISTRICT ESTABLISHED IN THE EL RANCHO DEL REY AREA AS A CONDITION OF APPROVAL TO THE FINAL MAF OF THAT CERTAIN SUBDIVISION KNOWN AS CHULA VISTA TRACT N0, 78-2 - BONITA HACIENDAS THIS AGREEMENT, made and entered into this 11th day of December 1979, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City", and L S• i~ DEVELOPMENT COMPANY, 591 Camino de la Reina, Suite 510, Safe Diego, California 92108, hereinafter called "Subdivider"; W T T N E S S E T H WHEREAS, L & L Development Company heretofore submitted a tentative map for that certain subdivision knoian as Chula Vista Tract 170. 78-2 - Bonita Haciendas, approved on June 6, 1978 by Resolution No. 9119, and WHEREAS, as a condition of said approval, Subdivider agreed to assume and pay their fair and proportionate share of the responsibility for the financing and installation of the basic infrastructure of E1 Rancho del Rey including all major thoroughfares and public works facilities, and YTHEREAS, the City has tentatively estimated that such proportionate share would be an amount not to exceed $1500 per unit in said subdivision. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Subdivider agrees to pay an amount not to exceed $1500 per unit of said subdivision concurrent with the issuance of building permits. 2. If and in the event that at such time as building permits are requested, City has finalized the assessment for the construction of said improvements, Subdivider shall pay the amount requested not to exceed $1500 per unit, and if the City should be unable to provide a finalized estimated cost of said share of the improvements at the time of the issuance of the building permits, the estimate prepared by City staff shall be accepted by the Subdivider. The Subdivider shall pay that estimate or $1500 per dwelling unit whichever is the lesser amount. IN WITNESS WHEREOF, the parties hereto have caused this agree- ment to be executed the day and year first hereinabove set forth.
