RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ADOPTING COUNCIL POLICY FOR SELECTION OF
CONSULTANTS
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that that certain Policy for the Selection of Con-
sultants, attached hereto as Exhibit I and incorporated herein by
reference as if set forth in full, be, and the same is hereby adopted.

Council Policy for the Selection of Consultants
BACKGROUND
From time to time the City requires the service of consultants
to undertake work beyond the scope of the City to perform.
While the City's most frequent need is for architectural and
engineering consulting services, the services of management,
planning, or multi-disciplinary, consulting firms are occasionally
required. In addition, a recent change in the Government Code,
.F34525 et seq. requires that the City adopt a resolution a
standardized set of proceudres for the hiring of A/E consultants.
PURPOSE
The purpose of this policy is to provide uniform procedures for
seeking and retaining the services of professional consultants
in conformance with the Government code, §4525 et seq.
POLICY
It shall be the policy of the City of Chula Vista to negotiate
all contracts for consulting services on the basis of demonstrated
competence and professional qualifications for the services
required, and at fair and reasonable fees. Further, that the
City shall publicly announce all requirements for consulting
services and shall adopt procedures to assure maximum participation
of small business firms.
This policy shall not apply to:
1. Consulting services which are determined to be more technical
in nature and involving little professional judgment.
2. Consulting services for the preparation of applications for
Environment Impact Reports. Selection of Environmental
review consultants will be as directed by the City's
Environmental Review Policy.
PROCEDURE
Implementation of the stated policy shall be as follows:
A. Determination of Applicability
1. The responsible department head will determine if the
required consulting service is exempt from this
procedure.
2. If exempt as a technical service, the normal bidding
process shall be used.

3. If exempt as an environmental review, the process
directed by the City's Environmental Review Policy
shall be utilized.
B. Registration and Notice
1. Public announcement of all projects requiring the
services of architectural, engineering, planning,
management, and/or multi-disciplinary firms shall be
made by the City through notice to the respective
professional societies and by publication in a newspaper
of general circulation. The notice shall invite
consultants to submit letters of interest for specific
projects.
2. In addition, said notice shall encourage consulting
firms to submit statements of qualifications and
performance data annually for registration and
reference purposes.
3. Statements of qualifications and letters of interest
shall be filed.
C. Selection
1. For projects where fees are estimated to be less than
$10,000, the responsible department head and one or more
staff members shall perform the duties of the Selection
Committee. If fees are estimated to be $10,000 or more,
the City i4anager shall appoint a three or five member
Selection Committee. When the Council determines it is
appropriate, the Mayor will appoint the Selection
Committee.
2. Concurrently, with the initiation of each proposed
project, the Selection Committee shall review all firms
currently registered and on file with the City to
determine those firms best qualified for the services
desired.
3. The Selection Committee shall choose a minimum of three
interested firms for personal interviews to discuss
anticipated concepts and the relative utility of
alternative methods of approach for furnishing the
required services. The Selection Committee shall
evaluate and rank the firms based upon criteria
established in advance by the City. A list containing
the ranking information will be sent to the responsible
department head.
4. The responsible department head shall negotiate a contract
with the firm ranked no. 1 by the Selection Committee at
a price determined to be fair and reasonable to the City.
The agreement shall define the conditions of the contract
scope, work plan and schedule, personnel costs, fee and

5. Should the department head be unable to negotiate a
satisfactory contract with the first ranked firm,
negotiations shall be formally terminated.
6. The department head shall then undertake negotiations
with the second ranked firm. This process shall continue
until a satisfactory contract is negotiated.
7. If the list of qualified firms is exhausted without a
contract being negotiated, the Selection Committee shall
choose additional firms and the process shall continue
until a satisfactory contract is negotiated.
D. Award of Contract
1. All awards for consulting contracts pursuant to this
policy shall be made in accordance with the City Charter.
