HomeMy WebLinkAboutReso 1979-9862RESOLUTION N0. 9862 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE "McCANN-GREENWOOD PLACE REORGANIZATION" INVOLVING ANNEXATION TO THE CITY OF CHULA VISTA AND DETACHMENT FROM THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT ZONE 3 The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declaration, IS-80-4 and the findings therein, the proposed "McGann-Greenwood Place Reorganization" will not have a significant impact upon the environment, and the City Council hereby certifies that the Nega- tive Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 5600 of the Government Code, the City of Chula Vista received from Dennis B. McCann an application pro- posing a reorganization consisting of the following changes of organization: 1. Annexation of territory to the City of Chula Vista as shown on Exhibit B and more particularly described on Exhibit A. 2. Detachment of territory described in Exhibit A from the San Diego County Flood Control District, Zone 3. WHEREAS, the City approved the boundaries of said McCann-Greenwood Place Reorganization and the staff filed the proposed reorganization with LAFCO, which by resolution dated November 5, 1979, in compliance with Government Code Section 56430 et seq., approved said reorganization without notice and hearing and without an election on the detachment of the territory from the San Diego County Flood Control District, Zone 3. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds and determines and orders as provided in Government Code Section 56430 et seq, as follows: 1. The territory proposed for reorganization (herein- after referred ~ as the Territory) is as desciibed in Exhibit A attached hereto. 2. The description of the boundaries of the Territory conforms to lines of assessment and ownership. 3. The Council does hereby approve the proposed re- organization consisting of annexation of territory described in Exhibit A to the City of Chula Vista and detachment of territory described in Exhibit A from the San Diego County Flood Control District, Zone 3. 4. Pursuant to Government Code Section 56430 et seq. and the resolution of LAFCO, the City of Chula Vista does hereby order said reorganization without notice and hearing and without an election. -1- 5. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to transmit a certified copy of this resolution in accordance with Section 56450 et seq. of the Government Code. PROJECT SETTING THE PROPOSED PROJECT INVOLVES 1.15 ACRES OF VACANT PROPERTY LOCATED EAST OF THE NORTHERN TERMINUS OF GREENWOOD PLACE. THIS PARCEL IS LOCATED WITHIN THE COUNTY OF SAN DIEGO AND IS CONTIGUOUS WITH THE CITY OF CHULA VISTA BOUNDARY. THE SITE IS IN A NATURAL STATE WITH AN AVERAGE NATURAL SLOPE OF 36°, DOWNWARD FROM GREEN4100D PLACE TO THE FLOOR OF LONG CANYON. ADJACENT LAND USES INCLUDE SINGLE FAMILY DWELLINGS AND DEDICATED NATURAL OPEN SPACE, A NUMBER OF SINGLE FAMILY HOMES ARE LOCATED TO THE EAST WITHIN LONG CANYON AND SEVERAL HOMES, ON LARGE LOTS C.5 ACRES ARE LOCATED TO THE SOUTHEAST ALONG THE CANYON WALL. NATURAL OPEN SPACE CBONITA RIDGE ESTATES OPEN SPACE LOTS #14~ 6 219 IS ADJACENT TO THE NORTHWEST AND SOUTHWEST. DUE TO THE NATURAL STATE OF THE PROJECT SITE AND ADJACENT AREAS, WILDLIFE IS PRESUMED PRESENT, HOWEVER, ACCORDING TO EIR-73-17 (BONITA RIDGE ESTATE'S, NO RARE OR ENDANGERED SPECIES HAVE BEEN IDENTIFIED IN THE IMMEDIATE AREA OF THE PROJECT. THE SUBJECT PROPERTY WAS INCLUDED IN AN ARCHAEOLOGICAL SU^VEY PpEpARED FOR THE ADJACENT BONITA RIDGE ESTATES SUBDIVISION. NO SIGNIFICANT RESOURCES WERE FOUND TO BE PRESENT. BASED ON A SOILS INVESTIGATION PREPARED FOR BONITA RIDGE ESTATES, OTAY FORMATION SOILS MAY BE PRESENT ON SITE. SOILS ASSOCIATED WITH THIS FORMATION ARE EXPANSIVE IN NATURE AND INCLUDE LAYERS OF BENTONITE CLAY. THE OTAY FORMATION IS ALSO PRONE TO LANDSLIDING, PARTICULARLY ON OVER STEPPENED HILLSIDES. THE CLOSEST VERIFIED EAP,THQUAKE FAULT IS LOCATED APPROXIMATELY 24)~pJ FT. TO THE SOUTHEAST. THIS FAULT TRACE IS ASSOCIATED WITH THE LA NACION FAULT ZONE WHICH IS CONSIDERED POTENTIALLY ACTIVE/LOW POTENTIAL. B. PROJECT DESCRIPTION THE APPLICANT PROPOSES TO ANNEX THE SUBJECT PROPERTY INTO THE CITY OF CHULA VTSTA AND SUBDIVIDE THE PARCEL INTO T4J0 INDIVIDUAL LOTS FOR THE PURPOSE OF CONSTRUCTING TWO SINGLE FAMILY DWELLINGS. EACH LOT ~~ COMMUNITY INFRASTRUCTURE 1~ THE APPLICANT PROPOSES TO CONSTRUCT AN CITY FIRE EQUIPMENT CANNOT NEGOTIATE A ENSURE FIRE SAFETY, THE PROPOSED ACCES VARY THE DEGREE OF GRADE IN ACCORDANCE SCHOOLS ACCESS DRIVE WITH A 2I1~ GRADE GRADE GREATER THAN 160. TO S DRIVE SHALL BE DESIGNED TO WITH CITY STANDARD DRAWINGS. BASED ON SPRING ENROLLMENT DATA, THE LOCAL ELEMEfdTARY AND JUNIOR HIGH SCHOOLS ARE EXPECTED TO BE OPERATING AT OR IN EXCESS OF CAPACITY. TO ENSURE THAT ADEQUATE EDUCATIONAL FACILITIES ARE AVAILABLE TO NEW STUDENTS GENERATED BY THE PROJECT AND THAT NO SUBSTANTIAL IMPACT ON SCHOOLS RESULTS FROM PROJECT IMPLEMENTATION, SUBMISSION OF WRITTEN ASSURANCE OF CLASSROOM SPACE FROM THE APPROPRIATE SCHOOL DISTRICTS WILL BE REQUIRED. E. MITIGATION NECESSARY TO AVOID SIGNIFICANT IMPACT 1. A SOILS REPORT SHALL BE PREPARED AND SHALL INCLUDE DISCUSSION RELATIVE TO LANDSLIDE POTENTIAL. 2. GRADING AND SUBSEQUENT STABILIZATION SHALL BE CONDUCTED IN A MANNER THAT WILL MINIMIZE SILTATION AND EROSION. 3. PLANS FOR SLOPE PLANTING SHALL BE SUBJECT TO THE CITY'S LANDSCAPE ARCHITECT APPROVAL. ~ 4. ACCESS DESIGN SHALL BE APPROVED BY THE CITY FIRE DEPARTMENT. 5. WRITTEN ASSURANCE OF AVAILABLE CLASSROOM SPACE SHALL BE OBTAINED FROM APPROPRIATE SCHOOL DISTRICTS. F. FINDINGS OF INSIGNIFICANT IMPACT 1. PROJECT IMPLEMENTATION WILL REDUCE THE TOTAL AMOUNT OF NATURAL HABITAT CURRENTLY AVAILABLE TO WILDLIFE, HOWEVER, DUE TO THE LIMITED SCALE OF THE PROPOSAL, NO SUBSTANTIAL IMPACT WILL RESULT. THERE HAVE NOT BEEN ANY RARE OR ENDANGERED SPECIES IDENTIFIED ON-SITE. AN ARCHAEOLOGICAL SURVEY OF THE VICINITY CONCLUDED THAT THERE ARE NO SIGNIFICANT ARCHAEOLOGICAL RESOURCES PRESENT. THE CLOSEST KNOWN FAULT TRACE IS APPROXIMATELY .8 MILES SOUTHEAST OF THE SITE AND POSES NO UNUSUAL THREAT. ADVERSE SOIL CONDITIONS AND POTENTIAL FOR LANDSLIDING WILL BE DISCUSSED IN A REQUIRED SOILS REPORT. 2. THE PROJECT IS CONSISTENT WITH THE LAND USE ELEMENT OF THE GENERAL PLAN AND IS NOT ANTICIPATED TO ACHIEVE SHOP,T TERM TO THE DISADVANTAGE OF LONG TERM ENVIRONMENTAL GOALS. 3.
