HomeMy WebLinkAboutReso 1979-9859RESOLUTION N0. 9859 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DECLARING ITS INTENTION TO ESTABLISH AND LEVY AN INCREASED ADDITIONAL BUSINESS LICENSE TAX UPON THE AREA INCLUDED IN THE PARKING AND BUSINESS Ib1PROVEMENT AREA AND TO MODIFY THE BOUNDARIES OF SAID AREA FOR THE PURPOSE OF THE GENERAL PROMOTION OF RETAIL TRADE, AND FIXING THE TIME AND PLACE FOR A HEARING TO BE HELD TO CONSIDER THE ADJUSTMENT OF SAID ADDITIONAL BUSINESS LICENSE LEVY AND MODIFICATION OF THE BOUNDARIES OF SAID PARKING AND BUSINESS IMPROVE- MENT AREA, AND DIRECTING THE GIVING OF NOTICE OF SAID HEARING The City Council of the City of Chula Vista does hereby resolve as follows: 1. Authority. Pursuant to the authority granted in Sections 36,000 through 36,081 of the Streets and Highways Code; more specifically §§36,024 and 36,061, the City Council is authorized to make changes in the additional rate or levy upon the parking and business improvement area and to modify the boundaries of said area as enumerated hereinbelow. 2. Intention. The City Council hereby declares its intention to makes in the additional rate or levy of the business license tax as follows: Class A: Business of manufacturing; apartments; hotels - An assessment equal to two times the business license. Class B: All classes of vending machines; games; card rooms; bowling alleys; pool halls, pawn shops - An assessment equal to three times the business license. Class C: Bars serving beer only - An assessment equal to two times the business license. Class D: Public utilities, including gas, electric, telegraph, telephone, water and trash - An assessment equal to two times the business license. Class E: Attorneys; medical and dental doctors; real estate brokers, bookkeeping, accounting, auto sales, chiropractor; veterinarians; stock and bond brokers; engineers; savings and loan associations; loan agencies; construction companies; newsstands, answering services; coin dealers; all other professions licensed and regulated by the State of California and not specifically otherwise classified herein - An assessment equal to two times the business license. Class F: Automotive repairs and accessories; auto parts, service stations; bookstores; undertaking establishments; cleaners and cleaner's agents and agencies; laundromats and self-service laundries and cleaners; rental agents and agencies; refrigeration repair; rental leasing companies; shoe repair shops; theatres; barber and beauty shops and supply stores; cafes and restaurants, not serving hard liquor; donut stores; massage parlors; schools o£ instruction, training schools; equipment rentals; physical culture studios or gymnasium; luggage repair shops, travel agencies; tailors; interior decorators, sewing machine repair; printers; office machines - An assessment equal to two times the business license. -1- Class G: Grocery stores and supermarkets; bakery goods, meat markets; delicatessens, department stores, variety stores, surplus stores; ice cream stores; liquor stores; photo studios and photo supplies - An assessment equal to two times the business license. Class H: Clothing stores; shoe stores; appliance stores; furniture stores; jewelry stores; sporting goods stores; restaurants serving hard liquor; yarn shops, arts and crafts shops; florists; nurseries, garden shops; hardware stores; pet stores; plumbing supplies; electrical supplies; television stores; hearing aid stores; music stores; paint stores; sewing machine sales; yardage stores; trophies; pharmacies; bicycle stores, hobby shops; gift stores; carpet stores; all other business involving retail sales - An assessment equal to two times the business license. 3. Collection of Additional Taxes. The collection of the additional levy to the license tax proposed by virtue of this proceeding shall be made at the times set forth hereinabove and in the same manner as the ordinary business license tax of the City under the provisions of the Chula Vista Municipal Code, and such tax proposed to be imposed under this proceeding shall be computed in the manner provided in the Chula Vista Municipal Code for each business. 4. Alternatives to Said Proposed Changes in the Additional Rate or Levy. The City Council may at the time and place of the hearing as set forth in this resolution, consider alternatives to the proposed changes in the additional rate or levy as set forth hereinabove. 5. Modification of Boundaries of Downtown Business Improvement Area o e Ci y o C u a Vista - Description. The description of the boundaries of the modified Downtown Business Improvement Area of the City of Chula Vista are as set forth in Exhibit "A", attached hereto and by reference made a part hereof, but generally bounded by the North side of "D" Street, North side of "I" Street, East side of Del Mar, and the West side of Fourth Avenue. A map delineating said proposed boundaries is attached hereto, marked Exhibit "B", and delineated as the Town Center Redevelopment Project, and is incorporated herein by reference. 6. Alternatives to Said Pro osed Changes or Modifications in the Downtown Business Improvement Area of t e City of Chula Vista Boundaries. The City Council may at the time and place of the hearing as set forth in this resolution consider alternatives to the boundaries of the Downtown Business Improvement Area of the City of Chula Vista as such proposed changes are set forth hereinabove. 7. Time and Place of Hearing; Notice. Notice is hereby given that Tues ay, t e t day o December, 1979, at the hour of 7:00 p.m. in the Council Chambers of the City Hall, 276 Fourth Avenue, in the City o£ Chula Vista, is the time and place fixed for the hearing on this resolution of intention to establish additional business license tax. These amendments levy an additional business license tax on the businesses listed according to class. 8. Publication and Mailing of Notice. The City Clerk shall cause this resolution to be published at least once in the Chula Vista Star News, a newspaper of general circulation printed and published in said City. The City Clerk shall also mail a copy of this resolution to each business in the business improvement area. IN 1. .l. - J ~ .... .... .... -T ". .~ ' .._ __. z .... --- - .-~-..- DOWNTOWN ASSOCIATION of Chula Vista 2 3 3 F O U R T H A V E N U E C H L1 L A V I S T A, C A L I F p R N l A 9 2 p l^ T E L E P H C N E: 4 2 0- 6 6 C 2 November 26, 1979 An Open Letter to the Downtown Business Community: For many years, the Parking and Business Improvement District has operated essentially along the Third Avenue business area arranging promotional activities which we believe have been beneficial to the whole business community, Now, the Town Centre Business and Professional Association finds along with everyone else that the amount raised by the additional business tax levy, being approximately $7,000 per year, can no longer adequately finance a worthwhile program of promotional activities. This amount is far less than that expended in any of our shopping center complexes to insure the well-being of the entire business community. In addition, we are now entering into the third year of activity of the Redevelopment project sponsored by the City of Chula Vista. The enthusiasm with which this project has been greeted has been most gratifying, It has, moreover, convinced the Association of the fact that the business community is really as extensive as the project area. Therefore, your Board of Directors voted unanimously to request that the City Council of the City of Chula Vista conduct a public hearing on December 11, 1979 to consider two amendments to the existing Parking and Business Improvement ordinance. The first would double your additional license tax. If, for example, you are presently paying one times your general license tax, you would now be paying twice your general license tax. As you know, that money does not go to the City, but is budgeted and expended by the Association strictly within the improvement area. Secondly, the area boundaries would be expanded to coin- cide with the Redevelopment boundaries. The details of the proposed changes are contained in the resolution attached hereto. we solicit your support in this effort.
