HomeMy WebLinkAboutReso 1979-9850Form No. 344 Rev. 2-79 RESOLUTION N0. 9850 follows: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 80-4, TP7IN OAKS CONDOMINIUMS The City Council of the City of Chula Vista finds as That in accordance with the attached Negative Declara- tion, IS- 79-7 and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Chula Vista Tract 80-4, Twin Oaks Condominiums and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-80-4 adopted on the 24th day of October 1979, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative sub- division map in accordance with Planning Commission Resolution No. PCS-80-4 . Project Setting DATE: 2254 Moore St August 10, 1978 San Diego 92110 The project involves .84 acres of property located at the southeast corner of E St. and Twin Oaks Ave. The site is currently developed with a 10 unit one story apartment building. Adjacent uses are primarily single family homes located to the north, east and south. A 26 unit multiple family complex is located to the west. The project is also adjacent to E St. which has a current ADT of 13,814 vehicles. There is a general lack of any significant vegetation or wildlife on-site, and there are not any geologic hazards or adverse soils conditions known to be present in the immediate area. B. Project Description The applicant proposes to retain the existing 10 unit structure and construct an additional 14 units on the eastern portion of the site. The structure will be approximately 30 ft. in height, including roof, and will be three stories in height. Parking for 30 vehicles will be located at ground level and fourteen 1 bedroom condominum units will be housed on the 2nd and 3rd floors. Private balconies are planned and over 10,000 sq. ft. of landscaping, including walkways, will be provided. C. Compatibility :pith zoning and plans The project area is zoned for R-3 development which allows a maximum density of 32 units per net acre. The subject proposal will result in a density of about 29 units/net acre. The project is also in r_onformance with the site's high density (13-26 dwellings/gross acre) land use designation on the General Plan. D. Identification of environmental effects 1. Noise The project is located adjacent to a major roadway which has an ADT of approximately 13,800 vehicles. Such a high traffic flow has the potential to generate significant intrusive noise 200 Twin Oaks Firstwest Devco ~~~~ levels. The proposed structure will be located about 112 ft. from E St. According to SWING noise analysis guidelines, structures located beyond 100 ft. of a low speed highway that has a daily traffic flow of 20,000 vehicles or less, will be subject to exter..,_< ,.~~~._ levels of a proximately 60 dB. Conventional construction would reduce t~is level by at least 15 dB and interior intrusion would then be reduced to an acceptable 45 dB. A detailed acoustical analysis may be required at the time of building permit issuance. 2. Aesthetics The project will be subject to the approval of the City's Design Review Committee which will review the architectural compatibility with existing structures. Also, since the proposed structure is adjacent to single family homes, a 6 ft. solid fence will be required along the property line as well as greater side yard setback to offset the buildings height. 3. Land Use Conflicts The project, if developed in accordance with the proposed site plan, would result in a building face containing balconies at the second and third stcry levels. This structure would be at a15 ft. setback from the rear property line of the single family dwelling located to the east. The building would be about 150 ft. in length. The single family dwellings have a substantial rear yard set back of 60-80 ft. with garages located in the rear yards at a setback of 20-30 ft. The intrusion of this three story structure with balconies along the eastern side of the building will. restrict the privacy of the rear yard areas of adjacent single family dwellings. The effect of the project may be substantial and adverse, but as defined in CEQA, this is not an environmental effect. 4. Schools The local junior high school is currently over capacity. However, all of the units are one bedroom and generation of junior high school students is not anticipated. The school districts do not charge any fees for one bedroom units. ~~s~ 2 E. Findings of insignificant impact 1. The project site is within urban Chula Vista and has been developed for many years. There is a general lack of significant natural or m. =sources and no geologic hazards or adverse soil condition is known to exist within the vicinity. 2. The proposed condominiums are in conformance with the General Plan and associated elements and is not anticipated to achieve short term to the disadvantage of long term environ- mental goals. 3. No significant impacts have been identified and none are expected to occur which could interact and result in a substantial cumulative effect on the environment. 4. The project will not generate a significant increase in traffic, nor will a significant increase in related noise or emissions result. r^. OAKS COf2DOf4INIUMS '.WHEREAS, a tentative subdivision map for Chula Vista Tract PCS-80-4, Twin Oaks Condcminiums, ~r!as filed by Twin Oaks Realty Investors, to convert 10 existing apartment units and construct 14 additional units on the same lot for a condominium project at the southeast correr of Twin Oaks Avenue and "E" Street in the R-3 zone, and `;JHEREP,S, Section 66473.5 of the State Plap Act provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and WHEP.EAS, the Planning Commission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 24, 1979 in the City Council Chambers before the Planning Commission and said hearing was thereafter closed, and 'WHEREAS, the Planning Commission found that this project will have no significant environment impact and adopted the fJegative Declaration on IS-79-7. NOW, THEREFORE, BE IT RESOLVED F•S FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds as follows: a. The site is physically suitable for residential development and the pro?osed development conforms to all standards established by the City for such project. b. The design of the subdivision will not affect the existing improve- ments: streets, sewer, etc., which have been designed to avoid any serious health problems. c. The subdivision is consistent with the General Plan Elements as follows: 1) Land Use Element - The General Plan designation for the site is High Density Residential, 13-26 dwelling units per grass acre. The density of the project of 28 units per net acre is consistent with this designation. 2) Circulation Element - The adjoining streets are improved to /"~ handle the present traffic flow. a~ -~- 3) sousing Element - While the conversion of the 10 existing mits ~;;iil reduce the city's apartment unit inventory, it Nill offer an expanded choice of ownership. Since the develop- ment contains less than 50 units, it is exempt from the requirement to address the need to provide for low and ~~oderate income families. 4) Conservation; Open Space and Parks and Recreation Elements - No parks are planned on the site and the developer will be assessed fees in lieu of park land dedication. 5) 'Joise Element - The property is not subject to objectionable noise levels. 6) Seismic Safety and Safety Elements -The developmen+: is not adjacent to or on any known fault systems. 7) Scenic Highways Element - The site does not abut a Scenic Highway or gateway. 8) Bicycle Route Element - No bicycle routes are proposed adjacent to the site. 9) Public Buildings Element - "7o public buildings are proposed on the site. 2. The Planning Commission recommends to the City Council that the tentative map for Chula Vista Tract 80-4, Tvdin Oaks Condominiums, be approved subject to the condition that a construction permit be obtained for the wheel- chair ramp and driveway on "E" Street prior to approval of the final map. 3. That this resolution be transmitted, along with the tentative map, to the City Councii, and a copy of this resolution be transmitted to the applicant.
