HomeMy WebLinkAboutReso 1979-9849Form No. 344 Rev. 2-79 RESOLUTION N0. 9849 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 79-12, HUDSON VALLEY ESTATES UNIT NO. 2 The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declara- tion, IS-79-58 and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Hudson Valley Estates Unit No. 2 and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No.PCS-79-12 adopted on the 24th day of October , 1979, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative sub- division map in accordance with Planning Commission Resolution No. PCS-79-12 . PROJECT SETTING DATE: MAY 9, 1979 THE PROJECT INVOLVES 2.58 ACRES OF PROPERTY LOCATED ALONG THE WESTERN SLOPE OF A CANYON BETWEEN THE NORTHERLY EXTENSION OF LAS FLORES DR. AND SECOND AVE. CURRENTLY THE SITE IS DEVELOPED WITH ONE SINGLE FAMILY DWELLING, FRONTING ON SECOND AVE. AND SEVERAL SMALL, WOODEN SHEDS LOCATED ON THE SLOPE OF THE CANYON. AND THE REMAINING FOUR LOTS WILL FRONT ALONG LAS FLORES DR. CONSTRUCTION PADS FOR THE FOUR DWELLINGS UNITS TO BE LOCATED WITHIN THE FLOOR PLAIN WILL BE RAISED TO THE 36 FT. BUILDING SITES WILL BE RAISED ABOVE THE I~~ YEAR FLOOD PLAIN AND RECOMMENDATIONS STATED WITHIN A PREPARED SOILS REPORT WILL BE FOLLOWED TO MITIGATE SOILS AND SLOPE STABILITY RELATED IMPACTS. AESTHETIC QUALITY OF RESULTING LAND FORM WILL ALSO BE ENSURED BY PRESCRIBED MITIGATION. 2. THE PROPOSED SUBDIVISION iS IN BASIC CONFORMANCE WITH THE LAND USE ELEMENT OF THE CHULA VISTA GENERAL PLAN AND WILL NOT ACHIEVE SHORT TERM TO THE DISADVANTAGE OF LONG TERM ENVIRONMENTAL GOALS. 3. IMPACTS CAN BE MITIGATED AND NONE ARE ANTICIPATED TO OCCUR WHICH COULD INTERACT TO CREATE A SUBSTANTIAL CUMULATIVE EFFECT ON THE ENVIRONMENT. 4. VISTA TRACT 79-12, HUDSOiI VALLEY ESTATES UNIT i10. 2 ~r1HEREAS, a tentative subdivision map for Chula Vista Tract 79-12, Hudson Valley Estates Unit flo. 2, was filed by Poletta Sue Hudson on October 8, 1979, to subdivide 2.35 acres into 9 single family lots, and IvHEREAS, Section 66473.5 of the State Flap Act provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan ot" the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public 'rieariny to consider said tentative map, and notice of said hearing, with its purpose, was given by the oublication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and 4JHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 24, 7979 in the City Council Chambers before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that the proposed project will have no significant environmental impact and adopted the Negative Declaration on IS-79-58. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that the subdivision map r'or Chula Vista Tract 79-12, Hudson Valley Estates Unit 'Jo. 2, is consistent with the goals and objectives of the Chula Vista General Plan based on the following: a. Land Use Element - The General Plan designates this site for ^ledium Density Residential development (4-12 dwelling units per gross acrej. The proposed project density of 3.9 dwelling units per acre is consistent with this designation. b. Circulation Element - The development will extend Las Flores Drive in conformance with General Plan standards. c. Housing Element - Inasmuch as the subdivision contains fewer than 50 lots, it is exempt from the requirement to address the need to provide 10% of the units for low and moderate income families. d. Conservation, Open Space, and Parks and Recreation Elements - None of the areas proposed for conservation or open space on the vari- ous plan diagrams of the General Plan are affected by the subject proposal. The developer will be assessed fees in lieu of park cf`~ land dedication. R~ e. ';oise Element - The lots ~.vill not be subject to objectionable noise levels. f. Seismic Safety and Safety Elements - The development is not adjacent to any known fault systems. Extension of public improve- ments, right-of-way ~r~idths, and turn-arounds meet or exceed element standards. Although a portion of the property is within the Sweetwater Valley 100 year flood plain, the prelim- inary grading plan indicates de;elling units will be elevated above said flood level. g. Scenic Highways Element - The site does not abut a Scenic Highway or gateway. h. Bicycle Routes - .lo bicycle routes are proposed on or adjacent to this site. i. Public Buildings Element - Public buildings are neither proposed nor required on the site. 2. The Planning Commission recommends to the City Council that the tentative map for Chula Vista Tract 79-12, Hudson Valley Estates Unit Plo. 2, be approved, subject to the following conditions: a. A preliminary grading plan shall be submitted to the Planning Department and Engineering Division for approval prior to City Council action on the final map. The grading plan shall encompass all properties upon which cut and fill is proposed. b. The grades on Las Flores Drive shall be subject to approval by the City Engineer. Las Flores Drive shall be constructed at such elevation as to be passable by vehicles during a 100 year storm. c. The subdivider shall be responsible for the construction of full street improvements in that portion of Las Flores Drive within the subdivision boundary and to 10 feet east of the centerline of said street along said portion. The subdivider shall be responsible far dedicating 38 feet of tine 52 feet of ultimate right-of-way for Las Flores Drive within and along the subdivision boundary prior to recordation of the final map. d. The subdivider shall be responsible for the construction of off- site improvements to provide access from "D" Street to the sub- division if existing conditions remain the same. Said improve- ~,p q ments shall include, but not be limited to, A. C, pavement, 24 `~ - 2 - feet in width, and street lights. The subdivider shall be responsible for dedicating 30 feet of the 52 feet of ultimate right-of-way for Las Flores Drive from "D" Street to the sub- division boundary nrior to recordation of the final map. e. The subdivider shall be responsible for the construction of a temporary cul-de-sac adjacent to the northerly subdivision boundary. Said cul-de-sac shall have a minimum radius of 28 feet. An A.C. bean shall be constructed around the cul-de-sac. The subdivider shall obtain the required letters of permission from adjacent property owners and a permit from the County of San Diego to construct the cul-de-sac prior to approval of the final map. f. The owner shall dedicate an additional 4 feet of right-of-way for street purposes to the City along Second Avenue adjacent to Lots 1 and 2 prior to recordation of the final map. g. The owner shall dedicate to the City, by grant deeds, one foot control lots in Las Flores Drive as determined 6y the City Engineer prior to approval of the final map. h. The developer shall be responsible for the construction of a gravity set-~er to serve the subdivision. The sewer shall be constructed northerly from the southerly subdivision boundary to a downstream location approved by the City Engineer. The developer shall be responsible for acquiring and dedicating all necessary easements for construction and maintenance of the sewer prior to approval of the final map. The developer may request a reimbursement district and a repayment diagram for those portions of the sewer which benefit other properties. i. The developer shall be responsible for the construction of the storm drain in Las Flores Drive adjacent to the subdivision. The developer shall also be responsible for the construction of offsite drainage facilities as determined by the City Engineer. The developer shall acquire, and dedicate to the City, all neces- sary easements and right-of-way for the construction and main- tenance of the required drainage facilities prior to approval of the final map. The developer may request a reimbursement ~~ district and repayment diagram for those portions of the storm ~~ drain which benefit other properties. -3- j. The owner shall grant easements for street tree purposes to the City along Ser_ond Avenue and Las Flores Drive prior to recordation of the final map. Easements shall be of sufficient width to provide fora total of 10 feet behind the sidewalk. k. The developer shall not oppose or object to the formation of an improvement act district to install improvements in Las Flores Drive. 1. The development of Lots 3, 8 and 9 shall conform to the criteria as set forth in Section 19.22.150 of the Municipal Code. m. The developer shall establish joint access easement agreements for the Zl foot wide drive area serving Lots, 3, 8 and 9. 3. That this resolution be transmitted, along with the Tentative PJap, to the City Council, and a copy of this resolution be transmitted to the applicant.
