It is my RECOMMENDATION: That Council adopt resolution and direct the City Clerk to record the easement documents. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: The City Council has approved, in the CIP budget, the construction of a gravity relief sanitary sewer main therefore allowing for elimination of the Rosebank Sewer Pump Station. The pump station is located in the alley north of "D" Street, east of Second Avenue. The alley is proposed to be the northerly extension of Las Flores Drive. The sewer main will be constructed from the pump station northerly to tie into the sewer main constructed by (KOA) Kampground Enterprises, Inc. To construct the sewer, it is necessary to obtain 9 sewer easements from the adjacent properties. (See attached plat). Engineering was able to obtain 7 of the 9 easements required. These easements were given to the City by the cooperating property owners. Two property owners have not agreed to grant the required easement. One is Mr. Peter DeGraaf, who owns the property in the County between the northerly City limits and KOA, a distance of approximately 187 feet. Ms. Nancy L. Perrott of 47 Second Avenue is the other property owner. Engineering is presently making an appraisal of the two properties for purposes of acquisition. My intention is that we acquire the property either by direct purchase, easement purchase, or through the City's power of eminent domain. This project will be financed through the Sewer Income fund. Cost of the project, including right-of-way acquisition will be assessed against the benefited properties at the time they connect to the sewer. Those properties that have granted the sewer easements voluntarily will not be assessed right-of-way costs. The easements acquired are as follows: ~y „ ~ ~w ASSE SSOR'S PARCEL N0.
