ITEM TITLE: Resolution /DDe?SLRequesting consent of the City of San Diego
to permit extension of sewer service beyond City limit

The City and Kampground Enterprises have executed an agreement
where under Kampground Enterprises would be allowed to connect to the
Chula Vista sewer system. Annexation of Kampground Enterprises property
has been placed in suspension. Written consent of the City of San Diego
is required prior to serving any property beyond the City limit as
provided in the Metro Sewer Agreement with the City of San Diego.
RECOMMENDATION: That Council adopt resolution.

DISCUSSION:
On September 27, 1978, Kampground Enterprises, Inc. filed an application
for annexation to the City. The proposed annexation (19.75 acres
easterly of Edgemere Avenue) would create an unincorporated island west
of Edgemere Avenue. It would additionally create financial problems
relative to the Lower Sweetwater Fire Protection District.
Because of the problems associated with the annexation, the Local Agency
Formation Commission refused to support the proposal. The annexation
is, therefore, in suspension pending resolution of the problems which it
would create.
On December 12, 1978, (Resolution 9406) the City Council entered an
agreement with Kampground Enterprises, Inc. (K. E. Inc.) for joint
financing of a sanitary sewer through K.E. Inc. property. It further
provides for contractual sewer service by the City prior to the time of
annexation to the City. In view of the suspended nature of the
annexation, it appears appropriate to proceed with a contractual
arrangement to provide sewer service to K.E. Inc. properties. K.E.
Inc. has indicated its desire to continue with development of their
property.
The City cannot provide sewer service to properties beyond the City
limit without first obtaining permission to do so from the Metro Sewer
authorities. The attached resolution requests such permission.
While the property owner (K.E. Inc.) could annex to the Spring Valley
Sanitation District immediately, such an action would have to be
subsequently rescinded (upon annexation to Chula Vista). The City
Engineer considers pre-annexation connection to the Chula Vista system
to be the most practical solution to the problem.
