HomeMy WebLinkAboutReso 1980-10033Revised 3-26-80 RESOLUTION NO. 10033 follows: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT 80-11, VISTA ARIZONA The City Council of the City of Chula Vista finds as That in accordance with the attached Negative Declara- tion, IS-78-83, and the findings therein, the proposed tentative map will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be.known as Chula Vista Tract 80-11, Vista Arizona and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-80-11, adopted on the 27th day of February, 1980, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein, and WHEREAS, the Council certifies that it has considered its decision in approving this tentative map on the housing needs of the region and has balanced those needs against the public service needs of the residents of Chula Vista and available fiscal and environmental resources; the Council hereby determines that this 12 unit condominium development will not adversely affect the housing needs of the region but will partially satisfy those needs without adversely affecting the city's ability to provide service to the existing residents of the community and the new residents of the project; the Council furthermore has determined that it concurs with the Planning Commission's finding of no significant effect on the environment from this one lot development. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative subdi- vision map in accordance with Planning Commission Resolution No. PCS-80-11. BE IT FURTHER RESOLVED that condition 2e of said Planning Commission Resolution No. PCS-80-11 be, and the same is hereby amended to read as follows: 2e. The developer shall be responsible for the con- struction of the north half of the drainage channel adjacent to the property. He shall pay to the City the sum of $8,000 to cover the cost of construction of said channel at such time as the Army Corps of Engineers shall have completed plans for the total construction of the channel. Project Settinct The project involves .42 acres of property located on the south side of Arizona St. between Broadway and 5th Ave. The site is currently developed :with 3 dwellings and is adjacent to two family and multiple family homes. The rear of the property involves a aortion of the Telegraph Canyon Creek drainageway and is subject to inundation. There are no significant natural resources kno:an to be present and the area appears to be void of any significant vegetation. B. Project Description The proponent proaoses to remove the existing structures and con- struct a 12 unit apartment building. The structure will be located to the rear of the property and on-site parking for 22 vehicles will be located adjacent to Arizona St.. Landscaping in accordance with the City's Landscape D4anual :gill be required. Grading Fer pad preparation will ?rimarily be e::port, however some may be placed near the existing drainage channel on the southern portion of the site. C. Compatibility caith zoning and clans The proposed project is in conformance with existing R-3 zoning and the high density residential land use designation indicated on the Ganeral Plan. D. Identification. o_* environmental effects. Drainage The portion of the site adjacent r_o Telegraph Canyon Creek is subject to inundation. Improvement of this drainage channel may be required. A study to determine what the level of flood ~•aaters would be, and at :chat ~1oor level the residential units caill have to be constructed will have to be undertaken. This could result in a substantial design chance. , Schccls The local elementary and junior high schools are currently over capacity. ~dditional students from the project will further this burden on educational facilities. The developer ~.ai11 be required to obtain written assurance from the appropriate school districts that adequate facilities will be available to nec•r students. Parks The projec*_ is located within City park district no. 6.02 where there are currently no park facilities. Park fees in lieu of land dedication will be required by the City to contribute toward the future purchase of parklands within this district. ... ~itication measures necessary to avoid 1. Park fees in lieu of land dedication are also required. F. Findings of insignificant impact 1. The project site is developed with dorellings and appears void of am- significant natural resources. There are no known geologic hazares within the immediate area. Compliance ~.aith the reccmmendation of the flood hazard study will avoid significant hazards due to inundation, 2. The proposed apartment building is in conformance with the land use element of the General Plan and is not anticipated to achieee short term to the disadvantage of long term environ- mental coals. 3. Potential impacts can be mitigated to an acceptable level and no impacts which could interact to create a substantial cumulative effect on tiie environment are anticipated. 4. The project is not anticipated to generate any substantial traffic volume orelated noise or emissions. No hazard to humans is e:<pected to occur. 003 1 f G. PCS-80-11 RESOLUTION OF THE CITY PLANNING COPIMISSION RECOMP1ENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISIOfJ MAP FOR CHULA VISTA TRACT 80-11, VISTA ARIZONA WHEREAS, a tentative subdivision map for Chula Vista Tract 80-11, Vista Arizona, was filed by Christian f4. Galichon on December 27, 1979 to develop a one lot, 12 unit condominium project at 582 Arizona Street in the R-3 zone, and WHEREAS, the Planning Commission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a. hearing was held at said time and place, namely 7:00 p.m., February 27, 1980 in the City Council Chambers before the Planning Commission and said hearing was thereafter closed, .and WHEREAS, the Planning Commission found that in accordance with the findings listed in the Negative Declaration on IS-78-83 this project will have no signif- icant impact. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission concerning the develop- ment, the Commission finds as follows: a. The site is physically suitable for residential development and the proposed project conforms to all standards established by the City for such development. b. The design of the subdivision will not affect the existing public improvements and the existing drainage will be required to be fmproved, thereby avoiding any serious health problems. c. The subdivision is in substantial. conformance with the General Plan Elements as follows: Land Use Element - The proposed density of slightly less than 28 units is ih conformance with the General Plan designation for this area of 13-26 dwelling units per gross acre. Circulation - The adjoining street is improved to handle the ry, present and ultimate traffic flow. Since the project contains less than 50 units it J• Pxempt from . providing housing for low and moderate income families. Conservation, Open Space and Recreation Elements - No parks are planned on the site and the developer will be assessed fees in lieu of park land dedication. Noise Element - The property is not subject to objectionable noise levels. Seismic Safety and Safety Elements - The development is not adjacent to or on any known fault systems. Scenic Highways Element - The site does not abut a Scenic Highway or gateway. Bicycle Route Element - No bicycle routes are proposed adjacent to the site Public Buildings Element - No public buildings are proposed on the site. 2. The Planning Commission recommends to the City Council that the tenta- tive map for Chula Vista Tract 80-11, Vista Arizona, be approved, subject to the following conditions: a. The owner shall grant a 7' foot wide easement along Arizona Street to the City for street tree .purposes. b. The existing driveway to be removed shall be replaced with mono- lithic curb, gutter and sidewalk. The proposed driveway shall be 24 feet wide ahd an excessive width. driveway permit shall be obtained prior to itS construction. The foregoing work shall .be accomplished under a separate construction permit. c. The CC&R's shall be amended to prohibit the installation of .outside T.V. or radio antennas in accordance with the city code (Article 2.6 of ,the CC&R's). d. The owner shall grant to the City the 11 foot wide drainage ease- ment (adjacent to the existing 20 foot wide drainage easement at the southerly end of the property) shown on the tentative map as ".proposed 11 foot drainage easement." e. The developer shall be responsible for the construction of the north half of the drainage channel adjacent to the property. He may request a deferral since there is an anticipated Army Corps of Engineers drainage improvement project. If said deferral is approved, then the developer shall post a bond with the City in an amount to be approved by the City Engineer in order to guarantee the installation of said improvements. Specifics of the bond ,shall be determined prior to consideration of the f: map. _ ,~ f. Those areas of the subdivision which are subject to inundation due to a 100 year frequency flood shall be delineated on the final map. g. A minimum distance of 6 feet shall be maintained between tine ,building and proposed retaining wall located at the northerly edge of the drainage easement. h. The applicant and/or all subsequent owners shall be obligated for the construction costs for fencing as required by the Director of Public Works and to perform all necessary grading, provision of access, and landscaping as determined by the City Planning Director within 60 days after completion of the proposed drainage channel .along the South property line. 3. That this resolution be transmitted, along with the ,tentative map, to t:he City Council, and a copy of this resolution be transmitted to the applicant.
