City Engineer
SUBMITTED BY
ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO x )
BACKGROUND:
On August 31, 1979, Sunset Pools applied for a Building
Permit to construct a swimming pool at 449 Westmont Court.
The plot plan submitted with the application showed the pool
to be 4 feet inside the rear property line. No easements
are within the property and no other conflicts were found in
the course of reviewing the application. Issuance of the
permit was cleared by the Engineering Department.
During construction of the pool, the Parks & Recreation
Department discovered that a 10-foot section of the
irrigation system in the open space lot adjacent to the
subject property had been torn out.
Further investig ation by Engineering staff resulted in the
finding that the pool encroaches into the open space lot by
2-1 /2 feet. It was also determined that the owner had built
his patio 10 feet into the open space lot.
