The plot plan submitted with the application showed the pool to be 4 feet inside the rear property line. No easements are within the property and no other conflicts were found in the course of reviewing the application. Issuance of the permit was cleared by the Engineering Department. During construction of the pool, the Parks & Recreation Department discovered that a 10-foot section of the irrigation system in the open space lot adjacent to the subject property had been torn out. Further investig ation by Engineering staff resulted in the finding that the pool encroaches into the open space lot by 2-1 /2 feet. It was also determined that the owner had built his patio 10 feet into the open space lot. P' .~ F o rm A-113 (Rev. 5/77) Agenda Item No. 8 For Meeting of 10/9/79 Supplemental Page Two On September 20, 1979, Mark Webster of Sunset Pools, acting as Agent for the owner, Thomas Karins, submitted a request f_or an Encroachment Permit for the pool and patio. Protective fencing must also be installed. In accordance with Ordinance No. 18~~, the f_ee of $00.00 was paid for processing this Permit. The encroachment does not constitute a safety or health hazard to the general public nor is it a detriment to the appearance of the area. I recommend that City Council approve the Encroachment Permit with the following conditions: 1. Total encroachment into the open space lot for the swimming pool, decking and protective fencing shall not exceed 7 feet. 2. No additional patio construction involving further encroachment into the open space lot shall be accompl fished . ~. Any landscaping within the fenced area of the open space shall be maintained by the owner. 4. The irrigation system which was damaged shall be repaired and relocated around the pool and fence to the satisfaction of the Director of Parks and Recreation. The owner shall bear the costs of such repairs and relocation.
