CALIFORNIA
The City Attorney's office advised you by letter on August 2.1,
1974 that if health violations continued at your place of bus-
iness at 4900 Otay Valley Road, the same would be declared a
public nuisance and subject to inunediate abatement.
Unfortunately, it is my duty to inform you that receipt of
information from the Sari Diego County Public FIealth Depart-
ment has led me to conclude the conditions at your premises
do, in fact, constitute a public nuisance and you will be
subjected to abatement proceedings.
Specifically, the following violations have been found:
1. You are required by the terms of Chula Vista City
Code Section 15.37 to take every precaution to keep
your premises free of rats, mice, rodents, ants and
other vermin and pests. The Public Health Officer
supplied me with evidence showing that your operation
does, in fact, harbor and permit the continued breeding
of rodents, vermin, etc.
2. Chula Vista City Code Section 4.7 requires that all
dead birds or animals or skins shall be kept in tight
containers or rerloved from the premises at least every
seven days. It also requires inter alia that runs must
be kept clean and that animal droppings and food scraps
shall be removed from the premises at least once a week.

3. Section 20.31 of the Chula Vista City Code requires
you to eliminate any place within your property that is
a breeding place for flies or mosquitoes. Such areas as
permit the breeding of flies or mosquitoes are declared
to be public nuisances.
4. Section 20.33 of the Chula Vista City Code addition-
ally provides that failure to elirinate the public nuisance
mentioned in r1o. 3 above is a misdemeanor subjecting you
to criminal prosecution. Further, Section 20.33 of the
Chula Vista City Code states that each day you permit a
Violation to continue is grounds for filing of a separate
criminal charge.
The City of Chula Vista has no choice but to institute abate-
ment proceedings against your ope~it.ion. Further, if ir~nediate
remedial steps are not taken to alleviate the public health
hazards, you will be criminally charged under Sections 20.31
and 20.33.

matter, please contact me.
