Chairman Cannon reviewed the composition of the Planning Commission,
its responsibilities and the format of the meeting.
APPROVAL OF I~INUTE~ - meetings of August 14 and August 28, 1985
Commissioner Green pointed out that in the minutes of August 14,
on page 8, the next to the last paragraph, the name should be
changed from Commissioner Green to Commissioner cannon who asked
about a conflict of interest.
MSUC (Guiles/Tugenberg) to approve the minutes of the meeting of
August 14, 1985 with the correction noted. Commissioners O'Neill
and Carson abstained.
MSUC (Guiles/Tugenberg) to approve the minutes of the meeting of
August 28, 1985, as mailed. Commissioner O'Neill abstained.

1. PUBLIC HEARING: (Continued) Conditional Use Permit PCC-84-11:
Requests permission to establish a church and
day school facility at the northwesterly corner
of East "H" Street and Buena Vista Way - Pilgrim
Lutheran Church
Principal Planner Lee noted that this hearing was continued from the
meeting of August 14 to obtain additional information on the acous-
tical effects and data on private school standards. He advised that

the acoustical study is underway and a workshop for the Commission
to discuss private school standards has been set for September 18.
It is, therefore, appropriate to continue the hearing to October 9.

to the meeting of October 9, 1985.
2. PUBI~IC HEARING, EIR-85-$ - East!~e 0ta¥ Water District
Improvements Draft Environmental Impact Report
Environmental Review Coordinator Reid advised that this is a supple-
mental environmental document to the Master EIR for the EastLake
project. Chula Vista is assuming the lead agency role in preparing
the supplemental document due to the background information obtained
for the ~'iaster EIR. This procedure has been cleared through the
State Resources Agency.
When the final EIR is prepared the Planning Commission will be asked
to certify that it has been prepared in compliance with CEQA; the
0tay Water District will certify that they haye reviewed the infor-
mation in this document when they reach a decision on the projecT.
The State Clearing House has indicated there is no further input from
any state agency. This evening a letter was received from Longley-
Cook Engineering which will require a response in the final EIR.
Therefore, it is recommended that the final EIR be considered on
September 25th after closing the public hearing this evening.
David Claycomb, Westec Services, San Diego, reported that they were
hired to prepare this supplemental report because of the knowledge
they gained in preparation of the EIR for EastLake. This project
consists of the installation of water mains, reservoirs and pump
stations necessary to service not only the EastLake development but
adjacent areas as well.
Since this is not a development project that would generate traffic,
the report focuses on specific issue areas. Those areas include:
visual quality, noise, construction, paleontology and growth induce-
ment. ~r. Claycomb outlined the mitigation measures contained in the
report to offset each of those effects. He advised that the areas of
archeology, biology and geology had also been considered and it was
determined the project would have no effects in those areas.
This being the time and place as advertised, the public hearing was
opened.
Franne Ficara of Loos Forward Hamilton and Scripps, ll0 West A
Street, San Diego, advised that the comments contained in the letter
from Longley Cook had been discussed with Mr. Santos of EastLake and
he had no objection to those comments.

In response to a question from Co~nissioner Tugenberg, Er. Ralph
Barber, representing 0tay Water District, 10595 Jamacha Blvd.,
Spring Valley, stated that the construction of the water reservoir
will be under the direction of the 0tay Water District and they will
impose on the contractor and designer all conditions imposed in the
EIR.
Commissioner Tugenberg referred to the reservoir on the south side
of East "H" Street, between 805 and 0tay Lakes Road, which he felt
dominates the scene and is not sufficiently screened by the trees
planted around it. He asked about undergrounding the reservoir or
constructing a berm around it to raise the landscaping.
~r. Barber advised that the reservoir at Project No. 6 will be cut
into the side of a hill which will lessen the visual impact and
assured they will do everything possible to further mitigate that
impact with landscaping.
In response to a suggestion from Chairman Cannon, Mr. Barber con-
curred that the final EIR can be more specific in suggesting miti-
gating measures for visual impact, including species of trees and
shrubs, color of paint, and the possible use of a berm, if feasible.
As no one else wished to speak, the public hearing was closed.

3. PUBI~O HEARING, PCS-86-1 - Consideratio~ of tentative subdivision
map for. EastLake Area R-13 ~Villa Nart~nieue)
Chula Vista Tract 86-1 - Barratt San DleMo
Principal Planner Lee pointed out the location of the l0 acre site
in the EastLake Shores area, which abuts the SDG&E power line to
the east and vacant residentially zoned p~o~erty ~o the north, west,
and south. This~plan contains 232 condominium un~ts, which is less
than the 250 units approved for the area under the target density in
the EastLake plan. Each unit will have a single car garage, with
additional parki~ spaces provided for the 130 two-bedroom units and
52 guest parking spaces interspersed throughout the project.
The site is served by two priviate streets, with access from the
loop road and from the road to the future shopping center. The
entrances will be identified by landscaping or enriched paving
material areas.
Slides were displayed showing the layout of the project, including
a recreation building, pool, and open space area to serve as the
focal point of the project; also, the architectural renderings of the
two-story residential structures of Mediterranean style. The project
has been approved by the Design Review Committee.

Mr. Lee called attention to the ll conditions for approval listed
in the report and pointed out that condition "k" should require
that the private street system be "named," rather than "paved,"
prior to submission of the map to the City Council.
Commissioner Green reported that he has had complaints from condo-
minium associations concerning problems with guest parking spaces
being taken by residents. He asked if the CC&R's could contain
some teeth to deal with this problem.
This being the time and place as advertised, the public hearing
was opened.
Jim Devlin, Barratt San Diego, 3615 Kearney Villa Road, San Diego,
expressed their pleasure at being part of the EastLake development
and their pride in the development concept of this project. In
answer to Commissioner Green's concern, he stated that they meet
with the homeowners association in establishing rules for their
project, but they cannot dictate the rules.
Commissioner Green suggested that the CC&R's should contain a means
of enforcing the rules of the association through fines.
Chairman Cannon suggested that this problem be discussed at a study
session.
Commissioner Giles asked who will be responsible for maintaining
the landscaping in the project.
Mr. Devlin advised that typically the developer sets up a management
association in contract with the homeowners association to be respon-
sible for the maintenance.
As no one else wished to speak, the public hearing was closed.
Assistant City Attorney Gill pointed out that condition "j" provides
for inclusion in the CC&R's for maintenance of private streets and
parking areas. He suggested adding a sentence that, "Said CC&R's
shall include enforcement provision relating to assigned parking
spaces."

been prepared in accordance with CEQA and that the Planning Commission
has reviewed the information contained in each EIR prior to making a
decision on this project.
~SUC (Tugenberg/0'Neill) Based on the findings contained in Section
"E" of the report, the Planning Commission recommends that the City
Council approve the tentative subdivision map for EastLake Area 13
(Villa ~iartinique), Chula Vista Tract 86-1, subject to the conditions
specified in the report with correction on condition "k" changing
the word "paved" to "nmned" and adding to "j", "Developers shall
include in the CC&R's provision for maintenance of private streets
and parking areas, and in addition, such CC&R's shall include enforce-
ment regulations for parking."

4. PUBLIC HEARING, PCA-86-1 - Proposed Amendment to Section
19.14.070, 19.14.080, 19.14.090 and 19.14.Il0
of the Chula Vista Municipal Code pertaininM
to conditional use permit authority within the
Chula Vista Bayfront Redevelopment Project Area
Director of Planning Krempl noted that the recommendation in the
staff report was for a continuance of this item pending action by
the Redevelopment Agency. On September 10th the Redevelopment Agency
took an action which would allow the Commission to withdraw this
item. The staff recommends its withdrawal.
~r. Krempl explained that the proposed amendment would have changed
the authority on conditional use permits within the Bayfront area
from the Planning Commission to the Redevelopment Agency. After the
Planning staff expressed their concern with the proposed change, the
Co~nunity Development Department recommended against the proposed
change. Action taken by the Redevelopment Agency leaves the existing
procedure for conditional use permits unchanged, so the proposed
amendment can be withdrawn.
DIRECTOR'S REPORTs
- Director of Planning Krempl recalled that at a recent Commission
meeting two Commissioners were absent, and in once instance
another Commissioner had to abstain. As a result, the item did
not receive a majority vote of the Commission. He pointed out
that a recent change in the City Code states: "Where an applica-
tion is denied by the Planning Commission with less than four
votes, the applicant is entitled to a rehearing at the subsequent
Commission meeting or an appeal to the City Council without pay-
ment of any additional fees. The decision as to whether the ap-
plicant chooses to go on to the Council or come back to the
Planning Commission for rehearing is at the discretion of the
applicant." In a recent case concerning the relocation of a card-
room, the applicant chose to go on to the City Council. Mr. Krempl
suggested that when such cases appear, one option for the Commis-
sion is to continue the public hearing and take action at a subse-
quent meeting if the applicant is amenable.
- ~r. Krempl reported %hat on September 10th the City Council
announced the reappointment of Miss Carson for a full term on the
Planning Commission and the selection of Shirley Grasser to fill
the vacancy.
He announced there will be a workshop next Wednesday at 5,00 p.m.
to discuss, among other things, private school standards. Follow-
ing that workshop, a reception for Commissioner O'Neill has been
scheduled for 6~00 p.m.

CO~ISSION C01~ENTS:
- Chairman Cannon complimented Commissioner O'Neill on the service
he has rendered to the Commission, noting the experience and
background information he has displayed in discussing issues
that arise.
Commissioner O'Neill stated that the last eight years have been
- a rewarding ex erience for him. He has been i~pres~e~ du~in~
that time ~ithPthe professionalism and dedication ox oommlssmon
members and the staff.
- Commissioner Green added that Mr. O'Neill will be sorely missed
on the Commission due to the thoroughness of his consideration
of the issues that come up.
ADJOURh~ENT at 7:45 p.m. to the study session at 5:00 p.m. on
Wednesday, September 18, and the regular business meeting at 7:00 p.m.
on September 25, 1985.
